Contractors'AllRisksInsurance

WhereastheInsurednamedintheScheduleheretohasmadetoACEInsuranceLimited（hereinaftercalled“theInsurers”a）writtenproposalbycompletingaQuestionnairewhichtogetherwithanyotherstatementsmadeinwritingbytheInsuredforthepurposeofthisPolicyisdeemedtobeincorporatedherein.

NowthisPolicyofInsurancewitnessesthatsubjecttotheInsuredhavingpaidtotheInsurersthepremiummentionedintheScheduleandsubjecttotheterms,exclusions,provisionsandconditionscontainedhereinorendorsedhereontheInsurerswillindemnifytheInsuredinthemannerandtotheextenthereinafterprovided.

GeneralExclusions

TheInsurerswillnotindemnifytheInsuredinrespectofloss,damageorliabilitydirectlyorindirectlycausedbyorarisingoutoforaggravatedby

（a）war,invasion,actofforeignenemy,hostilities（whetherwarbedeclaredornot）,civilwar,rebellionrevolution,insurrection,mutiny,riot,strike,lock-out,civilcommotion,militaryorusurpedpower,agroupofmaliciouspersonorpersonsactingonbehalfoforinconnectionwithanypoliticalorganization,conspiracy,confiscation,commandeering,requisitionordestructionordamagebyorderofanygovernmentdejureordefactoorbyanypublicauthority;

（b）nuclearreaction,nuclearradiationorradioactivecontamination;

（c）wilfulactorwilfulnegligenceoftheInsuredorofhisrepresentatives;

（d）cessationofworkwhethertotalorpartial.

Inanyaction,suitorotherproceedingwheretheInsurersallegethatbyreason

oftheprovisionsofExclusiona）aboveanyloss,destruction,damageorliabilityisnotcoveredbythisinsurancetheburdenofprovingthatsuchloss,destruction,damageorliabilityiscoveredshallbeupontheInsured.

PeriodofCover

TheliabilityoftheInsurersshallcommencenotwithstandinganydatetothecontraryspecifiedintheSchedule,directlyuponcommencementofworkoraftertheunloadingofthetermsenteredintheScheduleatthesite.TheInsurers'liabilityexpiresforpartsoftheInsuredcontractworkstakenoverorputintoservice.Atthelatestthe

insuranceshallexpireonthedatespecifiedintheSchedule.Anyextensionsofthe

PeriodofInsurancearesubjecttothepriorwrittenconsentoftheInsurers.

GeneralConditions

1.ThedueobservanceandfulfillmentofthetermsofthisPolicyinsofarasthey

relatetoanythingtobedoneorcompliedwithbytheInsuredandthetruthofthestatementsandanswersinthequestionnaireandproposalmadebytheInsuredshallbeaconditionprecedenttoanyliabilityoftheInsurers.

2.TheScheduleandtheSections（s）shallbedeemedtobeincorporatedinand

formpartofthisPolicyandtheexpression“thisPolicy”whereverusedinthis

contractshallbereadasincludingtheScheduleandtheSection（s）.Anyword

orexpressiontowhichaspecificmeaninghasbeenattachedinanypartofthisPolicyoroftheScheduleoroftheSection（s）shallbearsuchmeaningwhereveritmayappear.

3.TheInsuredshallathisownexpensetakeallreasonableprecautionsandcomplywithallreasonablerecommendationsoftheInsurerstopreventloss,damageorliabilityandcomplywithstatutoryrequirementsandmanufacturersrecommendations.

4.a）RepresentativesoftheInsurersshallatanyreasonabletimehavetherighttoinspectandexaminetheriskandtheInsuredshallprovidetherepresentativesoftheInsurerswithalldetailsandinformationnecessaryfortheassessmentoftherisk.

b）TheInsuredshallimmediatelynotifytheInsurersbytelegramandinwritingofanymaterialchangeintheriskandcauseathisownexpensesuchadditionalprecautionstobetakenascircumstancesmayrequire,andthescopeofcoverand/orpremiumshall,ifnecessary,beadjustedaccordingly.

NomaterialalterationshallbemadeoradmittedbytheInsuredwherebytheriskisincreased,unlessthecontinuanceoftheinsuranceisconfirmedinwritingbytheInsurers.

5.IntheeventofanyoccurrencewhichmightgiverisetoaclaimunderthisPolicy,

theInsuredshall

a）immediatelynotifytheInsurersbytelephoneortelegramaswellasinwriting,givinganindicationastothenatureandextentoflossordamage;

b）takeallstepswithinhispowertominimizetheextentofthelossordamage;

c）preservethepartsaffectedandmakethemavailableforinspectionbyarepresentativeorsurveyoroftheInsurers;

d）furnishallsuchinformationanddocumentaryevidenceastheInsurersmayrequire;

e）informthepoliceauthoritiesincaseoflossordamageduetotheftorburglary.

TheInsurersshallnotinanycasebeliableforloss,damageorliabilityofwhichnonoticehasbeenreceivedbytheInsurerswithinfourteen（14）daysofitsoccurrence.

