H.PointofCollectionTesting(POCT)meansaninitialscreeningtestperformedatthesitewherethesampleiscollectedusinganoninstrumentedtestingdeviceapprovedforthatpurposebythefederalFood&
DrugAdministration.
SECTION2.EMPLOYEECONSULTATIONANDEMPLOYEEANDAPPLICANTNOTIFICATIONREQUIREMENTS
A.Anemployershallconsultwiththeemployer'
semployeesinthedevelopmentofanysectionofasubstanceabusetestingpolicyand/oramendmentwhichreferstoemployeetesting.Consultmeansatwowaycommunicationbetweentheemployerandtheemployeesregardingtheproposedsubstanceabusetestingpolicy.Acommitteeformedtodeveloparandomorarbitrarytestingprogramunderpart3(CC)doesnotmeetthisrequirementexceptasitregardstherandomorarbitraryprogram.
B.Anemployershallgive,atthetimeofitssubmission,individualwrittennoticetoemployeesthatithassubmittedasubstanceabusetestingpolicyand/oramendmenttotheDepartmentforreview.ThenoticemustinformemployeesthattheymaysubmitwrittencommentstotheDepartment,aswellaswhereandhowanemployeemayreviewtheproposedpolicyifnotprovidedwiththenotice.ThenoticemustinformemployeesofthemannerandtimeframeinwhichtheymaycommenttotheDepartmentandmustdisplayprominentlytheaddressoftheDepartment.Thisrequirementcoversallpolicieseventhosewhichdonotinanywaypertaintoemployees.
C.AnemployerwhosepolicyincludesemployeetestingshallprovideeachemployeewithacopyofthewrittenpolicyapprovedbytheDepartmentatleast30daysbeforethepolicytakeseffect.
D.AnemployerwhoseamendmentincludesemployeetestingshallprovideeachemployeewithacopyofthewrittenamendmentapprovedbytheDepartmentatleast60daysbeforetheamendmenttakeseffect.
E.Anemployershallprovideacopyoftheapprovedwrittenpolicytoapplicantsbeforeadministeringasubstanceabusetest.Ataminimum,eachapplicantmustbenotifiedinwritingatthetimeofapplicationthattheymaybesubjecttoasubstanceabusetestifselectedforemploymentorplacedonaroster,aswellaswheretheymayreviewthestatuteandtheemployer'
swrittenpolicy.
F.Nothinginthissectionismeanttoinhibitadditionalmethodsofapplicantand/oremployeeinvolvement.
SECTION3.REQUIREMENTSFOREMPLOYERS'
WRITTENSUBSTANCEABUSEPOLICY
A.PolicyFormat
1.Individualemployerpoliciesmustbeasingledocument)writteninamannerthatisunderstandabletoalargemajorityoftheemployeesandapplicants.Provisionsshouldbemadewithinthepolicyforadditionalinformationorassistancetobemadeavailabletoanemployeeorapplicant,ifrequested.
2.Tofacilitatepromptreviewofandactiononindividuallysubmittedemployerpolicies,aspecificformatisrequested.FailuretocomplywiththerequestedformatmayresultinthesubmissionbeingreturnedwithoutDepartmentapproval.
3.Theauthorizingstatuteisveryspecificinmanyareas;
therefore,itisrequiredthattheemployeruseboththestatuteandDepartmentofLaborandHumanService'
srulesindevelopingapolicy.
4.Thefollowingoutlineshouldbeusedindevelopingapolicyasaminimumstandard.Employersareencouragedtowritethepolicyasanarrative.Thesectionsconcerningprobablecausetestingofemployees,randomorarbitrarytestingofemployees,andtestingofapplicantsareoptional,butmustbeincludediftheyaretobeapartoftheemployer'
ssubstanceabusetestingpolicy.

AA.SpecifysubstancesandspecifyforeachasallowedbystatuteandDepartmentofHumanServicesrules,
1)testproceduretobeusedandcut-offlimitforpositivescreeningtest,
2)testproceduretobeusedandcut-offlimitforpositiveconfirmationtest.
ii.ProbableCauseTestingofEmployees:
AA.Classificationsorpositiontitlesofemployeesthatwillbetestedbasedonprobablecause.Anemployermayelecttocoverallemployeesunderprobablecausetesting.
