(a)explosivewithinthemeaningoftheExplosivesAct;
(b)cosmetic,device,drugorfoodwithinthemeaningoftheFoodandDrugsAct;
(c)pestcontrolproductasdefinedinsubsection2
(1)ofthePestControlProductsAct;
or
(d)nuclearsubstance,withinthemeaningoftheNuclearSafetyandControlAct,thatisradioactive.
(2)ThisPartdoesnotapplytotheadvertising,saleorimportationofatobaccoproductasdefinedinsection2oftheTobaccoActortheadvertisingoflightersormatchesthatdisplayatobaccoproduct-relatedbrandelement,excepttotheextentthatacigarettedescribedinitem41ofPartIofScheduleIisaprohibitedproduct.

(3)IftheGovernorinCouncildoesnotmakearegulationunderparagraph5(b.1)onorbeforeJune30,2004,
(a)theMinistershallprepareareport;
(b)theMinistershallcauseacopyofthereporttobetabledineachHouseofParliamentonanyofthefirsttendaysonwhichthatHouseissittingafterJune30,2004;
and
(c)eachHouseshallreferthereporttotheappropriateCommitteeofthatHouse.

5.TheGovernorinCouncilmaymakeregulations
(a)authorizingtheadvertising,saleorimportationofanyrestrictedproductandprescribingthecircumstancesandconditionsunderwhichandthepersonsbywhomtherestrictedproductmaybeadvertised,soldorimported;
(b)prescribingtheprocedurestobefollowedbyaboardofreviewestablishedpursuanttosection9inconductinganinquiry;
(b.1)prescribingthemethodandflammabilitystandardtobeusedtotestcigarettes;
(c)generallyforcarryingoutthepurposesandprovisionsofthisPart.

Interimorders—regulations
5.1
(1)TheMinistermaymakeaninterimorderthatcontainsanyprovisionthatmaybecontainedinaregulationmadeunderthisPartiftheMinisterbelievesthatimmediateactionisrequiredtodealwithasignificantrisk,directorindirect,tohealthorsafety.
Interimorders—section6
(2)TheMinistermaymakeaninterimorderinwhichanypowerreferredtoinsection6isdeemedtobeexercised,iftheMinisterbelievesthatimmediateactionisrequiredtodealwithasignificantrisk,directorindirect,tohealthorsafety.
Cessationofeffect
(3)Aninterimorderhaseffectfromthetimethatitismadebutceasestohaveeffectontheearliestof
(a)14daysafteritismade,unlessitisapprovedbytheGovernorinCouncil,
(b)thedayonwhichitisrepealed,
(c)inthecaseofaninterimordermadeundersubsection
(1),thedayonwhicharegulationmadeunderthisPartthathasthesameeffectastheinterimordercomesintoforceand,inthecaseofaninterimordermadeundersubsection
(2),thedayonwhichanordermadebytheGovernorinCouncilunderthisPartthathasthesameeffectastheinterimordercomesintoforce,and
(d)oneyearaftertheinterimorderismadeoranyshorterperiodthatmaybespecifiedintheinterimorder.
Contraventionofunpublishedorder
(4)Nopersonshallbeconvictedofanoffenceconsistingofacontraventionofaninterimorderthat,atthetimeoftheallegedcontravention,hadnotbeenpublishedintheCanadaGazetteunlessitisprovedthat,atthetimeoftheallegedcontravention,thepersonhadbeennotifiedoftheinterimorderorreasonablestepshadbeentakentobringthepurportoftheinterimordertothenoticeofthosepersonslikelytobeaffectedbyit.
ExemptionfromStatutoryInstrumentsAct
(5)Aninterimorder
(a)isexemptfromtheapplicationofsections3,5and11oftheStatutoryInstrumentsAct;
(b)shallbepublishedintheCanadaGazettewithin23daysafteritismade.

(6)ForthepurposeofanyprovisionofthisPartotherthanthissection,anyreferencetoregulationsmadeunderthisActisdeemedtoincludeinterimorders,andanyreferencetoaregulationmadeunderaspecifiedprovisionofthisActisdeemedtoincludeareferencetotheportionofaninterimordercontaininganyprovisionthatmaybecontainedinaregulationmadeunderthespecifiedprovision.

(1)TheGovernorinCouncilmay,byorder,amendPartIorIIofScheduleIbyaddingthereto
(a)anyproduct,materialorsubstancethatisorcontainsapoisonous,toxic,flammable,explosive,corrosive,infectious,oxidizingorreactiveproduct,materialorsubstanceorotherproduct,materialorsubstanceofasimilarnaturethattheGovernorinCouncilissatisfiedisorislikelytobeadangertothehealthorsafetyofthepublic;
(b)anyproductdesignedforhousehold,gardenorpersonaluse,foruseinsportsorrecreationalactivities,aslife-savingequipmentorasatoy,playthingorequipmentforusebychildrenthattheGovernorinCouncilissatisfiedisorislikelytobeadangertothehealthorsafetyofthepublicbyreasonofitsdesign,constructionorcontents.

(2)TheGovernorinCouncilmay,byorder,amendPartIorIIofScheduleIbydeletingtherefromanyproduct,materialorsubstanceiftheGovernorinCouncilissatisfiedthattheinclusionoftheproduct,materialorsubstanceinthatPartisnolongernecessary.
