房屋租赁合同
tenancyagreement
一、出租人(以下简称甲方)
landlord(hereinafterreferredtoaspartya)
二、承租人(以下简称乙方)
tenant(hereinafterreferredtoaspartyb)
三、租赁范围及用途
tenancy:
甲方同意将其所有的位于北京市朝阳区光华路2号阳光100座2001室的房屋及其设施(包括家具和电器)在良好及可租赁的状态下租给乙方为居住使用,出租房的面积总计约110平方米。
partyaherebyagreestoleaseitspropertylocatedatandtherelatedfacilities(includingfurnitureandappliances)ingoodtenantableconditiontopartybforsizeoftheleasedpropertyisapproximatelyspm.
四、租赁期:
termoftenancy:
4.1租赁期为年,自年月日起至月14日止。
续租或退租,应提前壹个月通知甲方。
uponexpirationofthetenancy,partyahastherighttotakebacktheentire
leasedproperty,andpartybshalldelivertheleasedpropertytopartyaontime.alternatively,partybhavetheoptontorenewthisagreementorquitthisagreementupongivingonemonthpriornoticetopartyabeforetheexpirationofthisagreement.
五、租金及付款方式

5.1双方谈定的租金为每月元。

汇至甲方指定的银行账号,支付租金日期以乙方汇出日期为准。

aandthedateoftransfershallbethedateofpayment.
b:
以现金方式支付
paymentincash
c:
以支票方式支付
paymentincheck5.3由于乙方原因未能按期支付租金,乙方须按日加付其月租金0.5﹪的滞纳
金。
iftherentremainbeingunpaidontime,partybshallbeliabletopayalate
penaltyfeeequalto0.5﹪ofthemonthrentperday.
六、保证金(押金):
securitydesposit:
6.1为确保出租房屋及其设施之安全并完好及租赁期内相关费用之如期结算,
乙方同意于签订合同当日支付给甲方的租赁押金5300元作为乙方确保合同履行之保证金。

facilitiesaswellasthepromptpaymentandsettlementofallrelatedchargesdurningthetermoftenancy,partybagreestopaytopartyawithinonedayaftertheagreementsignedasecuritydespositintheamountofassecurityforpartyb’sobligationshereunder.
6.2除合同另有约定外,乙方应于租赁期满之日与甲方点清室内设施,并付清
所有应付费用后,甲方当天将保证金全额无息退还乙方。

securitydespositwithoutinterestthereonuponexpirationofthetenancyorsoonerdeterminationofthisagreementafterpartybsettledallchargesofleasedpropertywithpartya.
七、费用担保:
payment:
7.1租赁期间物业费和取暖费由甲方承担。
durningthetermofthetenancy,thepropertymanagementfeesandthe
heat-preservationfeesshallbepaidbypartya.
7.2房屋的冷、热水、电、天然气消耗按每月查表实数由乙方支付。
thecold,hotwater,electricity,andgaspayment(forwaterandtear)ofthe
propertyshallbepaidbypartybaccordingtoitsactualpaymentpermonth.
7.3电话费、有线收视费按实际费用由乙方交付。
partybaccordingtoitszctualpaymentshallpaythepaymentfortelephone
andinternationalchannel.
八、出租人的责任
landlord’sobligations:
8.1甲方须按时将出租房屋及其设施以良好的状态交付乙方使用。
partyashalldelivertheleasedpropertyandtherelatedfacilitiesingoodconditiontopartybonschedule.
8.2租赁期内甲方不得收回出出租房屋(除非本合同另有规定)
partyashallnottakebacktheleasedpropertydurningthetermofthetenancy.(unlessotherwisestipulatedinthisagreement)
8.3在乙方遵守本合同的条款及交付租金的前提下,乙方有权于租赁期内拒绝
甲方或其他人骚扰而安静享用出租房屋。
providedthatpartybabidesandperformstheappendixesoftheagreementand
thepaymentforthetenancy,partybhastherighttorefusetheinterruptionfrompartyatoenjoythelifesatisfactionandpeace.
8.4房屋基本设施和结构,甲方有修缮的责任并承担有关的费用,并对其做定
期修缮。
partyaisresponsibleforrepairingandmaintainingthebasicfacilitiesofthe
leasedpropertyandforbearingallcoststhereto.
8.5甲方谨在此声明及保证甲方为出租房屋的合法拥有人并由合法地位出租此
房屋与乙方。
partyaherebyrepresentsandwarrantsthatpartyaisthelegalownerofthe
leasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytopartyb.
8.6如在租赁期内,租赁房屋发生所有权全部或部分转移、或其他影响乙方权
益的事情时,甲方应保证所有权人或者其他影响乙方权益的第三者,能继续遵守本合同所有条款,如乙方与本合同的权益人首次等所有权人或第三者所影响或损害,甲方须负责任补偿乙方的所有损失、损害、支出及费用。