UponnotificationbeinggiventotheInsurersunderthiscondition,theInsuredmaycarryouttherepairsorreplacementofanyminordamage;inallothercasesarepresentativeoftheInsurersshallhavetheopportunityofinspectingthelossordamagebeforeanyrepairsoralterationsareeffected.IfarepresentativeoftheInsurersdoesnotcarryouttheinspectionwithinaperiodoftimewhichcouldbeconsideredadequateunderthecircumstances,theInsuredisentitledtoproceedwiththerepairsorreplacement.

TheliabilityoftheInsurersunderthisPolicyinrespectofanyitemsustainingdamageshallceaseifsaiditemisnotrepairedproperlywithoutdelay.

6.TheInsuredshallattheexpenseoftheInsurersdoandconcurindoingand

permittobedoneallsuchactsandthingsasmaybenecessaryorrequiredbytheInsurersintheinterestofanyrightsorremedies,orofobtainingrelieforindemnityfromparties（otherthanthoseinsuredunderthisPolicy）towhichtheInsurersareorwouldbecomeentitledorwhichisorwouldbesubrogatedtothemupontheirpayingforormakinggoodanylossordamageunderthisPolicy,whethersuchactsandthingsareorbecomenecessaryorrequiredbeforeoraftertheInsured'sindemnificationbhyetInsurers.

7.IfanydifferencearisesastotheamounttobepaidunderthisPolicy（liabilitybeingotherwiseadmitted）,suchdifferenceshallbereferredtothedecisionofanarbitratortobeappointedinwritingbythepartiesindifferenceor,iftheycannotagreeuponasinglearbitrator,tothedecisionoftwoarbitrators,onetobeappointedinwritingbyeachofthepartieswithinone

（1）calendarmonthafterhavingbeenrequiredinwritingsotodobyeitheroftheparties,or,incasethearbitratorsdonotagree,ofanumpiretobeappointedinwritingbythearbitratorsbeforethelatterenteruponthereference.Theumpireshallsit

withthearbitratorsandpresideattheirmeetings.ThemakingofanawardshallbeaconditionprecedenttoanyrightactionagainsttheInsurers.

8.Ifaclaimisinanyrespectfraudulent,orifanyfalsedeclarationismadeorusedinsupportthereof,orifanyfraudulentmeansordevicesareusedbytheInsuredoranyoneactingonhisbehalftoobtainanybenefitunderthisPolicy,orifaclaimismadeandrejectedandnoactionorsuitiscommencedwithinthree（3）monthsaftersuchrejectionor,inthecaseofarbitrationtakingplaceasprovidedherein,withinthree（3）monthsafterthearbitratororarbitratorsorumpirehavemadetheiraward,allbenefitunderthisPolicyshallbeforfeited.

9.IfatthetimeanyclaimarisesunderthePolicythereisanyotherinsurancecoveringthesameloss,damageorliability,theInsurersshallnotbeliabletopayorcontributemorethantheirrateableproportionofanyclaimforsuchloss,damageorliability.

SectionI-MaterialDamage

TheInsurersherebyagreewiththeInsuredthatifatanytimeduringtheperiodofcovertheitemsoranypartthereofenteredintheScheduleshallsufferanyunforeseenandsuddenphysicallossordamagefromanycause,otherthanthosespecificallyexcluded,inamannernecessitatingrepairorreplacement,theInsurerswillindemnifytheInsuredinrespectofsuchlossordamageashereinafterprovidedbypaymentincash,replacementorrepair（attheirownoption）uptoanamountnotexceedinginrespectofeachoftheitemsspecifiedintheSchedulethesumsetoppositetheretoandnotexceedinginanyoneeventthelimitofindemnitywhereapplicableandnotexceedinginallthetotalsumexpressedintheScheduleasinsuredhereby.

TheInsurerswillalsoreimbursetheInsuredforthecostofclearaneeofdebrisfollowinguponanyeventgivingrisetoaclaimunderthisPolicyprovidedaseparatesumthereforehasbeenenteredintheSchedule.

SpecialExclusionstoSectionI

TheInsurersshallnot,however,beliablefor

（a）thedeductiblestatedintheScheduletobebornebytheInsuredin

anyoneoccurrenee;

（b）consequentiallossofanykindordescriptionwhatsoeverincludingpenalties,lossesduetodelay,lackofperformanee,lossofcontract;

（c）lossordamageduetofaultydesign;

（d）thecostofreplacement,repairorrectificationofdefectivematerial

and/orworkmanship,butthisexclusionshallbelimitedtotheitems

immediatelyaffectedandshallnotbedeemedtoexcludelossofordamagetocorrectlyexecuteditemsresultingfromanaccidentdueto

suchdefectivematerialand/orworkmanship;

（e）wearandtear,corrosion,oxidation,deteriorationduetolackofuseandnormalatmosphericconditions;

（f）lossordamageduetoelectricalormechanicalbreakdown,failure,

breakageorderangement,freezingofcoolantorotherfluid,defective

lubricationorlackofoilorcoolant,butifasaconsequeneeofsuch

breakdownorderangementanaccidentoccurscausingexternaldamage,

suchconsequentialdamageshallbeindemnifiable;
