federalsuit/case:
联邦法案件。
美国是联邦制国家,除联邦的司法系统和法律外,各州有自己的司法体系和法律。
如州法律与联邦法律相矛盾,则以联邦法律为准。
以联邦法律为依据提起的讼案(即指称被告违反联邦法的案件),称为“federalsuit”或“federalcase”。
课文中Bilott代表Tennant依据联邦法律(如ToxicSubstancesControlAct)提起诉讼,所以称为联邦法案件。
ToxicSubstancesControlAct(TSCA):
《有毒物质控制法》。
该法案1976年经美国国会通过,由环境保护局(EnvironmentalProtectionAgency)执行。
其中规定在化学新产品投产前,厂商必须通知E.P.A.,提供有关信息,由后者判定是否禁止或限制该产品的生产。
