SubpartA—General

§145.1   Applicability.

Thispartdescribeshowtoobtainarepairstationcertificate.Thispartalsocontainstherulesacertificatedrepairstationmustfollowrelatedtoitsperformanceofmaintenance,preventivemaintenance,oralterationsofanaircraft,airframe,aircraftengine,propeller,appliance,orcomponentparttowhichpart43applies.Italsoappliestoanypersonwhoholds,orisrequiredtohold,arepairstationcertificateissuedunderthispart.

§145.3   Definitionofterms.

Forthepurposesofthispart,thefollowingdefinitionsapply:

（a）Accountablemanagermeansthepersondesignatedbythecertificatedrepairstationwhoisresponsibleforandhastheauthorityoverallrepairstationoperationsthatareconductedunderpart145,includingensuringthatrepairstationpersonnelfollowtheregulationsandservingastheprimarycontactwiththeFAA.

（b）Articlemeansanaircraft,airframe,aircraftengine,propeller,appliance,orcomponentpart.

（c）Directlyinchargemeanshavingtheresponsibilityfortheworkofacertificatedrepairstationthatperformsmaintenance,preventivemaintenance,alterations,orotherfunctionsaffectingaircraftairworthiness.Apersondirectlyinchargedoesnotneedtophysicallyobserveanddirecteachworkerconstantlybutmustbeavailableforconsultationonmattersrequiringinstructionordecisionfromhigherauthority.

（d）Linemaintenancemeans—

（1）Anyunscheduledmaintenanceresultingfromunforeseenevents;or

（2）Scheduledchecksthatcontainservicingand/orinspectionsthatdonotrequirespecializedtraining,equipment,orfacilities.

§145.5   Certificateandoperationsspecificationsrequirements.

（a）Nopersonmayoperateasacertificatedrepairstationwithout,orinviolationof,arepairstationcertificate,ratings,oroperationsspecificationsissuedunderthispart.

（b）ThecertificateandoperationsspecificationsissuedtoacertificatedrepairstationmustbeavailableonthepremisesforinspectionbythepublicandtheFAA.

§145.12   xxx

SubpartB—Certification

§145.51   Applicationforcertificate.

（a）AnapplicationforarepairstationcertificateandratingmustbemadeinaformatacceptabletotheFAAandmustincludethefollowing:

（1）ArepairstationmanualacceptabletotheFAAasrequiredby§145.207;

（2）AqualitycontrolmanualacceptabletotheFAAasrequiredby§145.211（c）;

（3）Alistbytype,make,ormodel,asappropriate,ofeacharticleforwhichtheapplicationismade;

（4）Anorganizationalchartoftherepairstationandthenamesandtitlesofmanagingandsupervisorypersonnel;

（5）Adescriptionofthehousingandfacilities,includingthephysicaladdress,inaccordancewith§145.103;

（6）Alistofthemaintenancefunctions,forapprovalbytheFAA,tobeperformedfortherepairstationundercontractbyanotherpersoninaccordancewith§145.217;and

（7）AtrainingprogramforapprovalbytheFAAinaccordancewith§145.163.

（b）Theequipment,personnel,technicaldata,andhousingandfacilitiesrequiredforthecertificateandrating,orforanadditionalratingmustbeinplaceforinspectionatthetimeofcertificationorratingapprovalbytheFAA.AnapplicantmaymeettheequipmentrequirementofthisparagraphiftheapplicanthasacontractacceptabletotheFAAwithanotherpersontomaketheequipmentavailabletotheapplicantatthetimeofcertificationandatanytimethatitisnecessarywhentherelevantworkisbeingperformedbytherepairstation.

（c）Inadditiontomeetingtheotherapplicablerequirementsforarepairstationcertificateandrating,anapplicantforarepairstationcertificateandratinglocatedoutsidetheUnitedStatesmustmeetthefollowingrequirements:

（1）Theapplicantmustshowthattherepairstationcertificateand/orratingisnecessaryformaintainingoralteringthefollowing:

（i）U.S.-registeredaircraftandarticlesforuseonU.S.-registeredaircraft,or

（ii）Foreign-registeredaircraftoperatedundertheprovisionsofpart121orpart135,andarticlesforuseontheseaircraft.

（2）TheapplicantmustshowthatthefeeprescribedbytheFAAhasbeenpaid.

（d）Anapplicationforanadditionalrating,amendedrepairstationcertificate,orrenewalofarepairstationcertificatemustbemadeinaformatacceptabletotheFAA.Theapplicationmustincludeonlythatinformationnecessarytosubstantiatethechangeorrenewalofthecertificate.

§145.53   Issueofcertificate.

（a）Exceptasprovidedinparagraph（b）,（c）,or（d）ofthissection,apersonwhomeetstherequirementsofthispartisentitledtoarepairstationcertificatewithappropriateratingsprescribingsuchoperationsspecificationsandlimitationsasarenecessaryintheinterestofsafety.

（b）IfthepersonislocatedinacountrywithwhichtheUnitedStateshasabilateralaviationsafetyagreement,theFAAmayfindthatthepersonmeetstherequirementsofthispartbasedonacertificationfromthecivilaviationauthorityofthatcountry.ThiscertificationmustbemadeinaccordancewithimplementationproceduressignedbytheAdministratorortheAdministrator'sdesignee.

（c）BeforearepairstationcertificatecanbeissuedforarepairstationthatislocatedwithintheUnitedStates,theapplicantshallcertifyinwritingthatall“hazmatemployees”（see49CFR171.8）fortherepairstation,itscontractors,orsubcontractorsaretrainedasrequiredin49CFRpart172subpartH.

（d）BeforearepairstationcertificatecanbeissuedforarepairstationthatislocatedoutsidetheUnitedStates,theapplicantshallcertifyinwritingthatallemployeesfortherepairstation,itscontractors,orsubcontractorsperformingajobfunctionconcerningthetransportofdangerousgoods（hazardousmaterial）aretrainedasoutlinedinthemostcurrenteditionoftheInternationalCivilAviationOrganizationTechnicalInstructionsfortheSafeTransportofDangerousGoodsbyAir.

§145.55   Durationandrenewalofcertificate.

（a）AcertificateorratingissuedtoarepairstationlocatedintheUnitedStatesiseffectivefromthedateofissueuntiltherepairstationsurrendersitortheFAAsuspendsorrevokesit.

（b）AcertificateorratingissuedtoarepairstationlocatedoutsidetheUnitedStatesiseffectivefromthedateofissueuntilthelastdayofthe12thmonthafterthedateofissueunlesstherepairstationsurrendersthecertificateortheFAAsuspendsorrevokesit.TheFAAmayrenewthecertificateorratingfor24monthsiftherepairstationhasoperatedincompliancewiththeapplicablerequirementsofpart145withintheprecedingcertificatedurationperiod.

（c）AcertificatedrepairstationlocatedoutsidetheUnitedStatesthatappliesforarenewalofitsrepairstationcertificatemust—

（1）Submititsrequestforrenewalnolaterthan30daysbeforetherepairstation'scurrentcertificateexpires.Ifarequestforrenewalisnotmadewithinthisperiod,therepairstationmustfollowtheapplicationproceduresin§145.51.

（2）SenditsrequestforrenewaltotheFAAofficethathasjurisdictionoverthecertificatedrepairstation.

（d）Theholderofanexpired,surrendered,suspended,orrevokedcertificatemustreturnittotheFAA.

§145.57   Amendmenttoortransferofcertificate.

（a）TheholderofarepairstationcertificatemustapplyforachangetoitscertificateinaformatacceptabletotheAdministrator.Achangetothecertificatemustincludecertificationincompliancewith§145.53（c）or（d）,ifnotpreviouslysubmitted.Acertificatechangeisnecessaryifthecertificateholder—

（1）Changesthelocationoftherepairstation,or

（2）Requeststoaddoramendarating.

（b）Iftheholderofarepairstationcertificatesellsortransfersitsassets,thenewowner
