REGULATIONONAPPLICATIONFORROUTEOPERATINGPERMIT

BYFOREIGNAIRTRANSPORTENTERPRISES

CHAPTER1

GENERALPROVISIONS

Article1

ThisRegulationismadeinaccordancewithCivilAviationLawofthePeople’sRepublicofChinaandwiththeviewofstandardizingtheregulationofoperationonthespecifiedroutebyforeignairtransportenterprisebetweenpointinforeigncountryandpointinthePeople’sRepublicofChina.

Article2

Applicationfiledbyforeignairtransportenterprise（hereinafterreferredtoas“foreignairline”foroperationonthespecifiedroutebetweenpointinforeigncountryandpointinthePeople’sRepublicofChinashallbeinconformitywiththeprovisionsspecifiedinthebilateralAirServicesAgreementortherelevantagreementconcludedbetweenthegovernmentsofChinaandtheforeigncountry.Thesaidforeignairlineshallbefirstdesignatedthroughdiplomaticchannelbyitsgovernment,unlessotherwiseprovidedinthebilateralAirServicesAgreementortherelevantagreement.

Article3

CivilAviationAdministrationofChina（hereinafterreferredtoas“CAAC”isresponsiblefortheregulationoftherouteoperatingpermitforforeignairline.

Foreignairline,afterbeingformallydesignatedthroughdiplomaticchannelbyitsgovernment,shallsubmitapplicationinaccordancewiththisRegulationtoCAACforpermittooperatethespecifiedroutebetweenpointintheforeigncountryandpointinthePeople’sRepublicofChina.

RegionalAdministrationsofCAACareresponsiblefortheoversightontheoperationbyforeignairlinewithintheirrespectiveregion.

Article4

CAACappliestheprincipleofmutual-benefitandreciprocaltreatmentwhenexaminingandapprovingtheapplicationforoperatingpermitsubmittedbyforeignairline.CAACshalltakereciprocalmeasuresintheeventthattheaeronauticalauthoritiesoftheforeigncountrywouldplaceunreasonablerestrictionontheapplicationsubmittedbytheairtransportenterpriseofthePeople’sRepublicofChinaforpermittooperatethespecifiedroutebetweenpointinthePeople’sRepublicofChinaandpointintheforeigncountry.

CHAPTER2

APPLICATIONPROCEDURESFOROPERATINGPERMIT

Article5

ApplicationforoperatingpermitshallbesubmittedbyforeignairlinetoCAACnolaterthan60daysbeforetheproposedcommencingdate.

CAACdoesnotaccepttheapplicationforoperatingpermitsubmittedbyforeignairlineiftheapplicationdoesnotconformtotherequiredtimelimit,unlessotherwiseprovidedinthebilateralAirServicesAgreementortherelevantagreement.

Article6

ForeignairlineapplyingforoperatingpermitshallprovideCAACwiththeapplicationletterandsupplementarydocumentsintheChineseorEnglishlanguage,whichshallbesignedbythelegalrepresentativeoftheheadquartersoftheforeignairlineorbythepersonauthorizedinwritingbythelegalrepresentative.

TheapplicationlettershallincludethespecifiedrouteplannedtooperatebetweenpointintheforeigncountryandpointinthePeople’sRepublicofChina,theproposedcommencingdate,flightnumberandcode-sharingflightnumber,weeklyfrequencyandoperationdays,typeofaircraftownedbytheforeignairlineorwet-leasedfromotherenterpriseandaircraftregistrationnumber.

Thesupplementarydocumentssubmittedtogetherwiththeapplicationletterbyforeignairlineshallinclude:

1PhotocopyofthedocumentcertifyingthattheforeignairlineisdesignatedbytheforeigngovernmenttooperatethespecifiedroutebetweenpointintheforeigncountryandpointinthePeople’RepublicofChina;

2PhotocopyoftheAirOperatorCertificate（AOCissuedbytheaeronauticalauthoritiesoftheforeigncountrytotheforeignairlineforengaginginpublicairtransport;

3PhotocopyoftheEnterpriseRegistrationCertificate;

4Charter（orcalled“ArticlesofAssociation”oftheenterpriseorcertificateissuedbythelegalenterpriseregistrationbody,whichcontainsinformationabouttheprincipleplacesofbusinessoftheenterprise,natureoftheenterprise（state-ownedorprivateenterprise,equitystructure,nationalitiesoftheinvestors,namesandnationalitiesoftheboardmembers;

5Generalconditionsofcarriageforpassengerandcargooftheenterprise;

6TheformalChineseandEnglishnameoftheenterprise,enterpriseprofile（includingthedateofestablishment,aircraftfleet,routenetwork,etc.,contactpersonsintheheadquartersandinthePeople’sRepublicofChinaandtheiraddress,telephoneandfaxnumber,e-mailaddress,thethree-letterdesignatorassignedtotheforeignairlinebyInternationalCivilAviationOrganization（ICAOandthetwo-characterdesignatorassignedtotheforeignairlinebyInternationalAirTransportAssociation（IATA;

7Whenwet-leasedaircraftisusedfortheoperation,photocopyofthewet-leaseagreementshallbeprovidedtogetherwiththedocumentsasrequiredbythebilateralAirServicesAgreement

ortherelevantagreementpertainingtotheuseofwet-leasedaircraft;

8OtherdocumentstobesubmittedbyforeignairlineasrequestedbyCAACinaccordancewithlaws,regulationsandbilateralagreement.

