　　甲、乙双方在自愿、平等、互利的基础上，经协商一致，就乙方承租甲方融资事宜，订立本合同。

　　Havingreachedunanimitythroughconsultations，PartyAandPartyB，onthebasisofvoluntariness，equalityandmutualbenefit，haveenteredintothisContractinrespectofPartyAleasingthePremisestoPartyB.

　　一、租赁融资

　　LeasedPremises

　　1.1甲方将坐落于上海市区路弄号室（以下简称'该融资'）出租给乙方使用，该融资建筑面积为平方米。

　　PartyAlets（hereinafterreferredtothePremises），toPartyB，andthesizeofthePremisesissquaremeters.

　　1.2甲乙双方确定该融资用途为住宅.

　　BothPartyAandPartyBhaveconfirmedthatthePremisesshallbeforthepurposeofResidential.

　　1.3该融资的家俱、家电配置，见本合同附件一。

　　Thefurniture&appliancesofthePremisespleaseseeAppendixI.

　　二、租赁期

　　LeasingTerm

　　2.1本合同租赁期为个月，自年月日起至年月日止。

　　Theleasingtermofthiscontractshallbecalendarmonths，

　　commencingfromto.

　　2.2租赁期满，甲方有权收回该融资，乙方应如期归还；乙方如要求续租，须在本合同期满前个月向甲方提出书面申请，经甲方同意后重新签订租赁合同。

　　Onexpiryofthislease，PartyAhastherighttotakebackthePremises，andPartyBshallreturnthePremisesontime.IfPartyBwishestoextendthelease，PartyBisrequiredtogivewrittennoticetoPartyAmonthspriortotheexpiryoftheleaseandsubjecttoPartyAandPartyB'sconsent，anewleasingcontractshallbesigned.

　　三、租金及保证金

　　RentalandDeposit

　　3.1租金为每月元人民币，租金含融资管理费，发票。

　　Themonthlyrentalispermonth，inclusiveofmanagementfee，formalinvoice.

　　3.2乙方应予签署本合同后五日内向甲方支付相当于一个月租金的金额，即人民币

　　元，作为保证金，甲方应出具收据给乙方。

在租赁期满，乙方如期交还该融资，并付清居住期间所有租金和其它费用后十*五天内，甲方应将保证金无息退还乙方。

　　WithinfivedaysafterthesigningofthisContract，PartyBshallpay

　　toPartyAasDeposit，whichisequivalenttoonemonths'rental，andPartyAshallissueareceiptforthesaidvalue.AttheexpirationoftheContract，PartyAshallrefundtheDeposittoPartyBwithoutinterestwithin15daysafterPartyBhasreturnedthePremisesandpaidalltherentandotherexpensesforthetermsthatPartyBhasoccupiedthePremises.

　　3.3乙方应在每月日前支付该月租金，若乙方在租金到期后十*五天仍未支付，

　　每逾期一天，则乙方应按日租金的支付滞纳金。

若超过三十天未付，则视乙方自动退租并构成违约，甲方有权收回该融资，没收保证金并追究相关损失。

　　PartyBshallpaytherentalonorbeforethedayofeachcalendarmonth.IftheRenthasnotbeenpaidwithin15daysofitsduedate，PartyBshallberequiredtopayalatepenaltyfeeequalto

　　oftherentalperdayforeachdayofdelay.Iftherentalhasnotbeenpaidmorethan30daysaftertheduedate，

　　PartybwillbedeemedtohaveautomaticallyterminatedtheleasingresultinginabreachoftheContract，PartyAwillbeentitledtotakebackthePremises，retaindepositandseekrelatedlosses.

　　3.4甲方在收到租金后五天内应提供给乙方正式发票，若甲方在月底前仍未提供乙方发票，则乙方有权延迟支付下月租金直至收到正式发票。

甲方有责任根据税务局和/或房管局的规定、要求和有关程序支付相应的有关租赁房屋的税款。

　　PartyAwillissueanofficialinvoicewithin5daysafterreceivingtherental.IfPartyAhasnotissueanofficialinvoicebytheendofthemonth，PartyBhastherighttodelaythepaymentofthefollowingmonth'srentaluntilthein

　　　　voiceofthesaidmonthisreceived.PartyAisresponsibleforcomplyingwithregulations，requirementsandproceduresoriginatingfromtheTaxBureauand/orHousingBureaurelatedtothetaxesoftherentofthePremises.