transferredorpartyb’srighttousetheleasedpropertyisattested,partyashallensurethatsuchtransfereeorthirdpartyhavinganeffectonpartyb’srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisagreement.partyashallalsobeliabletokeeppartybbefullyindemnifiedagainstanycosts,expenses,losses,anddamagessufferedbypartybifanyofpartyb’sinterestshereinareaffectedorprejudicedbyathirdparty.
九、承租人的责任:

9.1乙方应按合同的规定,按时支付租金,保证金及其他各项应付费用。
partybshallberesponsibletopayallrentsandfeesinattimelymanner
accordingtothetermsofthecontract.9.2乙方经甲方事先同意,可在承担租用房内进行装修及添置设备,租赁期满
必须恢复原状(正常损耗除外),并承担其费用,经甲方验收认可后归还甲方。
partybwiththepriorconsentofpartya,canrenovateandinstalladditional
facilitiesintheleasedproperty.uponexpirationifthetenancytheleasedpropertyshallberesumedtopartyainitsoriginalconditions(fairwearandtearexempted)andallexpensesarisingtherefromshallbebornebypartyb.
9.3乙方应爱护使用租赁的房屋,如因乙方的过失或过错致使房屋及设施受到
损失(正常损耗除外)乙方应负赔偿责任。

9.4乙方应按本合同的规定合法使用租赁房屋,不得擅自改变其性质,不应存
放中华人民共和国法律下所禁止的危险物品,如因此发生损害,乙方应承担全部责任。
partybshallusetheleasedpropertylegallyasagreedinthisagreementand
maynotchangesuchuseonitsown.partybshallnotstoreanydangerousitems,whichareprohibitedbythelawsinthepeople’srepublicofchinaintheleasedpropertyandshallbefullyresponsibleforanydamagesoraresultthereof.
9.5租赁期即将结束之日,经乙方同意,甲方可以带其他客户看房。
uponexpirationofthetenancyorsoonerdeterminationofthisagreement,partyacouldtakeotherstochecktheapartmentwiththepartybagreement.
9.6中英文条款及意思如有不一致之处,双方协调解决。
intheeventthatthereistheconflictbetweenthechineseversionandenglish
version,insuchcasepartyaandpartybshallgotogetherandresolvetheproblem.
十、违约处理:

10.1乙方如有下列行为之一的,甲方有权终止本合同,收回出租房屋,并且扣
除房屋保证金。
partyashallhavetherighttoterminatethisagreementrepossesstheleased
a、未得甲方同意将承租房屋擅自拆改结构改变用途
altersthestructureoftheleasedpropertywithoutauthorizationorusestheleasedpropertyotherthanforthepurposeatatedherein.
b、无故拖欠租金超过十五天
failtopayrentwithoutanyreasonsmorethan15daysaftertheduedate.c、中途退租
toterminatetheagreementdurningthetermoftenancy.
十一、适用法律
applicablelaw:
本合同的成立,其有效性、解释、签署和解决与其有关的一切纠纷均受中国法律的管辖并依据中国法律并以中文为准。
thefoemationofthisagreement.itsvalidityinterpretationexceptionandsettlementofanydisputesarisinghereundershallbegovernedandaccordingtothelawsofthepeople’srepublicofchina.
