INSTITUTETIMECLAUSES

HULLS

ThisinsuranceissubjecttoEnglishlawandpractice

1.NAVIGATION

（1）Thevesseliscoveredsubjecttotheprovisionsofthisinsuranceatalltimesandhasleavetosailornavigatewithorwithoutpilots,togoontrailtripsandtoassistandtowvesselsorcraftindistress,butitiswarrantedthattheVesselshallnotbetowed,exceptasiscustomaryortothefirstsafeportorplacewheninneedofassistance,orundertaketowageorsalvageservicesunderacontractpreviouslyarrangedbytheAssuredand/orOwnersand/orManagersand/orCharterers.ThisClauseshallnotexcludecustomarytowageinconnectionwithloadinganddischarging.

（2）Intheeventoftheeventbeingemployedintradingoperationswhichentailcargoloadingordischargingatseafromorintoanothervessel（notbeingaharbourorinshorecraft）noclaimshallberecoverableunderthisinsuranceforlossofordamagetothevesselorliabilitytoanyothervesselarisingfromsuchloadingordischargingoperations,includingwhilstapproaching,lyingalongsideandleaving,unlesspreviousnoticethatthevesselistobeemployedinsuchoperationshasbeengiventotheUnderwritersandanyamendedtermsofcoverandanyadditionalpremiumrequiredbythemhavebeenagreed.

（3）IntheeventoftheVesselsailing（withorwithoutcargo）withanintentionofbeing（a）brokenup,or（b）soldforbreakingup,anyclaimforlossofordamagetotheVesseloccurringsubsequenttosuchsailingshallbelimitedtothemarketvalueoftheVesselasscrapatthetimewhenthelossordamageissustained,unlesspreviousnoticehasbeengiventotheUnderwritersandanyamendmentstothetermsofcover,insuredvalueandpremiumrequiredbythemhavebeenagreed.NothinginthisClause1（3）shalleffectclaimsunderClauses8and/or11.

2.CONVENTION

ShouldtheVesselattheexpirationofthisinsurancebeatseaorindistressorataportofrefugeorofcall,sheshall,providedpreviousnoticebegiventotheUnderwriters,beheldcoveredataproratamonthlytoherportofdestination.

3.BREACHOFWARRANT

Heldcoveredincaseofanybreachofwarrantyastocargo,trade,locality,towage,salvageservicesordateofsailing,providesnoticebegiventotheUnderwritersimmediatelyafterreceiptofadvicesandanyamendedtermsorcoverandadditionalpremiumrequiredbythembeagreed.

4.TERMINATION

ThisClause4shallprevailnotwithstandinganyprovisionwhetherwrittentypedorprintedinthisinsuranceinconsistenttherewith.

UndertheUnderwritersagreetothecontraryinwriting,thisinsuranceshallterminateautomaticallyatthetimeof

4.1changeoftheClassificationSocietyoftheVessel,orchange,suspension,discontinuance,withdrawalorexpiryofherClasstherein,providedthatiftheVesselisatseasuchautomaticterminationshallbedeferreduntilarrivalathernextport.Howeverwheresuchchange,suspension,discontinuanceorwithdrawalofherClasshasresultedfromlossordamagecoveredbyClause6ofthisinsuranceorwhichwouldbecoveredbyaninsuranceoftheVesselsubjecttocurrentInstituteWarandStrikesClausesHullsTimesuchautomaticterminationshallonlyoperateshouldtheVesselsailfromhernextportwithoutthepriorapprovaloftheClassificationSociety.

4.2anychange,voluntaryorotherwise,intheownershiporflag,transfertonewmanagement,orcharteronabareboatbasis,orrequisitionfortitleoruseofthevessel,providedthat,iftheVesselhascargoonboardandhasalreadysailedfromherloadingportorisatseainballast,suchautomaticterminationshallifrequiredbedeferred,whilsttheVesselcontinuesherplannedvoyage,untilarrivalatfinalportofdischargeifwithcargooratportofdestinationifinballast.However,intheeventofrequisitionfortitleorusewithoutthepriorexecutionofawriteragreementbytheAssured,suchautomaticterminationshalloccurfifteendaysaftersuchrequisitionwhethertheVesselisatseaorinport.

Aproratadailynetreturnofpremiumshallbemade.

5.ASSIGMENT

NoassignmentoforinterestinthisinsuranceorinanymoneyswhichmaybeorbecomepayablethereunderistobebindingonorrecognizedbytheUnderwritersunlessadatednoticeofsuchassignmentorinterestsignedbytheAssured,andbytheassignorinthecaseofsubsequentassignment,isendorsedonthePolicyandthePolicywithsuchendorsementisproducedbeforepaymentofanyclaimorreturnofpremiumthereunder.

6.PERILS

6.1Thisinsurancecoverslossofordamagetothesubject-matterinsuredcausedby

6.1.1Perilsoftheseasriverslakesorothernavigablewaters

6.1.2Fire,explosion

6.1.3Violenttheftbypersonsfromoutsidethevessel

6.1.4Jettison

6.1.5Piracy

6.1.6Breakdownoforaccidenttonuclearinstallationsorreactor

6.1.7Contactwithaircraftorsimilarobjects,orobjectsfallingtherefrom,landconveyance,dockorharbourequipmentorinstallation

6.1.8Earthquakevolcaniceruptionorlighting

6.2Thisinsurancecoverslossofordamagetothesubject-matterinsuredcausedby

6.2.1Accidentinloadingordischargingorshiftingcargoorfuel

6.2.2Burstingofboilersbreakageofshaftsoranylatentdefectinthemachineryorhull

6.2.3NegligenceofMasterorofficersorCreworPilots.

