Article1TheseRegulationsareformulatedwithaviewtosafeguardingthesovereigntyofthePeople'

sRepublicofChina,maintainingitssecurityandsocialorderandfacilitatingtheexitandentryofpersonsandmeansoftransportation.

Article2TheMinistryofPublicSecurityshallberesponsiblefortheadministrationoftheexitandentryfrontierinspection.

Article3ThePeople'

sRepublicofChinashallsetupexitandentry　frontierinspectionstations（hereinafterreferredtoasfrontierinspection　stations）atopenports,airports,stationsandborderthoroughfares.

Article4InordertosafeguardthesovereigntyoftheStateandmaintain　itssecurityandsocialorder,frontierinspectionstationsshallexercisethefollowingfunctions:

（1）carryingoutfrontierinspectiononpersonsleavingorenteringthecountryandtheirluggageandotherpersonalbelongings,andonmeansoftransportationleavingorenteringthecountryandtheirfreight;

（2）exercisingsupervisiononmeansoftransportationleavingorenteringthecountryinaccordancewiththerelevantregulationsoftheState;

（3）guardingrestrictedareasinportsandmaintainingtheorderofexitandentry;

and

（4）performingotherfunctionsassignedbythecompetentauthoritiesorstipulatedbyotherlawsandadministrativeregulations.

Article5ForexitfromorentryintoChina,personsandmeansoftransportationshallpassthroughtheopenportsorotherportsspeciallydesignatedbythecompetentauthoritiesandshallsubjectthemselvestofrontierinspection,supervisionandcontrol.

Personsleavingorenteringthecountryshallabidebythelawsand　administrativeregulationsofthePeople'

sRepublicofChina.

Article6Frontierinspectionpersonsmustexecutetheirdutiesaccordingtolaw.

Noorganizationorindividualmayobstructthefrontierinspectorfromlawfullyexecutinghisduties.

CHAPTERIIINSPECTIONANDCONTROLOFPERSONS

Article7ForexitfromorentryintoChina,personsshallfillinarrivalordeparturecardsinaccordancewiththerelevantregulationsandpresenttothefrontierinspectionstationsforexaminationoftheirvalidpassportsorotherexitorentrydocuments（hereinafterreferredtoasexit-entrydocuments）;

theymayleaveorenterthecountryafterthefrontierinspectionstationshaveexaminedandapprovedtheirdocuments.

Article8Thefrontierinspectionstationshavethepowertoforbidpersonsbelongingtoanyofthefollowingcategoriestoleaveorenterthecountry:

（1）failingtoholdexit-entrydocuments;

（2）holdingandusinginvalidexit-entrydocuments;

（3）holdingandusingexit-entrydocumentsotherthantheirown;

（4）holdingandusingforgedoralteredexit-entrydocuments;

（5）refusingtoacceptfrontierinspection;

（6）failingtopassthroughtheportsasdesignated;

（7）beingforbiddentoleaveorenterthecountry　underthenoticeofthepublicsecuritydepartmentorthestatesecuritydepartmentoftheStateCouncil;

or

（8）beingforbiddentoleaveorenterthecountryinaccordancewiththelawsandadministrativeregulations.

Thefrontierinspectionstationmaydetainorconfiscatetheexit-entrydocumentsofthepersonsdefinedintheitem（3）or（4）aboveoroftheChinesecitizensdefinedintheitem（7）or（8）above.

Article9TheseRegulationsshallapplytofrontierinspectionand　controlontheaccompanyingworkingpersonsonboardthemeansoftransportationleavingorenteringthecountry.WherethereisanagreementbetweenthePeople'

sRepublicofChinaandanothercountryorregion,thefrontierinspectionandcontrolshallbeconductedaccordingtotheagreement.

Article10CrewmembersofaliennationalityorfromHongKong,MacaoandTaiwanandtheiraccompanyingdependantswho,uponthearrivaloftheirvesselsatportsofthePeople'

sRepublic　of　China,wishtolandorlodgeatporttownsshallapplythroughtheircaptainsorcaptains’agentstothefrontierinspectionstationforgoingthroughthelandingorlodgingformalities.

Crewmembersandtheiraccompanyingdependantswhohavelandedorlodgedwithpermissionshallreturntotheirvesselswithinthespecifiedtimelimit.Thosewhohaveviolatedlawsafterlandingshallbeorderedtoreturntotheirvesselsimmediatelyifthecircumstancesarenotseriousenoughtoconstituteacrime,andshallnotbepermittedtolandagainthereafter.

Chinesecrewmembersonvesselsnavigatinginternationalroutesmaylandorlodgebypresentingtheirexit-entrydocuments.