　　收取租金时，房东的银行所收的手续费由房东支付。

　　TheremittancefeechargedbytheLandlord'sbankforreceivingshouldbepaidbytheLandlord.

　　四、出租人的责任

　　Landlord'sResponsibilities

　　4.1甲方须按时将出租融资及家具电器（见附件一）以良好的状态交付给乙方使用。

　　PartyAshoulddeliveronscheduletheleasedpropertyandthefurnitureandappliances（refertoAppendixI）ingoodconditiontoPartyB.

　　4.2甲方应确保或责成融资管理公司对融资及其公共设施进行定期维修保养，包括

　　4.3但不限于融资内的空调、上下水管、电线电缆、煤气管道、通讯及有线电视等设施，使之处于正常的使用状态。

　　PartyAshouldguaranteeororderthepropertymanagementcompanytocarryoutmaintenanceandrepairofthesaidpremisesandthefacilitiesingoodandproperoperationregularly，includingbutnotrestrictedtoair-conditions，waterpipelines，wiresandcables，gaspipelines，communicationandcableTVetc.

　　4.3房屋基本设施和结构损坏时（不包括乙方损坏的家具和器具），甲方必须在24小时内提供维修服务或给予乙方答复，并承担相关的费用。

　　Incaseofthebasicfacilitiesandstructureofthepremisesbeingdamaged（notincludingfurnitureandappliancesdamagedbyPartyB），PartyAshallrepairorrespondtoPartyB'scomplaintswithin24hours，andbearallcostsrelatedthereto.

　　4.4甲方在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋给乙方。

就本合同及出租此房屋于乙方之事，甲方已取得所有有关机构的批准，包括政府批准及抵押权人的同意。

甲方于本合同所做出的声明与保证，如有错误或违反者，甲方须就因此而对乙方引起的任何损失、损害、支出及费用对乙方做出全额补偿。

　　PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarycapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinrespectofthisContractandtheleasingofthepropertytoPartyB，includinggovernmentapprovaland/ormortgageconsent.PartyAshallbeliabletokeepPartyBfullyindemnIfiedagainstanycosts，expenses，lossesanddamagesincurredandsufferedbyPartyBasaresultofanybreachofPartyA'srepresentationsorwarrantiesherein.

　　4.5如在租赁期内，租赁房屋发生所有权全部或部分转移，和其它影响乙方权益的事情时，甲方应保证所有权人或其它影响乙方权益的第三人，能继续遵守本合同所有条款。

如乙方于本合同下的权益受此等所有权人或第三者影响或损害，甲方应负责赔偿乙方的所有损失、损害、支出及费用。

　　Ifduringthetermofthetenancy，allorpartoftheleasedpropertyistransferredorPartyB'srighttouseleasedpropertyisaffected，PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB'srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisContract.PartyAshallalsobeliabletokeepPartyBfullyindemnIfiedagainstanycosts，expenses，losses

　　anddamageswhenanyofPartyB'sinterestshereinareaffectedorprejudicedbysuchtransfereeorthirdparty.

　　4.6甲方应负责根据中国法律法规所定因本楼宇租赁而产生的一切税务（包括但不限于房产税，所得税和营业税）和法定费用（包括但不限于土地使用费），并必须将该些税务和法定费用直接向有关税局缴付。

　　TheLandlordshallberesponsibleforandpaydirectlytotherelevanttaxauthoritiesallapplicabletaxes（includingbutnotlimitedtAlterealEstateTax，IncomeTaxandBusinessTax）andothergovernmentcharges（includingbutnotlimitedtoLandUseFee）requiredbyChi

　　　　neselaworanyrelevantregulationsarisingfromtheleasingofthePremises.

　　4.7在乙方遵守本合同的条款及交付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

　　ProvidedthatPartyBpayingtherentalandperformingandobservingpartyB'stermsandconditionshereincontainshallpeaceablyholdandenjoythePremisesthroughoutthetermofthisContractwithoutanyinterruptionbyPartyAorotherpersons.

