AdministrationofIndividualForeignExchangeundertheCapitalAccount."

Article3Foreignexchangepurchasedbyanindividualmayberemittedabroad,depositedinhis/herforeignexchangesavingsaccount,orcarriedacrosstheborderinaccordancewiththerelevantprovisions.

Article4Whentheamountofindividualforeignexchangepurchasesandsalesiswithinthetotalannualtotal,theindividualmayentrusthis/herimmediatefamilymemberstodealwiththebusiness;

whentheamountofindividualforeignexchangepurchasesandsalesoroverseasindividualpurchasesofforeignexchangeexceedsthetotalannualquota,theindividualmayentrustotherstodealwiththebusinessuponthestrengthoftherelatedsupportingdocumentsinaccordancewiththeprovisionsintheseDetailedRules.

Article5Incaseswhenanindividualcarriesforeigncashacrosstheborder,he/sheshallobeytherelevantadministrativeprovisionsoftheState.

Article6Alldesignatedforeignexchangebanks（hereinafterreferredtoasbanks）shallexamineandverifytheauthenticityofindividualforeignexchangetransactionsinaccordancewiththeprovisionsoftheseDetailedRules.Anyforgedoralteredtransactionsareprohibited.

Thebanksshallprocessthetransactionsofindividualforeignexchangepurchasesandsalesthroughthemanagementinformationsystemforindividualsalesandpurchasesofforeignexchange（hereinafterreferredtoasthesystemforindividualsalesandpurchasesofforeignexchange）,andshallinputtherelevantinformationtruthfully,accurately,andcompletely.

Article7TheSAFEanditsbranches/sub-branches（hereinafterreferredtoasforeignexchangebureaus）shallberesponsibleforcollectingthestatisticaldata,supervising,managing,andinspectingtheindividualforeignexchangebusinesses.

Chapter2AdministrationofIndividualForeignExchangeundertheCurrentAccount

Article8Individualforeignexchangereceiptsandpaymentsunderthecurrentaccountareclassifiedintobusiness-basedforeignexchangereceiptsandpaymentsandnon-business-basedforeignexchangereceiptsandpayments.

Article9Individualbusiness-basedforeignexchangereceiptsandpaymentsunderthecurrentaccountshallbehandledinaccordancewiththefollowingprovisions:

（1）Anindividualforeigntradebusinesspersonshallhandlethepurchase,payment,collection,andsaleofforeignexchangeunderforeigntradethroughhis/herforeignexchangesettlementaccount;

andhis/herforeignexchangereceiptsandpayments,verificationsforimportsandexports,anddeclarationsonthebalanceofpaymentsshallbehandledinlinewiththeformalitiesapplicabletoinstitutions.

Anindividualforeigntradebusinesspersonreferstoanindividualengaginginforeigntradebusinessactivitieswhohasattendedtotheformalitiesofregisteringattheadministrativedepartmentforindustryandcommerceortheotherbusinessformalitiesaccordingtolaw,hasobtainedabusinesslicenseorothercertificatesforbusinessoperations,hashandledtherecordingformalitiesforregistration,andobtainedtheforeigntraderightinaccordancewiththeprovisionsofthecommerceadministrativedepartmentoftheStateCouncil.

（2）Whenaprivatebusinesspersonentrustsanyenterprisewithforeigntraderightstohandletheimportbusiness,he/sheshallpurchaseforeignexchangebyhimself/herselfuponthestrengthoftheimportagentcontractortheagreementsignedwiththeentrustedenterprise.Thepurchasedforeignexchangeshallbetransferreddirectlyfromhis/herforeignexchangesettlementaccounttotheforeignexchangeaccountunderthecurrentaccountheldbytheentrustedenterprise.

Whenaprivatebusinesspersonentrustsanyenterprisewithforeigntraderightstohandletheexportbusiness,he/shemaydealwithforeignexchangecollectionsandsalesthroughhis/herownforeignexchangesettlementaccount.Salesofforeignexchangeshallbehandleduponthestrengthoftheexportagentcontractortheagreementsignedwiththeentrustedenterpriseandthecustomsexportdeclarationformsoftheentrustedenterprise.Afterfilingatthelocalforeignexchangebureautheprivatebusinesspersonsnameandaccountnumbersaswellasotherdocumentsprescribedfortheverification,theentrustedenterprisemayusetheprivatebusinesspersonsnoticeofcollectionasthesupportingdocumentforverification.