Article11Thefrontierinspectionstationsshallhavethepowertorefuse　theapplicationforlandingofthepersonsdefinedinArticle8oftheseRegulations.　

Article12Personswhowishtoembarkonordisembarkfromalien　vesselsshallpresenttothefrontierinspectionforexaminationoftheir　exit-entrydocumentsorotherdesignateddocumentsandobtainpermission.Personnelfromportinspectionandquarantineorgansshallbedressedinuniformandproducetheirdocumentswhentheyhaveneedtoboardsuchvesselstoexecutetheirduties.

Article13FrontierinspectionontransitoryexitorentryofpersonsonpublicbusinessandofborderresidentsofbothsidesintheborderingareasbetweenthePeople'

sRepublicofChinaandaneighboringcountry（orregion）shallbeconductedinaccordancewiththerelevantagreementsbetweenthetwosides.Intheabsenceofsuchagreements,theseRegulationsshallapply.

BorderresidentsofacountryadjacenttoChinawhohaveenteredChinatransitorilyincompliancewiththerelevantagreementshallconfinetheiractivitieswithintheareaprescribedundertheagreement.Incasethereisaneedtotravelbeyondtheprescribedarea,theyshallgothroughentryformalitiesinadvance.

Article14Frontierinspectionstations,whentheydeemitnecessary,mayconductbodysearchonpersonsleavingorenteringthecountry.Thesearchshallbeconducted　by　two　frontierinspectorsofthesamesexas　thepersontobesearched.

Article15　Wherepersonsleavingorenteringthecountry　belong　to　anyofthefollowingcategories,thefrontierinspectionstationshavethepowertorestricttheboundoftheiractivities,takeinvestigationorhandthemovertothecompetentauthoritiesfordisposal:

（1）beingsuspectedofholdingandusingexit-entrydocumentsotherthantheirown;

（2）beingsuspectedofholdingandusingforgedoralteredexit-entrydocuments;

（3）beingcriminalsuspectsnotifiedbythepublicsecuritydepartmentor　thestatesecuritydepartmentoftheStateCouncilorbythepublicsecurityorganorthestatesecurityorganoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment;

（4）beingsuspectedofcommittinganyactsharmfultothenationalsecurity,interestsandsocialorders.

CHAPTERIIIINSPECTIONANDSUPERVISIONONMEANSOFTRANSPORTATION

Article16MeansoftransportationleavingorenteringthecountrymustacceptfrontierinspectionpriortotheirdeparturefromortheirarrivalintheportsofChina.Entryinspectiononmeansoftransportationshallbeconductedattheirfirstarrivalport;

exitinspectionshallbeconductedattheirlastdepartureport.Underexceptionalcircumstances,entryandexitinspectiononmeansoftransportationmaybeconductedatspeciallypermittedplaceswiththeapprovalofthecompetentauthorities.

Article17Personsinchargeofmeansoftransportationortransportationdepartmentsconcernedshallnotifyinadvancethefrontierinspectionconcernedofthearrivingordepartingtime,thestoppingplaceandtheparticularofthepersonsandfreightonboardofthevessels,aircraftortrainsleavingorenteringthecountry.

Onarrivalatports,captainsortheiragentsofvesselsandaircraftshallfurnishthefrontierinspectionstationswithanamelistofthecrewandpassengers;

personsinchargeoftrainsandothermeansoftransportationshallreporttothefrontierinspectionstationsthenumberofworkingpersonnelandpassengersabroad.

Article18Personsinchargeofthemeansoftransportationortheiragentsshallbepresentatthesceneofinspectionandrenderassistancewhenfrontierinspectorsarecarryingoutfrontierinspectiononthesemeansoftransportation.

Article19MeansoftransportationleavingorenteringthecountryshallproceedalongtheroutesinChinaasspecified.Alienvesselsmaynotanchorormooratnon-openportswithoutapproval.

Withouttheapprovalfromthe　frontierinspection　station,nopersons,cargoesorarticlesmaybetakenonboardordischargedfromthemeansoftransportationwhichareabouttodepartfromChinaduringtheperiodfromthetimeafterexitinspectiontothetimeoftheirdeparture,orthemeansoftransportationwhichhavearrivedinChinaduringtheperiodfromthetimeoftheirarrivaltothetimebeforeentryinspection.

Article20WhereChinesevesselshaveneedtomakefasttoalienvessels,captainsortheiragentsshallapplytothefrontierinspectionstationforgoingthroughnecessaryformalities.Withoutsuchformalities,noChinesevesselsmaymakefasttoalienvessels.

Article21Thefrontierinspectionstationsshallhavethep