BB.Classificationsorpositiontitlesthatmaymakeadeterminationofprobablecause.
CC.Methodbywhichdeterminationwillbecommunicatedtotheemployee.
iii.RandomorArbitraryTestingofEmployees:
AA.Iftheemployerandtheemployeeshavenegotiatedanagreementcoveringrandomorarbitrarytestingofemployees,thepolicyshallsostatethatitisaproductofabargainedagreementandIdentifythoseclassificationsorpositiontitlesthataresubjecttorandomorarbitrarytesting,aswellastheprocedureforselectingthoseindividualstobetested.
Thecollectivebargainingagreementorappropriatesections;
mustbeattachedtothesubmissionasanexhibit.
BB.Iftheemployerdoesnothaveacollectivebargainingagreementwhichcoversrandomorarbitrarytesting,thepolicymustshow:
1)Thoseclassificationsorpositiontitleswhicharesubjecttorandomorarbitrarytesting.
a)Thepolicymustincludeforeachclassificationorpositiontitleaconcisestatementastowhytheworkisofanaturewhichwouldcreateanunreasonablethreattothehealthorsafetyofthepublicorco-workersiftheemployeewereundertheinfluenceofasubstanceofabuse.

b)Amorecompletedescriptionofeachpositionandafulljustificationforrandomorarbitrarytestingmustbesubmittedasanattachmentprovidedwiththepolicy.
2)Theprocedureforselectingthoseindividualstobetested.
CC.Anemployerhaving50ormoreemployeeswhoarenotcoveredbyacollectivebargainingagreementmayestablisharandom.orarbitrarytestingprogramwhichappliestoallemployees.Thewrittenpolicywithrespecttothepartsofthepolicyaddressingtherandomorarbitrarytestingprogrammustmeetthestandardsbelow.
1)Theemployershallappointacommitteeofemployeestodeveloptherandomorarbitrarytestingprogram.Thecommitteemustconsistof:
a)atleast10oftheemployer'
semployeesfromacrosssectionofemployeeseligibletobetested;
and
b)amedicalprofessionaltrainedinsubstanceabusetestingprocedures.Ifnosuchpersonisemployedbytheemployer,theemployershallobtaintheservicesofapersonmeetingthesequalificationstoserveonthecommittee.
2)Selectionofemployeestobetestedundertherandomorarbitrarytestingprogrammustbedoneasfollows:
a)Selectionofemployeestobetestedmustbeperformedbyapersonorentitynotsubjecttoinfluencebytheemployer,suchasaMedicalReviewOfficer.
b)Selectionmustbefromalistofallsubjectemployeesprovidedbytheemployer.Thelistmaynotcontaininformationthatwouldidentifytheemployeestothepersonorentitymakingtheselection.
c)Employeescoveredunderacollectivebargainingagreementmaynotbeincludedinthetestingallowedpursuanttothisparagraphunlesstheyagreetobeincludedunderacollectivebargainingagreement.
3)ThepolicydevelopedbythecommitteemustbeapprovedbytheDepartmentofLabor.Theemployermaynotchangethepolicyregardingtherandomorarbitrarytestingprogramwithoutapprovalofthecommittee.Theemployermaychoosenottosubmittherandomorarbitrarytestingprogramforapprovalandnottoestablishrandomorarbitrarytestingprogram.
4)Theemployermaynotdiscriminateagainstemployeeswhoparticipateorrefusetoparticipateonthecommittee.
iv.TestingofApplicants:
AA.Classificationsorpositiontitlestobetested.Anemployermayelecttocoverallapplicantsunderapplicanttesting.
c.ConsequencesofTesting:
i.Actiontobetakenforrefusaltosubmittoatest.
AA.Employee
BB.Applicant
ii.Actiontobetakenbetweenatestandreceiptoftestresults.
iii.Actiontobetakenbasedonconfirmedpositiveresultfromatestofanemployee.
AA.Opportunityforrehabilitation
