01.ClaimMadeBasisClause

以索赔提出为基础批单（期内索赔式）

Itisherebyagreedandamended:

1.Thisinsuranceapplyto"bodilyinjury"and"propertydamage"resultingfromanoccurrencewhichfirstcommencesonandaftertheretroactivedatedesignatedinschedule,onlyif:

（1）Aclaimfordamagebecauseof"bodilyinjury"and"propertydamage"isfirstmadeinwritingagainstanyinsuredduringthepolicyperiodand

（2）AnyinsureddidnotknoworcouldnothavereasonablyforeseensuchoccurrenceattheeffectivedateofthisPolicy.

2.Asusedinthisendorsement:

（1）"Aclaim"byapersonororganizationseekingdamagewillbedeemedtohavebeenmadewhenwrittennoticeofsuchclaimisreceivedbyanyinsuredorbytheCompany,whichevercomesfirst;

（2）"Allclaim"fordamagebecauseof"bodilyinjury"tothesamepersonasaresultofanoccurrence,willbedeemedtohavebeenmadeatthetimethefirstofthoseclaimsismadeagainstanyinsured;

（3）"Allclaim"fordamagebecauseof"propertydamaged"causinglosstothesamepersonororganizationasaresultofanoccurrence,willbedeemedtohavemadeatthetimethefirstofthoseclaimismadeagainstanyinsured.

02.OccurrenceBasisClause“日落条款”

以事故发生为基础批单（期内发生式）

Itisherebyagreedandamended:

1.Thisinsuranceappliesto“bodilyinjury”and/or“propertydamage”resultingfromanoccurrencewhichhappensduringthepolicyperioddescribedintheschedule,onlyif:

（1）Aclaimfordamagebecauseof“bodilyinjury”and/or“propertydamage”isfirstmadeinwritingagainsttheinsurerofthisPolicybyanyinsuredbefore（areportingtimelimitnotexceed5yearsfrominception）and

（2）AnyinsureddidnotknoworcouldnothavereasonablyforeseensuchoccurrenceattheeffectivedateofthisPolicy.

2.Asusedinthisendorsement:

（1）“Aclaim”byapersonororganizationseekingdamagewillbedeemedtohavebeenmadewhenwrittennoticeofsuchclaimisreceivedbytheinsurer;

（2）“Allclaim”fordamagebecauseof“bodilyinjury”tothesamepersonasaresultofanoccurrence,willbedeemedtohavebeenmadeatthetimethefirstofthoseclaimsismadeagainsttheinsurer;

（3）“Allclaim”fordamagebecauseof“propertydamage”causinglosstothesamepersonororganizationasaresultofanoccurrence,willbedeemedtohavemadeatthetimethefirstofthoseclaimismadeagainsttheinsurer.

03.AllCostwithintheLimitofIndemnitysubjecttoSelfInsuredRetention

所有索赔处理费用（适用自负额）包含在赔偿限额内

Itisagreedthatthesupplementarypaymentsunderthepolicyarewithinthelimitsofinsuranceshowninthedeclarations.

Ourrightanddutytodefendceasewhenwehaveuseduptheapplicablelimitofinsuranceinthepaymentofjudgements,settlementsorsupplementarypayments.

OurobligationtopaythesupplementarypaymentsappliesonlyinexcessofanySelfInsuredRetentionamountsstatedintheDeclarations.

SELF-INSUREDRETENTION（PERCLAIM）

1.Inconsiderationofthepremiumcharged,itisagreedtheLimitsofInsuranceforeachofthecoverage’sprovidedbythispolicywillapplyexcessofaUS$50,000.00perclaim.Self-InsuredRetention（hereinafterreferredtoasthe“RetentionAmount”）.

TheRetentionAmount:

（a）shallapplyonlyto“occurrences”coveredunderthispolicy,and

（b）shallapplyseparatelytoeachclaimarisingoutofsuch:

“occurrence”,and

（c）shallincludeallSupplementaryPaymentofpolicy

Yourbankruptcy,insolvencyorinabilitytopaytheRetentionAmountshallnotincreaseourobligationunderthispolicy.

2.Weshallhavetherightbutnotthedutytoparticipatewithyouatourownexpenseinthedefenseorsettlementofanyclaimorsuitseekingdamagescoveredunderthispolicy.Intheeventofaclaimorsuitwhichinourreasonablejudgmentmayresultinpayments,includingsupplementarypayments,inanamountinexcessoftheretentionamount,wemayassumecontrolofthedefenseorsuchclaimofsuit.Youwillcontinuetoberesponsibleforthepaymentoftheretentionamount.

3.Intheeventthereisanyotherinsurance,whetherornotcollectible,applicabletoan“occurrence”,claimorsuitwithintheretentionamount,youwillcontinuetoberesponsibleforthefullretentionamountbeforethelimitsofinsuranceunderthispolicyapply.

04.Employees'BodilyInjuryExclusion

雇员身体伤害除外条款（或称为雇主责任除外条款）

NotwithstandinganythingtothecontrarycontainedinthisPolicy,itisagreedthatthisPolicyshallnotapplytoanyliabilityforbodilyinjury,sickness,disease,occupationaldisease,disability,shock,mentalanguishormentalinjury,includingdeathatanytimeresultingtherefrom,sustainedbyanemployeeoftheInsured,andarisingoutofandinthecourseofhisemploymentbytheInsured.

