Measuresfortheadministrationofurbanhousinglease
Themeasuresfortheadministrationofurbanhouselease,adoptedon1995Aprilatthefifthexecutivemeetingofthetwenty-eightthday,areherebypromulgatedandshallcomeintoforceasofJune1,1995.

Generalprovisions
Article1ThesemeasuresareformulatedinaccordancewiththelawofthePeople'sRepublicofChinaontheadministrationofurbanrealestateinordertostrengthenthemanagementofleaseofurbanhouses,safeguardtheorderoftherealestatemarketandsafeguardthelawfulrightsandinterestsofthepartiesconcernedintheleaseofhouses.
SecondoftheseMeasuresshallbeapplicabletothemunicipalities,cityandtownshousingrental.
Thesethirdmeasuresshallbeobservedinthecasethattheownerofthehouserentsthehousetothelessee,orprovidesittootherpeopleforbusinessactivitiesandengagesinbusinessactivitieswithotherpeopleincooperation.
ThelesseemaysublettheleasedpremisesinaccordancewiththepresentMeasuresupontheconsentofthelessor.
Fourthcitizens,legalpersonsorotherorganizationsmayrentthehousesentitledtoownershipandthehousesauthorizedbythestatetomanageandoperatethem.
Fifthhousingrentalpartiesshouldfollowtheprincipleofvoluntariness,equalityandmutualbenefit.
Sixthhousesunderanyofthefollowingcircumstancesshallnotbeleased:
(1)failingtoobtainalltheownershipofthehouseinaccordancewiththelaw;
(two)thejudicialorgansandadministrativeorganshavedecidedordecidedtosealuporotherwiserestricttherightofhousinginaccordancewiththelaw;
(three)thecommonhousinghasnotbeenagreedbytheCOowner;
(four)theownershipisdisputed;
(five)itbelongstoillegalconstruction;
(six)notinconformitywithsafetystandards;
(seven)havingbeenmortgagedwithouttheconsentofthemortgagor;
(eight)itdoesnotmeettherelevantprovisionsofthecompetentdepartmentsofpublicsecurity,environmentalprotectionandpublichealth;
(nine)othercircumstancesrelatedtotheprohibitionofrentbylawsorregulations.
Seventhresidentialhousinglease,shouldbeimplementedinthecountry'shousingcity,thecitygovernment'sleasepolicy.
Whereahouseisengagedinproductionorbusinessactivities,theleaseandotherleasetermsshallbenegotiatedandagreeduponbythetwosidesofthelease.
EighthconstructionadministrativedepartmentsundertheStateCouncilisresponsibleforthemanagementofUrbanHousingleasingthroughoutthecountry.
TheadministrativedepartmentforconstructionofprovincesandautonomousregionsshallberesponsiblefortheadministrationofUrbanHousingleasingwithintheirrespectiveadministrativeareas.
Therealestateadministrativedepartmentofthepeople'sGovernmentofthemunicipalitydirectlyunderthecentralgovernmentandthepeople'sGovernmentofthecounty(hereinafterreferredtoastherealestatemanagementdepartment)shallberesponsiblefortheadministrationoftheurbanhousingleasewithintheadministrativearea.
Leasecontract
Ninthhousinglease,thepartiesshouldsignawrittenleasecontract,leasecontractshouldhavethefollowingtermsandconditions;
(1)thenameanddomicileofthepartyconcerned;
(two)thelocation,size,decorationandfacilitiesofthehouse;
(three)leasingpurposes;
(four)leaseterm;
(five)rentandmethodofdelivery;
(six)housingrepairresponsibility;
(seven)subleaseagreement;
(eight)conditionsformodificationandterminationofthecontract;
(nine)liabilityforbreachofcontract;
(ten)othertermsagreeduponbytheparties.
Theleasecontractexpiresattheendofthetenthhouselease.Wherethelesseeneedstocontinuethelease,itshallsubmitit3monthsbeforetheexpirationoftheleaseterm,andshallresigntheleasecontractwiththeconsentofthelessor.
Eleventhrentalperiod,thehousinglessorstransferhousingownership,housingassigneeshouldcontinuetofulfilltheoriginalleasecontract.
Wherethelessordieswithinthetermofthelease,hissuccessorshallcontinuetoperformtheoriginalleasecontract
Wherethelesseeofaresidentialhousedieswithintheleaseterm,thefamilymemberswhohavelivedtogetherformorethantwoyearsmaycontinuetorentit.
Articletwelfthunderanyofthefollowingcircumstances,thepartiestothehousingleasemaychangeorterminatetheleasecontract:
(1)inaccordancewiththeprovisionsofthelaworthecontract,maychangeorrescindthetermsofthecontract;
(two)theleasecontractcannotbecontinuedbecauseofforcemajeure;
(three)thepartiesconcernedagreethroughconsultation.
