Theregulationsonurbanafforestationinchangchuncity

（January25,1995,changchuntenththe14thmeetingofthestandingcommitteeofthepeople'scongressexaminedandapprovedonApril14,1995injilinprovincethe16thsessionofthestandingcommitteeoftheeighthpeople'scongressapprovedannouncementreleasedonMay6,1995

Accordingtochangchun,September26,1997thetenthpeople'scongressstandingcommitteemeetingbyNovember14,1997,35injilinprovincetheeighthof34people'scongressstandingcommitteeapprovedthechangchuncitypeople'scongressstandingcommitteeonmodifying

OnOctober28,2004,changchunthe12thsessionofthe14thmeetingofthestandingcommitteeofthepeople'scongressrevisedbyNovember26,2004injilinprovincetenthpeople'scongressapprovedthe16thsessionofthestandingcommitteeofreleasedonDecember16,2004announcementeffectiveasofFebruary1,2005）

Thefirstchapterthegeneral

Article1inordertopromotethedevelopmentofurbangreening,protectandimprovetheurbanecologicalenvironment,improvethelevelofresidents'physicalandmentalhealth,accordingtotheurbanplanningactofthePeople'sRepublicofChina,theurbangreeningordinanceandotherrelevantlawsandregulations,combinedwiththeactual,theseregulationsareformulated.

Article2theseregulationsshallapplytotheplanning,construction,protectionandmanagementofurbangreeningintheurbanplanningareasofthecity.

Article3theurbangreenareasmentionedintheseregulationsinclude:

（1）parkgreenspace:

opentothepublic,andtakeanapasthemainfunction,andhavethegreenspaceofecology,beautificationanddisasterprevention.

（2）theproductionofgreenspace:

thenurseryofseedlings,flowers,beds,andgrassbedsforurbanafforestation.

（3）protectedgreenspace:

greenspacewithhealth,isolationandsafetyprotectionincities.Itincludessanitaryisolationbelt,roadprotectiongreenspace,urbanhighpressurecorridorgreenbelt,windbreak,citygroup

isolationbeltandsoon;

（4）subsidiarygreenspace:

thelandfortheuseofthegreenspaceoutsidethegreenspaceintheurbanconstructionland.Includinglandforresidentialland,publicfacilities,landforindustrialland,storage,foreignlandfortraffic,roadsquareland,municipalfacilitiesandspeciallandofgreenspace;

（5）othergreenSpaces:

greenspacethatdirectlyaffectsthequalityofurbanecologicalenvironment,leisurelife,urbanlandscapeandbiodiversityprotection.Includingthescenicarea,waterconservation,countryparks,naturereserves,forestpark,scenicforestland,urbangreeningbelt,parks,wetlands,greenspaceinreturningtothelandfill.

Article4theconstructionandadministrationofurbanafforestationshallbegovernedbytheprincipleofunifiedleadership,unifiedplanningandresponsibilityforclassification.

Article5thepeople'sgovernmentofthecityanddistrictshallstrengthenthescientificresearchofurbangreening,andpromotetheapplicationoftheachievementsofgreeningscienceandtechnology.Optimizethestructureofgreening,encouragethecultivation,breedingandintroductiontoadapttothenaturalconditionsinthecityofnewplantvarieties,promotingscientificplantingandmaintenancetechniques,promoteplantdiversity.

Thepeople'sgovernmentofthecityanddistrictshallpromotetheuseofadvancedandapplicabletechnologyforthepreventionandcontrolofharmfulorganismsingardenplants.

Article6unitsandindividualsthathavetheobligationtoplanttreesshallcompletethetreeplantingtasksaccordingtotheprovisions.Anyunitorindividualshall

takecareoftheafforestationandafforestationfacilities,andshallhavetherighttoprevent,prosecuteandaccusetheACTSofviolationoftheseregulations.

Article7theadministrativedepartmentoflandscapeafforestationofthepeople'sgovernmentofthemunicipalgovernmentshallberesponsiblefortheadministrationofurbangreening.

Districturbanconstructionmanagementdepartmentisurbangreeningdistrictpeople'sgovernmentadministrativedepartments,accordingtothedivisionofduties,beresponsiblefortheurbangreeningadministrationwithintheirrespectiveadministrativeareas.

Theadministrativeandlaw-enforcementauthoritiesinthecityshall,inaccordancewiththestatutoryauthority,beresponsibleforthepunishmentoftheillegalactivitiesofthecity'safforestation.

Withinaplannedurbanarea,therelevantlawsandregulationsbythecompetentadministrativedepartmentforforestry,suchastraffic,waterconservancymanagementofgreening,inaccordancewiththerelevantlawsandregulations.