（3）Anoverseasindividualshallhandlethesaleofforeignexchangeunderthetradeitemsoftourismandshoppinguponthestrengthofhis/hervalididentitycertificateandthecustomsdeclarationformforindividualtourismandshopping.

Article10Whenadomesticindividual'

snon-business-basedforeignexchangesalesunderthecurrentaccountexceedthetotalannualquota,he/sheshallhandlethebusinessatthebanksuponthestrengthofhis/hervalididentifycertificateandthefollowingsupportingdocuments:

（1）Fordonations:

anotarizedagreementordonationcontract.ThedonationsshallcomplywiththerelevantprovisionsoftheState;

（2）Foralimony:

evidenceoftherelationshipoftheimmediatefamilymemberoranotarizeddocumentforalimonypayment,andproofofrevenueoftheoverseaspayer,suchasbankstatementsorindividualtaxreturns;

（3）Forinheritanceincome:

legalornotarizeddocumentofinheritance;

（4）Forinsurancepayments:

insurancepolicyandproofofpaymentfromtheoperatinginsuranceinstitution.PurchasesofinsurancepoliciesinforeignexchangeshallmeettherelevantprovisionsoftheState;

（5）Forpatentandroyaltyincome:

proofofpayment,agreement,orcontract;

（6）Forlegal,accounting,consulting,andpublicrelationservicesincome:

（7）Foremploymentcompensation:

contractofemploymentandevidenceofincome;

（8）Forproceedsfromoverseasinvestment:

foreignexchangeregistrationcertificateofoverseasinvestment,resolutionofprofitdistributionordividendpayments,orevidenceofotherincome;

（9）Forother:

relevantevidenceandpaymentvouchers.

Article11Whenanoverseasindividual'

snon-business-basedforeignexchangesalesunderthecurrentaccountexceedthetotalannualquota,he/sheshallhandlethebusinessatthebanksuponthestrengthofhis/hervalididentitycertificateandthefollowingsupportingdocuments:

（1）Forrentexpenditures:

leaseregisteredatthehousingauthority,invoiceornoticeofpayment;

（2）Forlivingexpenses:

relevantcontractorinvoices;

（3）Formedicalexpenses,tuition,andrelatedexpenses:

receiptsfromdomestichospitals（schools）;

（4）Forother:

WhentheamountofasingleforeignexchangesaleisequivalenttoUSD50,000ormore,theindividualshalldirectlytransfertherenminbicapitalgainedfromthesaleofforeignexchangeintothedomesticrenminbiaccountheldbythecounterpartyofthetransaction.

Article12Whenadomesticindividual'

snon-business-basedforeignexchangepurchasesunderthecurrentaccountexceedthetotalannualquota,he/sheshallhandlethebusinessatthebanksuponthestrengthofhis/hervalididentitycertificateandtherelevantsupportingdocumentsindicatingthetransactionamount.

Article13Whenanoverseasindividualpurchasesforeignexchangewithhis/herlawfulrenminbiincomeunderthecurrentaccountandexchangestheun-usedpartofthepurchasedrenminbibackintoforeignexchange,he/sheshallhandleitinaccordancewiththefollowingprovisions:

（1）Forforeignexchangepurchaseswithlawfulrenminbiincomeunderthecurrentaccountobtaineddomestically,theindividualshallhandleituponthestrengthofhis/hervalididentitycertificateandrelevantsupportingdocuments（includingtaxreturns）indicatingthetransactionamount.

（2）Forexchangesoftheun-usedpartofpurchasedrenminbibackintoforeignexchange,theindividualshallhandleituponthestrengthofhis/hervalididentitycertificateandtheoriginalexchangememo,andthelattershallbevalidfor24monthsfromthedateoftheexchange;

incaseswhenthetotaldailyamountisnotmorethanandincludingtheequivalentofUSD500（orUSD1000iftheexchangeismadewithintheboundariesbutoutsideofthecustomssupervisionzonebeforehe/sheleavesthecountry）,theindividualmayhandleitsolelyuponthestrengthofhis/hervalididentitycertificate.

Article14Incaseswhenadomesticindividualremitsforeignexchange

overseasforexpensesunderthecurrentaccount,he/sheshallhandleitinaccordancewiththefollowingprovisions:
