Themeasuresforthemanagement,processingandtransportationoftimberinGuangdonghavebeenadoptedbythe72executivemeetingoftheeleventhsessionoftheGuangdongProvincialPeople'sGovernmentonMay5,2011,andareherebypromulgatedandshallcomeintoforceasofSeptember1,2011.

ChapterIGeneralProvisions

Article1inordertostrengthenthemanagement,woodprocessingandtransportationmanagement,rationalutilizationofforestresources,protectecologicalenvironment,accordingtothe"People'sRepublicofChinaforestlaw","People'sRepublicofChinaforestlawenforcementregulations"and"Guangdongprovinceforestprotectionandmanagementregulations"andotherrelevantlawsandregulations,combinedwiththeactualsituationofthisprovince,theenactmentofthisapproach.

ArticlesecondtheseMeasuresapplytothemanagement,processing,transportationandmanagementactivitiesoftimberwithintheadministrativeareaofthisprovince.

Theexploitationandutilizationofforestrybiomassenergyinvolvestheoperation,processingandtransportationofwood,andshallbeimplementedinaccordancewiththerelevantprovisionsofthestate.

Thirdsaidthemeasuresincludingtimber,logs,sawntimber,veneer,bamboo,wood,woodandwood（includingcharcoal）,treestump,heightof5cmabovethetreesandwood（bamboo）forsemi-finishedproductsetc..

Fourththecompetentforestryauthoritiesofthepeople'sgovernmentsatorabovethecountylevelshallberesponsiblefortheadministrationandadministrationoftimberprocessingandtransportationwithintheirrespectiveadministrativeareas.

Thedepartmentsofindustryandcommerce,taxation,publicsecurity,transportation,railways,shippingandcustomsshall,inaccordancewiththeirrespectivefunctions,doagoodjobinthemanagementoftimberoperation,processingandtransportation.

Thesecondchapter,timbermanagementandprocessing

Articlefifththepeople'sgovernmentsatorabovethecountylevelforestrydepartmentsshouldadheretothescientificplanning,reasonablelayout,ecologicalpriority,theprincipleofconservationofresources,establishmentofwoodprocessingindustryplanning,people'sgovernmentatthesamelevelforapproval.

Sixthplansforthepreparationoftimberprocessingindustryshallbebasedonthefollowingconditions:

（1）localsocialandeconomicdevelopmentplan;

（two）marketdemand;

（three）localforestresourcesandutilizationofforeigntimber;

（four）constructionplanningofrawmaterialforestbase;

（five）thetraditionalcraftleveloflocalwoodprocessing.

Timberprocessingindustryplanningshouldincludetheplanningperiod,thetypesofprocessingenterprisesandprocessingplants（points）,quantity,size,layout,rawmaterialprotectionandsoon.Restrictionsonprimaryprocessingprojectsandprocessingofrawhardwoodspeciesasrawmaterials.

Seventhunitsandindividualsengagedintimberprocessingandprocessingshallapplyforthe"timberprocessingandprocessinglicenseofGuangdongprovince"（hereinafterreferredtoastimberprocessingandprocessinglicense）.However,thevillagersuselegitimatesourcesoftimbertoprocesssmallamountsoffarmimplements,furnitureandbuildinghouses.

Theeighthtimberprocessingandprocessinglicensesshallbesupervisedbythecompetentdepartmentofforestryoftheprovincialpeople'sgovernment,andthecompetentforestryauthoritiesofthepeople'sgovernmentsatorabovethecountylevelshallissuethem.

Carryoutonefactory（shop）onecard.

Timberprocessingandprocessinglicensesshallbeapprovedforthemodesofoperationandprocessing,aswellasspecificitemssuchasproductcategories,scale,locationandvalidityperiod.

Articleninthapplyingfortimberbusinesslicenseshallmeetthefollowingconditions:

（1）therearelegitimatesourcesoftimberthatmatchthesizeoftheiroperations;

（two）afixedoperatingplacesuitableforitsscaleofoperation;

（three）timberlogsshallbeprovidedwithtimberinspectors;

（four）otherconditionsprescribedbylaws,regulationsandregulations.

Articletenthapplyingfortimberbusinesslicense,thefollowingmaterialsshallbesubmitted:

（I）applicationform;

（two）identitycertificateofanindividualorlegalrepresentative;

（three）timbersourcechannelcertification;

（four）proofoffixedplaceofbusiness;

（five）thetimbersurveyor'scertificateshallbesubmittedandthecontractofwoodsurveyorshallbesubmitted.

Theeleventhapplicationfortimberbusinesslicenseshallbeexaminedandapprovedbythecompetentforestrydepartmentofthepeople'sgovernmentatorabovethecountylevel.