Article8ofthemunicipal,districtpeople'sgovernmentshallencourageunitsandindividualstoinvest,donated,RenJian,adoption,RenGuanform,constructionandmaintenanceofgreenspace,fomoustreesandtrees,guideandorganizethemassestoplantJiNianShu,memorialforestconstruction.

Theunitsandindividualswhomakeoutstandingachievementsinurbangreeningworkshallbecommendedandrewardedbythemunicipalanddistrictpeople'sgovernments.

Chapteriiplanningandconstruction

Article9thecompetentdepartmentofurbanplanningadministrationshall,inconjunctionwiththemunicipallandscapingadministrativedepartment,formulatetheurbanafforestationplanandincorporatetheoverallplanofthecity.

Theadministrativedepartmentsforlandscapingandlandscapingofthemunicipalparksshallimplementtheplanaccordingtotheurbanafforestationplan.

Article10theurbangreeningplanningshouldfromsetoutactually,accordingtotheneedsofurbandevelopment,reasonablearrangementwiththeurbanpopulationandurbanareathatmeettheneedsofurbangreenlandarea.

Article11shallbeaccordingtothecharacteristicsofthelocalurbangreeningplanning,scientificuseoftopography,landform,water,vegetationandhistoricalandculturalsitessuchasnaturalandculturalconditions,toimprovetheecological,environmentalprotection,convenienttothemassesastheprinciple,settingupreasonableparkgreenspace,greenproduction,protectivegreenbelt,attachedgreenspaceandothergreenspace.

Article12themunicipalcityplanningadministrativedepartmentsshalljointlywiththeadministrativedepartmentofcitylandscaping,accordingtotheurbangreeningplanning,tohavebeenbuiltintheparkgreenspaceandurbanplanningdetermineaffiliatedgreenbelt,protectivegreenspace,greenproduction,greenspaceandothergreenspaceanddelimittheplanninggreenline（hereinafterreferredtoasthegreenline）.Thelandwithinthegreenlineshallnotbealteredforuseandshallnotbeconstructedwithouttherelevantconstructionofthecity.

Forthecity'sconstructionisreallynecessarytoadjust

urbangreenline,shall,inaccordancewiththelawofthePeople'sRepublicofChinaonurbanplanningactandtherelevantprovisionsofthejilincityplanningordinance.

Article13thecityafforestingtreesandshrubs,evergreentreesanddeciduoustrees,treesandplants;Thecombinationofplanarafforestationandverticalafforestation.Thegardenbuildingandotherfacilitiesshallbereasonablyconstructedandreasonablyconstructed.

Article14thestateorgans,organizations,schools,units,enterprisesandinstitutionsshall,inaccordancewiththeformulationofthisunitaffiliatedgreenspaceplanning,design,andisresponsiblefortheconstructionandmanagement,andshallnotbeusedforotherpurposeswithoutauthorization.Wheretherearemorethan500squaremetersofthegreenspace,thegreenplanningshallbereportedtothemunicipalgreenadministrativedepartmentofthedistrictfortherecord.

Unitsandindividualsshallmakeuseofthevacantlandandscatteredlandintheunitorindividualyardtoplanttrees,plantgrassandplantflowers.Wewillpromoteverticalafforestationofspacedevelopment.

Article15theproportionofthetotalareaoflandusedfortheprojectofnewprojectsshallbecarriedoutinaccordancewiththefollowingprovisions:

（1）thedevelopmentofresidentialareasshallnotbelessthan30percent,andthereconstructionoftheoldtownshallnotbelessthan25percent;

（2）thehospitalisnotlessthan45%;

（3）theunitsthatproducepoisonousandharmfulgasesarenotlessthan40%;

（4）theinstitutionsofhigherlearningarenotlessthan40%;

（5）largepublicbuildings,suchashotels,restaurantsandsportsvenues,arenotlessthan30%;

（6）largeandmedium-sizedcommercialandservicefacilitiesinurbancommercialareasshallnotbelessthan20%;

（7）urbanhighwaysarenotlessthan25percent;

Otherconstructionprojectsshallnotbelessthan25%.

Article16theafforestinglandforconstructionproject

areaisnotuptothestandardofthearticle15oftheseregulations,andisreallynecessary,theconstruction

shallbeconductedinasimilarlocationchangeofgreening,changeofgreening,notaccordingtostipulations,inaccordancewiththelackofgreenlandareatotheadministrativedepartmentofcitylandscapingpaycompensationforurbanchangeofgreening.

Citywongreenonlydoorstore,compensationshallbesubmittedtothemunicipalfinancialspecialfundisspecial,bytheadministrativedepartmentofcityafforestationinaccordancewiththeunifiedarrangementforurbanplanningurbangreeningconstruction.

Article17thecostofafforestingconstructionprojectsshallbebornebythe
