2、平方米。Party A hereby agrees to lease its property located at Unit , Shanghai, PRC, and the related facilities (including furniture and appliances) in good and tenantable condition to Party B for residential use. The size of the leased property is approximately m2. 乙方指定物业使用者为 。 The said Occupant is n.

3、四、 租赁期:Term of Tenancy:4.1 租赁期为 年,自 年 月 日至 年 月 日。 The above property is hereby leased for a term of 1 year(s), commencing on and expiring on . 4.2 租赁期满,甲方有权收回全部租赁房屋,乙方应如期交还。乙方如要求续租,须在本合同期满日前二个月向甲方提出书面申请,除了双方衷诚地协议续租的年期及租金外,双方将按于本合约相同的条款另行签订续租合同。 On expiry of the tenancy, Party A has the right to take

If Party B asks for renewing the lease, Party B shall give Party A 2 months written application in advance before the expiration date, and get the renewal agreement signed by both parties on the same terms an

5、d conditions as this Agreement save and except that the Parties shall negotiate and agree upon in good faith, the renewal terms and monthly rental.4.3 在租赁期满十个月后,乙方可以提前二个月书面通知甲方终止此合同,并同意甲方在此期间安排潜在客户参观该物业。After the tenth month of the tenancy, the Tenant may terminate this said Agreement by giving the

6、Landlord two (2) calendar months notice in writing, and agree the landlord to show the apartment to potential tenant. 在乙方付清本合同项下规定其应该支付的费用后十五个工作日内全额无息将二个月保证金如数归还乙方。如乙方在已经办理了退房手续支付所有的费用后十五个工作日内未收到甲方归还的全额押金,则视为逾期未归还押金,每逾期一天超出归还日期后未支付,乙方须按日加付租金 3 %的滞纳金。The two months deposit shall be returned to Party

7、B in full within 15 working days after the check-out procedure has been handled. If Party B did not receive the full amount of deposit after Party B has already paid all the relevant expenses within 15 working days, Party A should be liable to pay a penalty fee equal to 3% of the rent per day. 五、 租金

8、:Rent: 5.1 双方议定租金为每月人民币 圆整包括 物业管理费,发票税金,有线电视和卫星电视安装和使用费,电话及宽带的安装费用。 The rent agreed to by both parties during the lease term is RMB per month inclusive of management fee, invoice tax, cable TV and satellite TV installation & usage fee, telephone installation, broadband installation fee.5.2 乙方应提前支付甲方

9、每月的租金,应在每月的第 天或以前汇至甲方指定的银行帐号,支付租金日期以乙方汇出日期为准。乙方应以人民币形式支付租金。甲方需提供租金的付款通知单予乙方。Party B hereunder shall pay each months rent in advance, on or before the day of each calendar month, by transferring the amount of such rent to a bank account designated by Party A. The date of transfer shall be the date of

Party A shall provide debit note on rental. 乙方须于 年 月 日或在此之前,支付从 年 月 日起至 年 月 日(包括首尾两日)的首期租金人民币 On or before , Party B shall pay to Party A the rental for the period from to (inclusive), in the amount of RMB .5.3 如租金逾期支付,每逾期一天超出付款日期后七天仍未支付,乙方须按日加付租金3 %的滞纳金。如超过15天未付则视为乙方自动退租,构成违约,甲方有权收回出租房屋,并

11、追究乙方违约责任。If the rent shall be unpaid for seven (7) days after the rent shall become due and payable, Party B shall be liable to pay a late penalty fee equal to 3% of the rent per day. If the rent has not been paid more than 15 days after the due date, Party B will be deemed to have automatically ter

12、minated the tenancy resulting in a breach of this Agreement. Party A will then be entitled to take back the leased property and have recourse against Party B for breach of contract. 六、 保证金:Security Deposit:6.1 为确保租赁房屋及其设施之安全与完好及租赁期内相关费用之如期结算,乙方应在甲方提供该租赁房屋的产权证复印件(或预售/预租许可证)支付给甲方二个月租金额及管理费的租赁保证金计人民币 圆

13、整,做为乙方确保合同履行之保证金,保证金的支付日不得晚于起租日。乙方可以人民币形式支付保证金。甲方应在收到保证金的七个工作日内提供相应的正式收据给乙方。To ensure the welfare and good condition of the leased property as well as the prompt payment and settlement of all related charges during the term of the tenancy, Party B agrees to pay Party A security deposit equal to two

14、months rent and management fee in the amount of RMB as security for Party Bs hereunder once the copy of ownership certificate (or pre-sell / pre-lease permit) of the premises is provided. Party A shall provide the formal receipt to Party B within 7 working days after receiving the deposit.6.2 除合同另有约

15、定之外,甲方应于租赁期满或此合同提前终止之日且双方确认该租赁房屋的归还和乙方付清所有相关费用后的十五个工作日内将保证金全额无息退还乙方。Unless otherwise provided in this Agreement, Party A shall return to Party B the entire security deposit without interest in 15 working days after expiration of the tenancy or early determination of this Agreement and both parties h

16、ave confirmed the return of the premises and Party B has paid all related outstanding fees. 6.3 甲方因乙方违反本合同的规定而受的损失,可在保证金中扣抵合理数目,不足部分乙方必须在接到甲方付款通知后十天内补足。Party A may deduct a reasonable amount of security deposit towards payment of any actual damages Party A shall have incurred or suffered as a result

17、 of Party Bs breach of this Agreement. If the security deposit is not sufficient to cover such amounts, Party B must pay the deficiency within 10 days of the receipt of a demand from Party A.七、 其他费用: Other Charges:乙方应承担租赁期内的水、电、煤气、电话费、宽带月租费等,并按上海市公共事业局的帐单如期缴纳。Party B is responsible for paying water,

