idonotconsideritnecessaryatpresentformetodiscussthosemattersof
administrationaboutwhichthereisnospecialanxietyorexcitement.apprehensionseemstoexistamongthepeopleofthesouthernstatesthatbythe
accessionofarepublicanadministrationtheirpropertyandtheirpeaceandpersonal
securityaretobeendangered.therehasneverbeenanyreasonablecauseforsuch
apprehension.indeed,themostampleevidencetothecontraryhasallthewhile
existedandbeenopentotheirinspection.itisfoundinnearlyallthepublished
speechesofhimwhonowaddressesyou.idobutquotefromoneofthosespeecheswhen
ideclarethat:
ihavenopurpose,directlyorindirectly,tointerferewiththeinstitutionof
slaveryinthestateswhereitexists.ibelieveihavenolawfulrighttodoso,
andihavenoinclinationtodoso.thosewhonominatedandelectedmedidsowithfullknowledgethatihadmade
thisandmanysimilardeclarationsandhadneverrecantedthem;andmorethanthis,
theyplacedintheplatformformyacceptance,andasalawtothemselvesandtome,
theclearandemphaticresolutionwhichinowread:
resolved,thatthemaintenanceinviolateoftherightsofthestates,and
especiallytherightofeachstatetoorderandcontrolitsowndomesticinstitutions
accordingtoitsownjudgmentexclusively,isessentialtothatbalanceofpoweron
whichtheperfectionandenduranceofourpoliticalfabricdepend;andwedenounce
thelawlessinvasionbyarmedforceofthesoilofanystateorterritory,nomatter
whatpretext,asamongthegravestofcrimes.inowreiteratethesesentiments,andindoingsoionlypressuponthepublic
attentionthemostconclusiveevidenceofwhichthecaseisthereismuchcontroversyaboutthedeliveringupoffugitivesfromserviceor
labour.theclauseinowreadisasplainlywrittenintheconstitutionasanyother
ofitsprovisions:
nopersonheldtoserviceorlabourinonestate,underthelawsthereof,escaping
intoanother,shallinconsequenceofanylaworregulationthereinbedischarged
fromsuchserviceorlabour,butshallbedelivereduponclaimofthepartytowhom
suchserviceorlabourmaybedue.thereissomedifferenceofopinionwhetherthisclauseshouldbeenforcedby
nationalorbystateauthority,butsurelythatdifferenceisnotaverymaterial
one.iftheslaveistobesurrendered,itcanbeofbutlittleconsequencetohim
ortoothersbywhichauthorityitisdone.andshouldanyoneinanycasebecontent
thathisoathshallgoun-keptonamerelyunsubstantialcontroversyastohowit
shallbekept?

toconstruetheconstitutionorlawsbyanyhypercriticalrules;andwhileidonot
choosenowtospecifyparticularactsofcongressaspropertobeenforced,ido
suggestthatitwillbemuchsaferforall,bothinofficialandprivatestations,toconformtoandabidebyallthoseacts
whichstandun-repealedthantoviolateanyofthemtrustingtofindimpunityinhaving
themheldtobeunconstitutional.iholdthatincontemplationofuniversallawandoftheconstitutiontheunion
ofthesestatesisperpetual.perpetuityisimplied,ifnotexpressed,inthe
fundamentallawofallnationalgovernments.itissafetoassertthatnogovernment
propereverhadaprovisioninitsorganiclawforitsowntermination.continueto
executealltheexpressprovisionsofournationalconstitution,andtheunionwill
endureforever,itbeingimpossibletodestroyitexceptbysomeactionnotprovided
forintheinstrumentitself.again:
iftheunitedstatesbenotagovernmentproper,butanassociationof
statesinthenatureofcontractmerely,canit,asacontract,bepeaceablyunmade
bylessthanallthepartieswhomadeit?

descendingfromthesegeneralprinciples,wefindthepropositionthatinlegal
contemplationtheunionisperpetualconfirmedbythehistoryoftheunionitself.
theunionismucholderthantheconstitution.itwasformed,infact,bythearticles
ofassociationin1774.itwasmaturedandcontinuedbythedeclarationof
independencein1776.itwasfurthermatured,andthefaithofallthethenthirteen
statesexpresslyplightedandengagedthatitshouldbeperpetual,bythearticles
ofconfederationin1778.andfinally,in1787,oneofthedeclaredobjectsfor
ordainingandestablishingtheconstitutionwastoformamoreperfectunion.butifdestructionoftheunionbyoneorbyapartonlyofthestatesbelawfully
possible,theunionislessperfectthanbeforetheconstitution,havinglostthe
vitalelementofperpetuity.itfollowsfromtheseviewsthatnostateuponitsownmeremotioncanlawfullygetoutoftheunion;thatresolvesandordinancestothateffectare
legallyvoid,andthatactsofviolencewithinanystateorstatesagainstthe
authorityoftheunitedstatesareinsurrectionaryorrevolutionary,accordingto
circumstances.ithereforeconsiderthatinviewoftheconstitutionandthelawstheunionis
unbroken,andtotheextentofmyability,ishalltakecare,astheconstitution
itselfexpresslyenjoinsuponme,thatthelawsoftheunionbefaithfullyexecuted
inallthestates.doingthisideemtobeonlyasimpledutyonmypart,andishall
performitsofaraspracticableunlessmyrightfulmasters,theamericanpeople,
shallwithholdtherequisitemeansorinsomeauthoritativemannerdirectthecontrary.
itrustthiswillnotberegardedasamenace,butonlyasthedeclaredpurposeof
theunionthatitwillconstitutionallydefendandmaintainitself.themails,unlessrepelled,willcontinuetobefurnishedinallpartsofthe
union.sofaraspossiblethepeopleeverywhereshallhavethatsenseofperfect
securitywhichismostfavourabletocalmthoughtandreflection.thecoursehere
indicatedwillbefollowedunlesscurrenteventsandexperienceshallshowa
modificationorchangetobeproper,andineverycaseandexigencymybestdiscretion
willbeexercised,accordingtocircumstancesactuallyexistingandwithaviewand
ahopeofapeacefulsolutionofthenationaltroublesandtherestorationoffraternal
sympathiesandaffections.thattherearepersonsinonesectionoranotherwhoseektodestroytheunion

ithinknot.happily,thehumanmindissoconstitutedthatnoparty
canreachtotheaudacityofdoingthis.think,ifyoucan,ofasingleinstancein
whichaplainlywrittenprovisionoftheconstitutionhaseverbeendenied.ifby
themereforceofnumbersamajorityshoulddepriveaminorityofanyclearlywritten
constitutionalright,itmightinamoralpointofviewjustifyrevolution;certainly
wouldifsuchrightwereavitalone.butsuchisnotourcase.allthevitalrights
ofminoritiesandofindividualsaresoplainlyassuredtothembyaffirmationsand
negations,guarantiesandprohibitions,intheconstitutionthatcontroversiesnever
ariseconcerningthem.butnoorganiclawcaneverbeframedwithaprovision
specificallyapplicabletoeveryquestionwhichmayoccurinpracticaladministration.