Article7

WhenforeignairlinerequeststooperateanewrouteafteritcommencestheoperationofthespecifiedroutebetweenpointintheforeigncountryandpointinthePeople’sRepublicofChinaaspertheoperatingpermitissuedbyCAAC,theforeignairlineshallreapplytoCAACforanewrouteoperatingpermit.Thedocumentslistedinsubparagraph2,3,4,5and6ofArticle6ofthisRegulationmaynotbesubmittediftheforeignairlineappliesfornewrouteoperatingpermit.

Article8

Incaseanychangetothecontentslistedinsubparagraph2,3,4,5,6and7ofArticle6ofthisRegulationtakesplacewhileinthecourseofoperatingthespecifiedrouteaspertheoperatingpermitissuedbyCAACoratthetimewhenapplyingfornewrouteoperatingpermit,theforeignairlineshallnotifyCAACinwritingofsuchchangewithin30daysfromthedatewhensuchchangeismadeoratthetimewhentheapplicationfornewrouteoperatingpermitissubmitted.

Article9

Ifforeignairlinedelegatesanagencytosubmit,onitsbehalf,anapplicationforoperatingpermittoCAAC,itshalldelegatetheagencycapableofhandlingrelevantbusinessandshallissueanofficialletterofdelegationtosuchagency.

CHAPTER3

EXAMINATIONANDAPPROVALOFOPERATINGPERMIT

Article10

CAACmakesproceduralexaminationoftheapplicationdocumentssubmittedbyforeignairlineandmayconductsubstantialexaminationwhenitisdeemednecessary.

Foreignairlineshallberesponsiblefortheauthenticityofallapplicationdocumentssubmitted.

Article11

CAACacceptstheapplicationfiledbyforeignairlineifsuchapplicationdocumentsarecompleteandinconformitywiththestatutoryforms.Iftheapplicationdocumentsarenotcompleteandnotinconformitywiththestatutoryforms,CAACwillgiveanotificationwithin5workingdaystoforeignairlinetocomplementallrequireddocuments.Otherwisetheapplicationisconsideredasacceptedasofthedaywhentheapplicationdocumentsarereceived.

CAACacceptstheapplicationaftertheforeignairlinehascomplementedalltherequireddocuments.CAACdoesnotaccepttheapplicationandwillgiveawrittennotificationofun-acceptanceiftheapplicationdocumentsarestillnotinconformitywiththerequirements.

Article12

CAACshallmakeadecisiononwhethergrantingapprovalornotwithin20workingdaysfromthedaywhenitacceptssuchapplication,unlessotherwiseprovidedinthebilateralAirServicesAgreementortherelevantagreement.IfCAACcannotmakeadecisionwithin20workingdays,itmay,withtheapprovaloftheministerofCAAC,deferthedecisionfor10workingdaysandshallgiveexplanationsaboutthedefermenttotheforeignairline.

Article13

CAACshallissuetheoperatingpermittoforeignairlinewithin10workingdaysfromthedaywhenanapprovaldecisionismade.IfCAACmakesadisapprovaldecisionontheapplicationinaccordancewiththelawandregulations,itshallgiveawrittendecisiontotheforeignairlinewithrelevantexplanations.

CHARPTER4

RENEWALOFANDCHANGETOOPERATINGPERMIT

Article14

ForeignairlinesshallsubmitapplicationforrenewalofoperatingpermittoCAACnolaterthan30daysbeforeitsexpirydateasspecifiedintheoperatingpermit.Iftheapplicationisnotsubmittedwithinthetimelimitwithoutanyappropriatereasons,CAACwillmakeawrittendecisionofun-acceptance.Iftheforeignairlinefailstosubmitanapplicationforrenewaloftheoperatingpermitafteritisexpired,CAACwillrevoketheoperatingpermit.

Article15

Foreignairline,inapplyingforrenewalofoperatingpermit,shallprovidewiththefollowingdocuments:

1Photocopyoftheoperatingpermittoberenewed;

2FlightschedulesfortheroutebeingoperatedinaccordancewiththespecifiedRouteSchedulebetweenpointintheforeigncountryandpointinthePeople’sRepublicofChina.

Article16

ApplicationfiledbyforeignairlineformakingchangestothecontentsofthecurrenteffectiveoperatingpermitshallbesubmittedinwrittenformtoCAACwithdetailedcontentstobemodifiedaswellasreasonsforthemodification.

Article17

CAACshallmakeadecisionontheapplicationsubmittedbyforeignairlineforrenewalormodificationoftheoperatingpermitwithinthetimelimitasspecifiedinArticle12and13ofthisRegulation.

CHARPTER5

REGULATIONONOPERATINGPERMIT

Article18

ForeignairlineshalloperatethespecifiedroutebetweenpointinforeigncountryandpointinthePeople’sRepublicofChinawithinthescopeofoperationandthetermofvalidityasauthorizedbytheoperatingpermit.
