laborpayment,socialsecurityandwelfare
1.partyashouldpaypartybmonthlysalaryaccordingtonational,municipalgovernmentand
company’srelevantrequirement,aswellaspartyb’sposition,whichshouldnotlowerthanlocalminimumwagestandard.
2.partyacangiverewardtopartybaccordingtotherelevantprovisionsofthestateandthe
unitduetotheoutstandingcontributionsofpartyb.
3.asstipulatedbycentralgovernmentandautonomousregiongovernment,partyashallpaya
partofsocialsecurityfee,coveringunemployment,pension;
partyakeepsthecustodyofinsurance,andreturntopartybwhensheleave.ifpartybleavethepositionduetothedefault,partybhastherighttowithholdtheinsurancedocumentuntilpartybfullycompensatealllosses.

labordisciplines
1.partyashallsetupandimprovetheinternalregulationsandlabordisciplinesaccordingto
thelaws,supervisepartybaccordingtolaws.
2.partybshallstrictlyabidebytheregulationsformulatedbypartya,andsubjecttopartya’s
management.
clause6:
alteration,dissolution,suspensionandrenewalofcontract
1.bothpartiescouldchangethecontractafteragreementifanyofthefollowingisfound:
1）onmutualconsentonthechangeofthelineofproductionorbusinessscopeofpartya;
2）thelaws,regulationsandpoliciesasstipulatedbeforehavebeenchanged;
3）theforcemajeureoramajorchangeintheobjectivecircumstancetakesplacebythetimeof
signingthecontractandthecontractcannotbeexecuted.
2.ifanyofthefollowingisfoundtopartyb,partyaisentitledtocancelthecontract.
1）partybisprovednotmeettheconditionsofemploymentduringtheprobationperiod.
2）partybseriouslyviolateslabordisciplinesortherulesandregulationsmadebypartya.
3）partybmakesseriousmistakesorengagesinmalpracticeforselfishendwhichisresulting
greatlossestopartya.
4）partybmakesseriousbadinfluenceonthesocietyandthecompanyduetocriminalaction
ofpartyb.
3.partybhastherightofinformingpartyaofterminatingthecontractatanytimeinthefollowingcase.
1）partybnoticespartyaofterminatingthecontractinwrittenform30daysahead;
2）intheprobationperiod;
3）confirmedbyrelevantnationaldepartment,laborsafetyandhealthconditionsprovidedby
partyaaresopoorthatpartyb’ssafetyandhealthareseriouslyharmed
;
4）partyashallnotpayremuneration,socialinsuranceandwelfareagainstthecontract;
5）partyagoesgainstthecontractandthreatenthelegalrightsofb;
6）partybisadmittedtohigherstudyinstitutionsatherownexpense.
4.thecontractshallbeterminatedinanyoffollowingcases.
1）thecontractisexpired;
2）partybmeetstherequirementsofretirement.
3）partybdiedincontractperiod;
4）thecircumstancescontributingtotheterminationofthelaborcontractagreedbybothsides
turnup.
5.whenthecontactisexpired,duetopartya’sdemand,itmaybecontinuedupontheagreementofpartybthroughnegotiationbetweenthetwoparties.
6.theproceduresofterminationandcontinuousnessofthecontractshallbegonethroughwithin30daysfromthedateofcontractexpiration.thiscontractwillbeautomaticallycontinuedifnoanyformalitywereconductedandthelaborrelationshipalsoexists.

scopeforbreachofthecontract
thecontactshallbelegallyboundbylawuponsign.thepartywhichoneviolatesthecontractshallassumetheliabilities;
causeslosstotheotherpartyshallcompensatefortheotherpartyaccordingtorelevantregulations.thescopeforbreachofthecontractshouldincludethefollowingcaseexceptforthetheaboveclauses:
1.partybcannotdoparttimejobsforanyothercompanieswithouttheconsentofpartya
duringthecontractperiod;
2.partybcannotleakoutthecommercialsecrets;
3.partybshouldstrictlyobeylabordisciplinesandregulationsstipulatedpartya;
4.alltheachievementsandproductsofpartybshallbeownedbybothsidesduringthe
workingperiod.partybshallnotmakeactivitiessuchastransfer,sell,orprofit-makingwithoutpermission.
5.partyacannotinterferewiththepersonalfreedomofpartyb.

anyassociatedmattersneedtosupplementoraltershallbesettledbybothpartiesinwrittenform.

二、工作内容和义务jobcontentandresponsibility

三、劳动保护和劳动条件laborprotectionlaborcondition
1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定，为乙方提供必要的工作条件和劳动保护设施，保障乙方的安全与健康；

2、甲方根据国家有关规定制定工时制度，乙方确因生产经营需要延时的，甲方应当依法安排乙方补休或支付相应的加班费；
假设乙方实行的是级别工资，则在当月的绩效考核中表达；
accordingtotherelevantregulationsofworkinghoursystem，ifpartybneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyashallarrangepartybcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;
ifpartybisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.
3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护；
partyashouldprovideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththe
relevantprovisionsofthestate.
4、甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的告知、教育和培训。

四、劳动报酬laborremuneration
根据“按劳分配”原则，实行同工同酬，乙方的报酬不得低于当地最低工资标准。
具体薪酬标准、支付方式以及支付时间按公司制定的《薪酬管理制度》执行。