Articletwelfthapplyingforwoodprocessinglicenseshallmeetthefollowingconditions:

（1）inlinewiththerequirementsofthelocalurbanandruralplanningandtimberprocessingindustryplanning;

（two）therearelegitimatesourcesoftimberthatmatchtheirprocessingscale;

（three）afixedprocessingplacesuitableforitsprocessingscale;

（four）equipmentandtechnicalpersonnelsuitableforitsprocessingscale;

（five）theprocessmeetstherequirementsofenvironmentalprotection;

（six）otherconditionsprescribedbylaws,regulationsandregulations.

Forthewoodprocessingcapacityofover10thousandcubicmetersofwoodprimaryprocessingpermits,constructionprojectshallhavethequalificationofforestryinvestigationandplanninganddesignunitstodesignandmakeafeasibilitystudyforthesupplyofrawmaterials.Applyfortimberprocessingcapacityof30thousandcubicmetersormoretimberprimaryprocessingpermit,shouldalsobeabletosupplymorethan50%ofrawmaterialsprocessingbaseforestbase.

Articlethirteenththefollowingmaterialsshallbesubmittedfortheapprovaloftimberprocessing:

（I）applicationform;

（two）identitycertificateofanindividualorlegalrepresentative;

（three）timbersourcechannelcertification;

（four）proofoffixedplaceofbusiness;

（five）thelistofequipment,technicalpersonnel,timberinspectorcertificateandcontractofwoodsurveyor,whichcorrespondtothescaleofprocessing;

（six）theenvironmentalimpactreportoftimberprocessingprojectpreparedbythecorrespondingenvironmentalimpactassessmentqualificationinstitution（table）.

Forthewoodprocessingcapacityofover10thousandcubicmetersofwoodprimaryprocessinglicense,shouldalsobethefeasibilityreportoftheprojectconstructiondesigndocumentsissuedwithqualificationofforestryinvestigationandplanninganddesignunitsandsuppliesofrawmaterials.Inordertoapplyfortimberprocessingcapacityof30thousandcubicmetersormore,theprimaryprocessinglicenseoftimbershallbesubmitted,andabaseforestcertificateforsupplyingmorethan50%processingrawmaterialsshallbesubmitted.

Fourteenthgradesoftimberprocessingpermitapprovalsystem:

（1）timberprocessingcapacityof10thousandcubicmetersormoreshallbeexaminedandapprovedbythecompetentforestrydepartmentoftheprovincialpeople'sgovernment.

（two）thetimberprocessingcapacityof5000cubicmetersormore（10thousandcubicmeters）oftimbershallbeexaminedandapprovedbythecompetentforestrydepartmentofthepeople'sgovernmentatorabovethecountylevel（10thousandcubicmeters）.

（three）timberprocessingpermissionandannualprocessingcapacityoftimberunder5000cubicmeters（excluding5000cubicmeters）ofwoodprimaryprocessingpermitshallbeexaminedandapprovedbythecompetentforestrydepartmentofthepeople'sgovernmentatthecountylevel（two）.

Municipalitiesdirectlyunderthestateownedforestfarmfortimbertwoprocessinglicensingandwoodprocessingcapacityof10thousandcubicmetersbelow（excluding10thousandcubicmeters）oftheprimarywoodprocessinglicense,approvalbythecompetentforestrydepartmentoftheMunicipalPeople'sgovernmentsatorabovethelevelof.

IfthestateownedForestFarmdirectlyundertheprovincialgovernmentappliesfortimberprocessingpermission,itshallbesubjecttotheapprovalofthecompetentforestrydepartmentoftheprovincialpeople'sgovernment.

Thefifteenthforestryadministrativedepartmentshallmakeanadministrativelicensingdecisionwithin20workingdaysfromthedateofacceptingtheapplicationforprocessingandprocessingoftimber.Ifitmeetstherequirements,itshallissueawoodprocessingandprocessinglicense;ifitdoesnotmeettherequirements,itshallmakeawrittendecisionwithouttheadministrativelicenseandexplainthereason.

Sixteenthtimberprocessingandprocessinglicensesvalidfor3years.Temporarypurchaseoftimbershallbevalidfornotmorethan2years.

Seventeenthtimbermanagement,processingunitsandindividualstochangetheregistrationitems,shouldbesubmittedtotheoriginalexaminationandapprovalauthorities.Ifitmeetstherequirements,theoriginalexaminationandapprovalauthoritiesshallrenewthetimberprocessingandprocessinglicensesinaccordancewiththelaw.

Eighteenth,timberprocessingunitsandindividualsneedstoextendthevalidtimberprocessinglicense,shallbe30dayspriortotheoriginalexaminationandapprovalauthorityshallapplytotheexpirydate.