6.2.4Negligenceofrepairsorcharterersprovidedsuchrepairersorcharterersarenotanassuredhereunder.

6.2.5BarratryofMasterofficersCrew

ProvidedsuchlossordamagehasnotresultedfromwantofduediligencebytheAssumed,OwnersorManagers

6.3MasterofficersCreworPilotsnottobeconsideredOwnerswithinthemeaningofthisClause6shouldtheyholdsharesintheVessel.

7.POLLUTIONHAZARD

ThisinsurancecoverslossofordamagetotheVesselcausedbyanygovernmentalauthorityactingunderthepowersvestedinittopreventormitigateapollutionhazard,orthreatthereof,resultingdirectlyfromdamagetothevesselforwhichtheUnderwritersareliableunderthisinsurance,providedsuchactofgovernmentalauthorityhasnotresultedfromwantofduediligencebytheAssumed,theOwners,orManagersoftheVesseloranyofthemtopreventormitigatesuchhazardorthreat,Master,Officers,CreworPilotsnottobeconsideredOwnerswithinthemeaningofthisClause7shouldtheyholdsharesinthevessel.

8.3/4THSCOLLITIONLIABILITY

8.1TheUnderwritersagreetoindemnitytheAssumedforthree-fourthsofanysumorsumspaidbytheAssumedtoanyotherpersonorpersonsbyreasonoftheAssumedbecominglegallyliablebywayofdamagesfor

8.1.1lossofordamagetoanyothervesselorpropertyonanyothervessel

8.1.2delaytoorlossofuseofanysuchothervesselorpropertythereon

8.1.3generalaverageof,salvageof,orsalvageundercontractof,anysuchothervesselorpropertythereon.

WheresuchpaymentbytheAssumedisinconsequenceoftheVesselherebyinsuredcomingintocollisionwithanyothervessel.

8.2TheindemnityprovidedbythisClause8shallbeinadditiontotheindemnityprovidedbytheothertermsandconditionsofthisinsuranceandshallbesubjecttothefollowingprovisions:

8.2.1WheretheinsuredVesselincollisionwithanothervesselandbothvesselsaretoblamethen,unlesstheliabilityofoneorbothvesselsbecomeslimitedbylaw,theindemnityunderthisClause8shallbecalculatedontheprincipleofcross-liabilitiesasiftherespectiveOwnershasbeencompelledtopaytoeachothersuchproportionofeachother’sdamagesasmayhavebeenproperlyallowedinascertainingthebalanceorsumpayablebyortheAssumedinconsequenceofthecollision.

8.2.2InnocaseshalltheUnderwriters’totalliabilityunderClause8.1and8.2exceedtheirproportionatepartofthree-fourthsoftheinsuredvalueoftheVesselherebyinsuredinrespectofanyonecollision.

8.3TheUnderwriterswillalsopaythree-fourthsofthelegalcostsincurredbytheAssumedorwhichtheAssumedmaybecompelledtopayincontestingliabilityortakingproceedingstolimitliability,withthepriorwrittenconsentoftheUnderwriters.

EXCUSIONS

8.4ProvidedalwaysthatthisClause8shallinnocaseextendtoanysumwhichtheAssumedshallpayfororinrespectof

8.4.1Removalordisposalofobstructions,wrecks,cargoesoranyotherthingwhatsoever

8.4.2Anyrealorpersonalpropertyorthingwhatsoeverexceptothervesselsorpropertyonothervessels

8.4.3Thecargoorotherpropertyon,ortheengagementsof,theinsuredVessel

8.4.4Lossoflife,personalinjuryorillness

8.4.5Pollutionorcontaminationoranyrealorpersonalpropertyorthingwhatsoever（exceptothervesselswithwhichtheinsuredVesselisincollisionorpropertyonsuchothervessels）

9.SISTERSHIP

ShouldtheVesselherebyinsuredcomeintocollisionwithorreceivesalvageservicesfromanothervesselbelongingwhollyorinparttothesameOwnersorunderthesamemanagement,theAssumedshallhavethesamerightsunderthisinsuranceastheywouldhaveweretheothervesselentirelytheproperlyofOwnersnotinterestedintheVesselherebyinsured;butinsuchcasestheliabilityforthecollisionortheamountpayablefortheservicesrenderedshallbereferredtoasolearbitratortobeagreeduponbetweentheUnderwritersandtheAssumed.

10.NOTICEOFCLAIMANDTENDERS

10.1Intheeventofaccidentwherebylossordamagemayresultinclaimunderthisinsurance,noticeshallbegiventotheUnderwriterspriortosurveyandalso,iftheVesselisabroad,tothenearestLloyd’sAgentsothatasurveyormaybeappointedtorepresenttheUnderwritersshouldtheysodesire.

10.2TheUnderwritersshallbeentitledtodecidetheporttowhichtheVesselshallproceedfordockingorrepair（theactua