　　4.8租期为一年，如若任何一方提前解约，支付违约金为一年的租金（人民币78000.XXX元）。

　　LeasingTermisoneyear.Ifanysideterminatestheagreementahead

　　oftime，mustpaythepenaltyisoneyearrent（RMB78000.00yuan）。

　　五、承租人的责任

　　Tenant'sResponsibilities

　　5.1乙方应按时支付合同中规定的保证金、租金及水、电、煤气、电话费，宽带费等公用事业费。

　　PartyBshouldpromptlypaythedeposit，rentalandwater，broadband，electricity，gas，telephonechargeetc.

　　5.2未经甲方书面同意，乙方不得将该融资转租或分租给第三方。

　　PartyBshallnottransferorsub-leasethesaidpremisestoanythirdpartywithoutPartyA'swrittenconsent.

　　5.3乙方应爱护使用租赁的房屋，如因乙方的过失或过错致使房屋及设施受到损坏（正常损耗除外），乙方应负赔偿责任。

　　PartyBshalltreattheleasedpropertywithcare.If，asaresultof

　　PartyB'snegligenceormisconduct，theleasedpropertyandtherelatedfacilitiessufferanydamage（fairwearandtearexcepted），PartyBshallberesponsibleforcompensatingPartyAforsuchdamages.

　　5.4除在融资内已有的装饰和设施外，乙方如要增加设备或装修，须征得甲方的同意，甲方不得无理拒绝或延误；租赁期满必须恢复原状（正常损耗、磨损除外），并承担其费用，经甲方验收认可后归还甲方。

甲方同意期满前两个月通知乙方其所需拆除的在融资内的任何改变及改进的设施。

　　InAdditiontothedecorationandequipmentalreadyintheproperty，IfPartyBwishestomakeanyAlterationsorimprovementstotheproperty，PartyBmustgetPartyA'sconsent.Anysuchconsentshallnotbeunreasonablywithheldordelayed.Onexpiryofthetenancy，PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition（fairwearandtearexcepted）。

AllfeesarisingfromsuchworktodosoaretobebornebyPartyB.PartyAagreestoprovidePartyBwithtwomonths'noticepriortotheexpiryofthecontract，intheeventPartyArequiresdemolitionofanyAlterationorimprovementcarriedouttothepropertybyPartyB.

　　5.5若乙方、乙方雇员或任何其他经乙方许可的人员进入该融资，对甲方或其他住户造成损失，不论故意或过失，乙方皆应对造成的所有损失予以赔偿。

　　IncaseofPartyB，employeesofPartyBoranyotherpersonpermittedbyPartyBtoenterthepropertycausingdamagestoPartyAorothertenants，whetherintentionallyornegligently，PartyBshallcompensateforallthelossescausedbysuchdamages.

　　5.6乙方不得携带任何违禁危险物品进入该融资，严禁从事任何违反中华人民共和国法律法规的活动；如因此发生损害，乙方应承担全部责任。

　　PartyBshallnotbringanythingdangerousorforbiddenintheleasedproperty，andnotbehaveagainstthelawsorregulationsofthePeople'sRepublicofChina，andshallbefullyresponsibleforanydamagesorlossesasaresultthereof.

　　5.7在本合同期满前一个月内，乙方应允许甲方或其指定的代理人经与乙方预约后，在合理的时间内陪同其他有兴趣租住该楼宇的人士参观

　　TheTenantshallpermittheLandlordoritsdesignatedagenttoenterthePremiseswithotherpotentialtenantstoseethePremises，atreasonabletimeanduponpriorappointmentwiththeTenantwithinonemonthbeforetheexpirationofthisContract.

　　5.8租期为一年，如若任何一方提前解约，支付违约金为一年的租金（即人民币元）。

　　LeasingTermisoneyear.Ifanysideterminatestheagreementahead

　　oftime，mustpaythepenaltyisoneyearrent（RMByuan）。

　　六、违约处理

　　BreachofContract

　　6.1甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任，

　　双方同意违约方应赔偿

　　　　受害方之直接损失（间接和结果性损失除外）。

甲方若有违约并在七日内未予补救，乙方则有权延付租金和管理费或做相应的扣除。

　　IfeitherPartyAorPartyBfailstoperformitsobligationshereunder，itshallconstituteabreachofthisContractandthedefaultingpartyshallundertaketheliabilitiesforsuchbreach.