SubjectotherwisetothetermsexceptionsandconditionsofthePolicy.

05.Punitive/ExemplaryDamageExclusion

惩罚性赔偿/罚金除外条款

Itisagreedthatsuchcoverageasisaffordedbythispolicyshallnotapplytofines,penalties,punitiveorexemplarydamagesagainstthenamedinsured.

06.WarandTerrorismExclusion

战争及恐怖主义除外条款（采用美国政府对恐怖主义之定义）

Itisherebydeclaredandagreedthatthisendorsementmodifiesinsuranceprovidedunderthefollowing:

Underany“Exclusions”Section,Warisdeletedinitsentiretyandreplacedwiththefollowing:

“Bodilyinjury”,“propertydamage”“personalinjury”or“advertisinginjury”duetowar,whetherornotdeclared,oranyactorconditionincidenttowar.Warincludescivilwar,insurrection,invasion,actofforeignenemy,civilcommotion,factionalcivilcommotion,militaryorusurpedpower,rebellionorrevolution.

All“Exclusions”Sections,isamendedwiththeadditionofthefollowingexclusion:

“Bodilyinjury”or“propertydamage”arisingdirectlyorindirectlyasaresultoforinconnectionwith“terrorism”including,butnotlimitedto,anycontemporaneousorensuing“bodilyinjury”or“propertydamage”causedbyfire,lootingortheft.

“Terrorism”meanstheuseorthreateneduseofforceorviolenceagainstpersonorproperty,orcommissionofanactdangeroustohumanlifeorproperty,orcommissionofanactthatinterfereswithordisruptsanelectronicorcommunicationsystem,undertakenbyanypersonorgroup,whetherornotactingonbehalfoforinconnectionwithanyorganization,government,power,authorityormilitaryforce,whentheeffectistointimidateorcoerceagovernment,thecivilianpopulationoranysegmentthereof,ortodisruptanysegmentoftheeconomy.

TerrorismshallalsoincludeanyactwhichisverifiedorrecognizedbytheUnitedStatesGovernmentasanactofterrorism.

Allothertermsandconditionsofthepolicyremainthesame.

07.AbsolutePollutionExclusion

绝对污染除外条款

NotwithstandinganythingtothecontrarycontainedinthisPolicy,itisagreedthatthispolicyshallnotapply:

A.Toanypersonalinjuryorpropertydamagearisingoutoftheactualorthreateneddischarge,dispersal,releaseorescapeofpollutions,anywhereintheworld;

B.Toanyloss,costorexpensearisingoutofanygovernmentaldirectionorrequestthattheinsured,thecompanyoranyotherpersonororganizationtestfor,monitor,cleanup,remove,contain,treat,detoxifyorneutralizepollution.

C.Toanyloss,costorexpense,includingbutnotlimitedtocostsofinvestigationorattorney’sfees,incurredbyagovernmentunitoranyotherpersonororganizationtotestfor,monitor,cleanup,remove,contain,treat,detoxifyorneutralizepollutions.

“Pollutions”meansanysolid,liquid,gaseousorthermalirritantorcontaminant,includingsmoke,vapor,soot,fumes,acids,alkalis,chemicalsandwastematerials.Wastematerialsincludematerialswhichareintendedtobeorhavebeenrecycledreconditionedorreclaimed.

Further,shouldtheunderlyinglimitsbecomeimpairedorexhaustedforclaim（s）payment（s）and/orlossadjustmentexpense（s）excludedbythisendorsement,coverageprovidedbythispolicywillnotdropdownovertheimpairedorexhaustedunderlyinglimits,however,thepolicywillcontinuetorespondforcoveredclaimsinexcessofthelimitsstatedinthedeclarationpageasunderlying.

SubjectotherwisetothetermsexceptionsandconditionsofthisPolicy.

08.AbsoluteAsbestosExclusion

NotwithstandinganythingtothecompanycontainedinthisPolicy,itisagreedthatthispolicyshallnotapply:

A.Toanyliabilityforpropertydamage,personalinjury,sickness,disease,occupationdisease,disability,shock,death,mentalanguishormentalinjuryatanytimearisingourofthemanufactureof,miningof,useof,saleof,installationof,removalof,distributionof,orexposuretoasbestos,asbestosproducts,asbestosfibersorasbestosdust;

B.Toanyobligationoftheinsuredtoindemnifyanypartybecauseofdamagesarisingourofsuchpropertydamage,personalinjury,sickness,disease,occupationdisease,disability,shock,death,mentalanguishormentalinjuryatanytimeasaresultofthemanufactureof,miningof,useof,saleof,installationof,removalof,distributionoforexpensetoasbestos,asbestosproducts,asbestosfibersorasbestosdust;

C.Toanyobligationtodefendanysuitorclaimagainsttheinsuredallegingpersonalinjury,orpropertydamage,ifsuchsuitorclaimarisesfrompersonalinjuryorpropertydamageresultingfromorcontributedto,byanyandallmanufactureof,miningof,useof,saleof,installationof,removalof,distributionof,orexposuretoasbestos,asbestosproducts,asbestosfibersorasbestosdust.

Further,shouldtheunderlyinglimitsbecomeimpairedorexhaustedforclaim（s）payment（s）and/orlossadjustmentsexpense（s）excludedbythisendorsement,coverageprovidedbythispolicywillnotdropdownovertheimpairedorexhaustedunderlyinglimits,however,thepolicywillcontinu
