ThelargestfirmsinAmericaandBritaintogetherspendmorethan$15billionayearonCSR,accordingtoanestimatebyEPG,aconsultingfirm.Thiscouldaddvaluetotheirbusinessesinthreeways.First,consumersmaytakeCSRspendingasa“signal”thatacompany’sproductsareofhighquality.Second,customersmaybewillingtobuyacompany’sproductsasanindirectwaytodonatetothegoodcausesithelps.Andthird,throughamorediffuse“haloeffect,”wherebyitsgooddeedsearnitgreaterconsiderationfromconsumersandothers.

PreviousstudiesonCSRhavehadtroubledifferentiatingtheseeffectsbecauseconsumerscanbeaffectedbyallthree.ArecentstudyattemptstoseparatethembylookingatbriberyprosecutionsunderAmerica’sForeignCorruptPracticesAct(FCPA).Itarguesthatsinceprosecutorsdonotconsumeacompany’sproductsaspartoftheirinvestigations,theycouldbeinfluencedonlybythehaloeffect.

Thestudyfoundthat,amongprosecutedfirms,thosewiththemostcomprehensiveCSRprogrammestendedtogetmorelenientpenalties.Theiranalysisruledoutthepossibilitythatitwasfirms’politicalinfluence,ratherthantheirCSRstand,thataccountedfortheleniency:
