　　中华人民共和国著作权法实施条例【1】

　　RegulationsfortheImplementationoftheCopyrightLawofthePRC

　　第一章一般规定

　　CHAPTERIGENERALPROVISION

　　第一条根据中华人民共和国著作权法（以下简称著作权法）第五十四条的规定，制定本实施条例。

　　Article1.

　　ThepresentRegulationsareformulatedaccordingtotheArticle54oftheCopyrightLawofthePeople'sRepublicofChina（hereinafterreferredtoastheCopyrightLaw）.

　　第二条著作权法所称作品，指文学、艺术和科学领域内，具有独创性并能以某种有形形式复制的智力创作成果。

　　Article2.

　　Theterm"works"usedintheCopyrightLawreferstooriginalintellectualcreationsintheliterary,artisticandscientificdomain,insofarastheyarecapableofbeingreproducedinacertaintangibleform.

　　第三条著作权法所称创作，指直接产生文学、艺术和科学作品的智力活动。

　　Article3.

　　Theterm"creation"mentionedintheCopyrightLawreferstointellectualactivitiesfromwhichliterary,artisticandscientificworksaredirectlyresulted.

　　为他人创作进行组织工作，提供咨询意见、物质条件，或者进行其他辅助活动，均不视为创作。

　　Themakingofarrangementandtheprovisionofconsultation,materialmeansorsupportingservice,doneforothersintheircreatingactivities,shallnotbedeemedasactsofcreating.

　　第四条著作权法和本实施条例中下列作品的含义是：

　　Article4.

　　TheseworksmentionedintheCopyrightLawandthepresentRegulationsmeanthefollowing:

（一）文字作品，指小说、诗词、散文、论文等以文字形式表现的作品;

（1）Writtenworksareworksexpressedinwriting,suchasnovels,poems,essaysandthesis;

（二）口述作品，指即兴的演说、授课、法庭辩论等以口头语言创作、未以任何物质载体固定的作品;

（2）Oralworksareworks,suchasunpreparedspeeches,lecturesandcourtdebates,whicharecreatedinspokenwordsandhavenotbeenfixedonanymaterialcarrier;

　　（三）音乐作品，指交响乐、歌曲等能够演唱或者演奏的带词或者不带词的作品;

　　（3）Musicalworksareworks,withorwithoutaccompanyingwords,whichcanbesungorperformed,suchassymphonyandsongs;

　　（四）戏剧作品，指话剧、歌剧、地方戏曲等供舞台演出的作品;

　　（4）Dramaticworksareworks,suchasdramas,operasandlocalartforms,whicharecreatedforstageperformance;

　　（五）曲艺作品，指相声、快书、大鼓、评书等以说唱为主要形式表演的作品;

　　（5）QuYiworksareworkscreatedmainlyforbeingperformedinawayinvolvingrecitation,singing,orboth,suchascrosstalk,clappertalk,balladsingingandstorytelling;

　　（六）舞蹈作品，指通过连续的动作、姿势、表情表现的作品;

　　（6）Choreographicworksareworkswhichareorcanbeexpressedinsuccessivebodymovements,gesturesandfacialmovements;

　　（七）美术作品，指绘画、书法、雕塑、建筑等以线条、色彩或者其他方式构成的有审美意义的平面或者立体的造型艺术作品;

　　（7）Worksoffineartaretwo-orthree-dimensionalworkscreatedinlines,coloursorothermediumwhich,whenbeingviewed,impartestheticeffect,suchaspaintings,worksofcalligraphy,sculpturesandworksofarchitecture;

　　（八）摄影作品，指借助器械，在感光材料上记录客观物体形象的艺术作品;

　　（8）Photographicworksarethekindofartisticworkscreatedbyrecordingimagesonlight-sensitivematerialswiththeaidofdevices;

　　（九）电影、电视、录像作品，指摄制在一定物质上，由一系列有伴音或者无伴音的画面组成，并且借助适当装置放映、播放的作品;

　　（9）Cinematographic,televisionandvideographicworksareworkswhich,beingrecordedonsomematerial,consistofaseriesofframesofimages,withorwithoutaccompanyingsound,andcanbeprojectedwiththeaidofdevicessuitableinrelationtoaspecificworks;

　　（十）工程设计、产品设计图纸及其说明，指为施工和生产绘制的图样及对图样的文字说明;

　　（10）Drawingsofengineeringdesignsandproductdesignsandtheaccompanyingdescriptionsaredrawingsmadeforthepurposeofactualconstructionandmanufacturinganddescriptiveworkscontainedinthesaiddesigndrawings;

　　（十一）地图、示意图等图形作品，指地图、线路图、解剖图等反映地理形象、说明事物原理或者结构的图形或者模型。

　　（11）Maps,diagramsandothergraphicworksrefertotwo-orthree-dimensionalworksshowinggeographicalphenomenonanddemonstratingthefundamentalorthestructureofathingoranobject,suchasgeographicalmaps,planofelectricalcircuitorananatomicaldrawings.

　　第五条著作权法和本实施条例中下列使用作品方式的含义是：

　　Article5.

　　TheexploitationreferredtointhepresentLawinrelationtoworksshallmeanthedoingofthefollowingacts:

（一）复制，指以印刷、复印、临摹、拓印、录音、录像、翻录、翻扫等方式将作品制作一份或者多份的行为;

（1）Reproductionisthemakingofifoneormorecopiesofaworkbymeanslikeprinting,photocopying,copyingbyhand,rubbing,audio-recording,video-recording,re-recordingorphotographing;

（二）表演，指演奏乐曲、上演剧本、朗诵诗词等直接或者借助技术设备以声音、表情、动作公开再现作品;

（2）Performanceisthepublicpresentationofaworkthroughvocalsound,facialmovementsandbodymovements,directlyorwiththeaidoftechnicaldevices;

　　（三）播放，指通过无线电波、有线电视系统传播作品;

　　（3）Broadcastingisthecommunicationofworksthroughwirelessradiowavesandcabletelevisionsystem;

　　（四）展览，指公开陈列美术作品、摄影作品的原件或者复制件;

　　（4）Exhibitionisthepublicdisplayofworksoffineartandphotography,whethertheiroriginalcopiesorreproductions;

　　（五）发行，指为满足公众的合理需求，通过出售、出租等方式向公众提供一定数量的作品复制件;

　　（5）Distributionistheprovisionofcopiesofaworktothepublicbymeanssuchassaleandrental,insofarasthenumberofcopiessatisfythereasonableneedofthepublic;

　　（六）出版，指将作品编辑加工后，经过复制向公众发行;

　　（6）Publicationisthepublicdistributionofcopiesoftheeditedversionofawork;

　　（七）摄制电影、电视、录像作品，指以拍摄电影或者类似的方式首次将作品固定在一定的载体上。

　　将表演或者景物机械地录制下来，不视为摄制电影、电视、录像作品;

　　（7）Makingofcinematographic,televisionandvideoworksmeansthefixationforthefirsttimeofaworkonsomematerialsbymeansofcinematographicproductionoranalogousprocess.

　　Thissubsectionshallnotapplytothemeremechanicalrecordingofperformanceorscenesormaterialobjects;

　　（八）改编，指在原有作品的基础上，通过改变作品的表现形式或者用途，创作出具有独创性的新作品;

　　（8）Adaptationisthecreationofneworiginalworksonthebasisofpre-existingonesbychangingtheiroriginalformofexpressionorthepurposestheyareoriginallydesignedtoserve;

　　（九）翻译，指将作品从一种语言文字转换成另一种语言文字;

　　（9）Translationistheconversionofthelanguageofaworkintoanotherlanguage;

　　（十）注释，指对文字作品中的字、词、句进行解释;

　　（10）Anotationistheexplanationofcharacters,wordsandsentencesusedinaliterarywork;

　　（十一）编辑，指根据特定要求选择若干作品或者作品的片断汇集编排成为一部作品;

　　（11）Compilationisthecreationofaworkbyassemblinganumberofselectedpre-existingworks,inwholeorinparts,accordingtoanarrangementdesignedforaspecificpurpose;

　　（十二）整理，指对内容零散、层次不清的已有文字作品或者材料进行条理化、系统化的加工，如古籍的校点、补遗等。

　　（12）Sorting-outistherearrangementofpre-existingworksormaterialsbychangingtheirformerstateofbeingfragmentedandpoorly-orderedintoaoneofbeingsystematicandorderly,suchastheglossingandrepairingofancientclassics.

　　第六条著作权法和本实施条例中下列用语的含义是：

　　Article6.

　　AsusedintheLaw,thetermslistedbelowshallmeanthefollowing:

（一）时事新闻，指通过报纸、期刊、电台、电视台等传播媒介报道的单纯事实消息;

（1）Newsofcurrenteventsreferstothemerereportoffactsorhappeningsconveyedbynewspapers,periodicalsandradioandtelevisionstations;

（二）录音制品，指任何声音的原始录制品;

（2）Soundrecordingsreferstotheoriginalrecordationofanysounds;

　　（三）录像制品，指电影、电视、录像作品以外的任何有伴音或者无伴音的连续相关形象的原始录制品;

　　（3）Videorecordingsreferstotheoriginalrecordationofaseriesofrelatedimages,withorwithoutaccompanyingsounds,otherthancinematographicandtelevisionandvideographicworks;

　　（四）广播、电视节目，指广播电台、电视台通过载有声音、图像的信号传播的节目;

　　（4）Radioandtelevisionbroadcastsrefertotheprogrammecommunicatedbyradioortelevisionstationbymeansofdiffusingsignalscarryingsoundorimagesorboth;

　　（五）录音制作者，指制作录音制品的人;

　　（5）Producerofsoundrecordingsreferstoapersonwhomakessoundrecordings;

　　（六）录像制作者，指制作录像制品的人;

　　（6）Producerofvideorecordingsreferstoapersonwhomakesvideorecordings;

　　（七）表演者，指演员或者其他表演文学、艺术作品的人。

　　（7）Performerreferstopersonswhoperformliteraryandartisticworksprofessionallyornotprofessionally.

　　第二章著作权行政管理部门

　　CHAPTERIICOPYRIGHTADMINISTRATIVEAUTHORITIES

　　第七条国家版权局是国务院著作权行政管理部门，主管全国的著作权管理工作，其主要职责是：

　　Article7.

　　ThenationalCopyrightAdministration,beinganadministrativedepartmentforcopyrightmattersundertheStateCouncil,isresponsibleforthenation-wideworkofadministrationofcopyrightbymainlycarryingoutthefollowingfunctions:

（一）贯彻实施著作权法律、法规，制定与著作权行政管理有关的办法;

（1）Toimplementcopyright-relatedlawsandregulationsandtopromulgaterulesinrelationtocopyrightadministration;

（二）查处在全国有重大影响的著作权侵权案件;

（2）Toinvestigateandredresscasesofinfringementofcopyrightthatareofnation-wideinfluence;

　　（三）批准设立著作权集体管理机构、涉外代理机构和合同纠纷仲裁机构，并监督、指导其工作;

　　（3）Toapprovetheformationofandtosupervisetheoperationofcollectiveadministrationofcopyright,copyrightagentbusinessdealingwithcross-bordertransactionsandarbitrationsschemefordisputesraisedinrelationtocopyrightcontracts;

　　（四）负责著作权涉外管理工作;

　　（4）Toundertakeadministrationasfarasexternalcopyrightrelationisconcerned;

　　（五）负责国家享有的著作权管理工作;

　　（5）ToadministercopyrightofwhichtheStateistheowner;

　　（六）指导地方著作权行政管理部门的工作;

　　（6）Toprovideguidanceforlocalcopyrightauthoritieswiththeirperformanceofadministrativefunctions;

　　（七）承担国务院交办的其他著作权管理工作。

　　（7）TocarryoutotherdutiesassignedbytheStateCouncilinrelationtocopyrightadministration.

　　第八条地方人民政府的著作权行政管理部门主管本行政区域的著作权管理工作，其职责由各省、自治区、直辖市人民政府确定。

　　Article8.

　　Thecopyrightdepartmentunderthelocalgovernmentsareresponsibleforcopyrightadministrationwithintheirrespectivejurisdiction,whosedutiesshallbedeterminedbythegovernmentofeachoftheprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernment.

　　第三章著作权的归属与行使

　　CHAPTERIIIOWNERSHIPANDEXERCISEOFCOPYRIGHT

　　第一节著作权的归属

　　SECTIONIOWNERSHIPOFCOPYRIGHT

　　第九条创作作品的公民或者依法被视为作者的法人或者非法人单位享有著作权，但法律另有规定的除外。

　　Article9.

　　UnlesstheLawprovidedotherwise,copyrightshallbelongtocitizenswhohavecreatedworksandthelegalandnon-legalentitieswhoaredeemedauthorsbyvirtueoftheLaw.

　　法人必须符合民法通则规定的条件。

　　不具备法人条件，经核准登记的社会团体、经济组织或者组成法人的各个相对独立的部门，为非法人单位。