18、 gas, electricity, telephone charges and broadband monthly fee. Such charges shall be paid when due according to the bills from Shanghai Utility Bureau therefor received by Party B. 八、 出租人的责任: Landlords Obligations:8.1 甲方须按时将租赁房屋以良好可租赁状态交付乙方使用。办 理 交 房 手 续 前,甲,乙双 方 必 须 清 查 该 物 业 及 其 内 部 所 有 设 施 的 运 行

19、 情 况。 如 有 任 何 设 施 无 法 正 常 运 作, 则 应 被 视 为未 能 按 时 交 房, 直 至 视 察 时 所 有 设 施 及 设 备 均 呈 正 常 运 作 状 况。 在 此 情 况 下, 双 方 应 签 署 一 份 视察 情 况 记 录 一 式 两 份 并 且 作 为 本 合 同 的 一 部 分 以 示 房 屋 交 接 完 毕。Party A shall deliver on schedule to Party B the leased property in good and tenantable condition for Party Bs use. Prior to

20、 hand over both parties shall participate in a walk through inspection of the premises to inventory all facilities therein and ensure their proper working condition. Should any of the facilities or fixtures not be in working order the hand over will be deemed incomplete until such a time as they are

21、 in correct working order and inspected. The inventory / hand over inspection record will be made in duplicate and forms an integral part of this agreement.8.2 租赁期内甲方不得无故收回租赁房屋。(除非本合同另有规定)Party A shall not take back the leased property, without cause, during the term of the tenancy (unless otherwise

22、 stipulated in this Agreement).8.3 在乙方遵守本合同的条款及支付租金的前提下,乙方有权于租赁期内拒绝甲方或其他人骚扰(中华人民共和国法律规定除外)而安静享用租赁房屋。在租赁期内,租客将在租期开始时搬入自己的家具并在租期结束时搬出并承担此费用。该条款在合同的其他条款适用。Provided that Party B paying the rent and performing and observing Party Bs terms and conditions herein contain shall peaceably hold and enjoy the l

23、eased property throughout the term of this Agreement without any interruption by Party A or any other person save and except as required by the law of the Peoples Republic of China.During the leased term, furniture and goodsof the occupant will bedelivered to the apartment in the beginning of the Le

24、ase Term, and taken out of the apartment, at its end by his own expense and respecting the other provisions of the Agreement.8.4 甲方应维修并保持约定之物业外墙和主体结构,电力供应系统,有线电缆,下水道,地板,水管和外部窗架在良好及可使用状态下供居住人使用。租赁房屋的基本设施和结构(包括非乙方原因损坏的家具和电器)损坏时,甲方有修缮的责任并承担有关的费用,并对其作定期修保。若修缮7天后此租赁房屋仍无法居住,甲方应提供乙方一个同等于租赁房屋每日租金的房屋或酒店使用。 T

25、o maintain and keep or cause to be maintained and kept the outside building main walls of the said premises and the said building and the main structure, electricity supply cables, drains, floors, manholes, water pipes and exterior window frames of the said building at all times in a proper state of

26、 repair and condition. Party A is responsible for repairing and maintaining the basic facilities (including furniture and appliances not damaged by Party B), the structure of the leased property and for bearing all costs related thereto. During the repair period, Party A shall provide Party B anothe

27、r premise or hotel at the same daily rent if the leased property is not livable after 7 days. 8.5 甲方谨在此声明及保证甲方为租赁房屋的合法拥有人并有合法 地位出租此租赁房屋予乙方。就本合同及出租此租赁房屋予以乙方之事,甲方已取得所有有关机构的批准,包括政府批准及抵押权人的同意(如适用)。Party A hereby represents and warrants that Party A is legal owner of the leased property and has the neces

28、sary legal capacity to lease the property to Party B. Party A has also obtained all the necessary authorizations from all relevant authorities in the Peoples Republic of China in respect of this Agreement and the leasing of the property to Party B, including government approval and / or mortgage con

29、sent (if applicable). 8.6 如在租赁期内,租赁房屋发生所有权全部或部分转移、和其他影响乙方权益的事情时,甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本合同所有条款。如乙方于本合同下的权益受此等所有权人或第三者所影响或损害,甲方须负责补偿乙方的所有损失、损害、支出及费用。若甲方出售该租赁房屋,则乙方承诺将放弃优先购买权。If during the term of the tenancy, all or part of the leased property is transferred or Party Bs right to use leased prope

30、rty is affected, Party A shall ensure that such transferee or third party having an effect on Party Bs right to use the leased property will continue to abide by the terms of this Agreement. Party A shall keep Party B indemnified against any costs, expenses, losses and damages incurred to or suffere

31、d by Party B as a result of any of Party Bs interests herein are affected or prejudiced by such transferee or third party. Party B hereby agrees to give up the priority of purchasing if Party A sells the leased property.87 在 租 赁 期 间,甲 方 保证 提供 乙方承 租 的 房 屋是安全的 ,且不会 因甲方的原因干 扰 乙 方 的 正 常 居 住。如 因甲方的原因出现 周

32、 围 房屋 的 影 响,导 致 乙 方 不 能 居住 ,乙 方 有 权 终 止 合 约。乙方须接受并遵守物业管理处之管理公约.During the lease term Party A mustguarantee that Party B can live safely in the rented premises and that Party A will not disturb Party Bs regular dwelling . PartyBhastherighttoterminatetheagreementshouldthegeneral livingconditionssurroundingthePremisesaffectthePremisesinsuch degreethatapeacefullivingcannotbeobtained. Party B shall accept and a
