按照《中华人民共和国劳动法》、《中华人民共和国劳动合同法》及其他有关的法律、法规、政策，甲乙双方根据平等自愿、协商一致的原则，签订本合同。
Inaccordancewiththe"

andotherrelevantlaws,regulations,policies,AandBsidesonthebasisofequality,voluntariness,theprincipleofconsensus,thesigningofthiscontract.双方共同信守本合同所列各条款，并确认本合同为双方解决争议时的依据。
Thetwosidesabidebytheprovisionssetforthinthiscontractandconfirmthatthiscontractforthepartiestoresolvedisputesbasis.
一、合同期限和试用期限Adurationofcontractandthetrialperiod
甲、乙双方选择以下第贰种形式确定本合同期限：

二、工作岗位及职责Second,jobsanddutiesof
1、依据乙方求职承诺，甲方聘用乙方在甲方所属1,basedoncommitmenttojobB,PartyAPartyBonParty-ownedemployment
工作，具体工作内容见乙方所签字确认的“岗位职责与考核”（见附件）。

2、合同期内，甲方有权根据工作、生产经营需要，临时安排乙方从事其他岗位工作，时限为不超过六个月。

3、乙方必须按照双方所确定的岗位职责，按时、按质、按量完成工作任务，甲方将依据考核制度进行考核，如乙方不能通过基本考核要求则甲方有权依相关规定处理。
3,Bmustbedeterminedbythepartiesinaccordancewithjobresponsibilities,ontimeandaccordingtothequality,quantityandcompletetasks,PartyAwillbebasedonevaluationsystemofassessment,suchasBcannotbethebasicassessmentrequirementsinaccordancewiththerelevantprovisionsofthePartyhavetherighttodealwith.
4、甲方因生产和工作需要，依据乙方的专业、特长、工作能力和表现，需调整乙方工作岗位及其工作报酬的，原则上应协商一致，但以下情况除外：
4,PartyAduetotheproductionandoperationalneeds,accordingtoB'
sprofessional,expertise,capabilityandperformancetobeadjusted,PartyBtoworkandremunerationfortheirwork,inprinciple,betakenbyconsensus,butthefollowingexceptions:
（1）甲方因生产经营服务需要，产业、产品结构调整及工艺规程、组织机构设置等情况发生变动需调动乙方工作岗位时，乙方应予接受；
（1）Partyforproductionandbusinessserviceneeds,industryandproductstructureadjustmentandprocessplanning,organizationalsettings,etc.requirethemobilizationofachangeinjobB,theBshouldbeaccepted;
（2）乙方因技能、身体等因素达不到生产服务、工作质量、产量等指标，不能胜任工作的。

5、乙方承诺：

（1）接受甲方所制定的“岗位职责与考核”，认真履行岗位职责，完成工作任务，接受甲方考核。

三、工作时间、劳动报酬和福利待遇3,workinghours,laborcompensationandbenefits
1、具体上下班时间按甲方规定的作息时间执行。
AspecificworkinghoursrequiredbyPartyAtimetoimplementtherest.甲方因工作需要安排乙方延长工作时间或节假日加班加点的，乙方应服从甲方统一安排。
PartyAPartyBbecauseofworkneedtoarrangetoextendtheworkinghoursorholidays,overtime,andPartyBshallbesubjecttoPartyAunifiedarrangements.乙方加班须征得甲方确认同意，否则不视为加班。
PartyAPartyBtoworkovertimetoconfirmtheneedtoseekconsent,ornotconsideredovertime.
2、甲方确定的发薪日期为每月5日。

3、甲方可根据实际业务经营状况以及乙方的工作业绩、奖罚记录、职位变化，随时调整乙方的工资水平和工资结构，并及时通知乙方。

4、甲、乙双方按国家和本市的有关规定缴纳各项社会保险费用。

5、乙方在合同期内享有国家和甲方规定的各种补贴、福利待遇等。

6、甲方为乙方提供符合国家规定的劳动保护、劳动条件和职业危害防护的措施。

四、劳动纪律和奖惩办法4,labordisciplineandincentivesanddisincentives
1、乙方应自觉遵守国家法律、法规和社会公德，遵守职业道德，自觉维护甲方声誉。

2、乙方应严格遵守甲方制订的各项规章制度、工作程序、工作纪律，包括《员工手册》等中写明的各项规定和要求。

andotherstatesintheprovisionsandrequirements.甲方对模范遵守劳动纪律、规章制度或违反劳动纪律、规章制度的乙方，可以进行奖励或处罚。

3、乙方在担任领导职务期间，对其下属负有领导责任，并承担其下属工作过错或过失造成的经济损失的连带责任。

4、甲方规章制度的认可条款4,PartyArecognitionprovisionsofrulesandregulations
甲、乙双方在签订合同后，即进行职前培训。

PartyBshallunconditionallyauthorizedmanagementrulessystem,bothbyrulesandregulationstoimplementandguaranteeobligations.
五、商业秘密保护5,tradesecretprotection
1、乙方应保守甲方的商业秘密。
1,BtobetheconservativePartyoftradesecrets.“商业秘密”包括但不限于甲方客户信息，供应商信息，产品设计，商品价格，销售数据，财务资料，人事资料等。

2、乙方承诺严格遵守甲方的保密制度，绝不将甲方的经营情况和业务情况向第三方泄露；

soperationsandbusinessconditionsdisclosuretothirdparties;
nottobusinessrecords,businessdocuments,etc.tocopyorlendtothirdparties.如乙方泄露甲方商业秘密，对甲方利益造成损害的，甲方可根据具体情况对乙方给予警告、扣发奖金及罚款、解除本合同等处分。
IfPartyAPartyBrevealtradesecrets,damagetheinterestsofPartyA,PartyAPartyBaccordingtothespecificcircumstancesofthewarning,thewithholdingofbonusesandpenaltiestoliftthesanctionsofthecontracts.
3、甲方可根据情况与乙方另行签订保密协议和竞业限制协议等。
3,PartyAPartyBinaccordancewithsituationandsignedaconfidentialityagreementandaseparatenon-competitionagreements.
六、利益冲突的约定6,conflictofinterestoftheconvention
1、本合同期内乙方不得从事与甲方利益相冲突的活动，不得从事第二职业。
1,duringtheperiodofthiscontract,PartyBshallnotengageinconflictwiththeinterestsandactivities,shallnotengageinasecondjob.否则甲方可给予相应惩处直至合同解除并追究其法律责任。
