（b）cosmetic,device,drugorfoodwithinthemeaningoftheFoodandDrugsAct;
（c）pestcontrolproductasdefinedinsubsection2
（1）ofthePestControlProductsAct;
or
（d）nuclearsubstance,withinthemeaningoftheNuclearSafetyandControlAct,thatisradioactive.
（2）ThisPartdoesnotapplytotheadvertising,saleorimportationofatobaccoproductasdefinedinsection2oftheTobaccoActortheadvertisingoflightersormatchesthatdisplayatobaccoproduct-relatedbrandelement,excepttotheextentthatacigarettedescribedinitem41ofPartIofScheduleIisaprohibitedproduct.

（a）theMinistershallprepareareport;

and

5.TheGovernorinCouncilmaymakeregulations
（a）authorizingtheadvertising,saleorimportationofanyrestrictedproductandprescribingthecircumstancesandconditionsunderwhichandthepersonsbywhomtherestrictedproductmaybeadvertised,soldorimported;
（b）prescribingtheprocedurestobefollowedbyaboardofreviewestablishedpursuanttosection9inconductinganinquiry;
（b.1）prescribingthemethodandflammabilitystandardtobeusedtotestcigarettes;
（c）generallyforcarryingoutthepurposesandprovisionsofthisPart.

5.1
（1）TheMinistermaymakeaninterimorderthatcontainsanyprovisionthatmaybecontainedinaregulationmadeunderthisPartiftheMinisterbelievesthatimmediateactionisrequiredtodealwithasignificantrisk,directorindirect,tohealthorsafety.
Interimorders—section6
（2）TheMinistermaymakeaninterimorderinwhichanypowerreferredtoinsection6isdeemedtobeexercised,iftheMinisterbelievesthatimmediateactionisrequiredtodealwithasignificantrisk,directorindirect,tohealthorsafety.
Cessationofeffect
（3）Aninterimorderhaseffectfromthetimethatitismadebutceasestohaveeffectontheearliestof
（a）14daysafteritismade,unlessitisapprovedbytheGovernorinCouncil,
（b）thedayonwhichitisrepealed,
（c）inthecaseofaninterimordermadeundersubsection
（1）,thedayonwhicharegulationmadeunderthisPartthathasthesameeffectastheinterimordercomesintoforceand,inthecaseofaninterimordermadeundersubsection
（2）,thedayonwhichanordermadebytheGovernorinCouncilunderthisPartthathasthesameeffectastheinterimordercomesintoforce,and
（d）oneyearaftertheinterimorderismadeoranyshorterperiodthatmaybespecifiedintheinterimorder.
Contraventionofunpublishedorder
（4）Nopersonshallbeconvictedofanoffenceconsistingofacontraventionofaninterimorderthat,atthetimeoftheallegedcontravention,hadnotbeenpublishedintheCanadaGazetteunlessitisprovedthat,atthetimeoftheallegedcontravention,thepersonhadbeennotifiedoftheinterimorderorreasonablestepshadbeentakentobringthepurportoftheinterimordertothenoticeofthosepersonslikelytobeaffectedbyit.
ExemptionfromStatutoryInstrumentsAct
（5）Aninterimorder
（a）isexemptfromtheapplicationofsections3,5and11oftheStatutoryInstrumentsAct;
（b）shallbepublishedintheCanadaGazettewithin23daysafteritismade.

（6）ForthepurposeofanyprovisionofthisPartotherthanthissection,anyreferencetoregulationsmadeunderthisActisdeemedtoincludeinterimorders,andanyreferencetoaregulationmadeunderaspecifiedprovisionofthisActisdeemedtoincludeareferencetotheportionofaninterimordercontaininganyprovisionthatmaybecontainedinaregulationmadeunderthespecifiedprovision.

（1）TheGovernorinCouncilmay,byorder,amendPartIorIIofScheduleIbyaddingthereto
（a）anyproduct,materialorsubstancethatisorcontainsapoisonous,toxic,flammable,explosive,corrosive,infectious,oxidizingorreactiveproduct,materialorsubstanceorotherproduct,materialorsubstanceofasimilarnaturethattheGovernorinCouncilissatisfiedisorislikelytobeadangertothehealthorsafetyofthepublic;
（b）anyproductdesignedforhousehold,gardenorpersonaluse,foruseinsportsorrecreationalactivities,aslife-savingequipmentorasatoy,playthingorequipmentforusebychildrenthattheGovernorinCouncilissatisfiedisorislikelytobeadangertothehealthorsafetyofthepublicbyreasonofitsdesign,constructionorcontents.

（2）TheGovernorinCouncilmay,byorder,amendPartIorIIofScheduleIbydeletingtherefromanyproduct,materialorsubstanceiftheGovernorinCouncilissatisfiedthattheinclusionoftheproduct,materialorsubstanceinthatPartisnolongernecessary.