Ifapartyconcernedsufferslossesduetothealterationorrescissionoftheleasecontract,theresponsiblepartyshallberesponsibleforthecompensationinadditiontotheexemptionaccordingtolaw.
Leaseregistration
Thirteenthhousingrentalregistrationsystem.
Tosign,alterorterminatealeasecontract,thepartyconcernedshallregisterwiththerealestatemanagementdepartmentofthepeople'sGovernmentoftheplacewherethehouseislocated,themunicipalitydirectlyunderthecentralgovernment,themunicipalityorthecountywherethepeople'sgovernmentislocated.
Articlefourteenththepartiesshallintherentalhousingleasecontractsignedwithin30daysaftertheholdingofrealestatemanagementregulationsfifteenthofthefiletothemunicipality,cityandCountyPeople'sgovernmenttohandletheregistrationformalities.
Articlefifteenthforhousingrentalregistration,thefollowingdocumentsshouldbesubmitted:
(I)writtenleasecontract;
(two)housingownershipcertificate;
(three)legaldocumentsofthepartiesconcerned;
(four)otherdocumentsasprescribedbytheMunicipalPeople'sgovernment.
Ifahouseisleased,itshallalsosubmitproofthattheotherco-owneragreestorentit.
Rentalhousingentrustedescrow,butalsotoentrusttheescrowtoauthorizetherentalofproof.
Sixteenthhousingrentalapplicationsbythemunicipalities,municipalities,countypeople'sgovernmentrealestatemanagementreview,issuedthe"housingleasecertificate.".
Outsidethecountypeople'sgovernmentislocatedinthetownsofthehousingrentalapplicationcanbemadebythepeople'sGovernmentofthemunicipality,cityandcountyrealestatemanagementdepartmentcommissionedagencyreview,andissued"housingrentalpermits".
Theseventeenth"housingleasecertificate"isavalidandvalidleasecertificate.Ifahouseisengagedinproductionorbusinessactivities,theleasecertificateofthehouseshallbethelawfulvoucherfortheplaceofoperation.Rentalhousingforhousing,"housingrentalcertificate"canbeusedasoneofthepublicsecuritydepartmentstoregisteroneofthevouchers.
Eighteenthitisstrictlyprohibitedtoforge,alter,lend,transferthe"rentalhousingpermit.Ifthehouseleasecertificateislost,itshallapplytotheoriginallicenseissuingorganforreissue.
Rightsandobligationsoftheparties
Nineteenthrentalhousingrentalpartiesinaccordancewiththeleasecontract,enjoytherightsandassumecorrespondingobligations.
Wherethelessorreallyneedstowithdrawthehouseinadvancewithinthetermofthelease,thelesseeshallagreewiththelesseeinadvance,andthelesseeshallbecompensatedforanylosscausedbythelessee.
Twentiethlessorsshouldbeinaccordancewiththeleasecontractperiodofthehousingdeliverytenant,andcannotbedeliveredontime,shouldpaybreachofcontractdamages,thelossofthelessee,shouldbeartheresponsibilitytopaycompensation.
Twenty-firstrentalhousingfornaturaldamageorcontractagreedtobythelessorrepair,thelessorisresponsibleforrepair.Ifahousefailstoberepairedintime,causingadestructiveaccidentinthehouse,causingpropertydamageorpersonalinjurytothelessee,itshallbeliableforcompensation.
Iftheleasedhouseisengagedinproductionorbusinessactivities,theresponsibilityforrepairshallbeagreeduponbybothpartiesintheleasecontract.
Twenty-secondlesseemustpayrentonschedule,breachofcontract,shouldpayliquidateddamages.
Twenty-thirdlesseeshouldbeprotectedandreasonableuseoftheleasedpremisesandancillaryfacilities,shallnotbeallowedtodismantle,expandorincrease.Whereitisnecessarytomakechanges,thelessorshallobtaintheconsentofthelessorandsignawrittencontract.
Wherethehouseisdamagedduetothefaultofthelessee,thelesseeshallberesponsiblefortherestorationorcompensation.
Wherethetwenty-fourthlesseecommitsanyofthefollowingacts,thelessorhastherighttoterminatethecontractandwithdrawthehouse,therebycausinglosses,andthelesseeshallcompensatethelesseefortheloss:
(1)sublettheleasedpremiseswithoutauthorization;
(two)willbeleasedhousingunauthorizedtransfer,loanorotherunauthorizeduseoftheexchange;
(three)alteroraltertheleasedpremiseswithoutauthorization;
(four)arrearsofrentformorethansixmonths;
(five)publichousingforidlereasonsidleformorethansixmonths;
(six)rentingorrentingahouseforillegalactivities;
