反补贴条例(英文版)
CountervailingRegulationofThePeople’sRepublicofChina

TheCountervailingRegulationofthePeople’’sRepublicofChina,whichwasadoptedatthe46thexecutivemeetingoftheStateCouncilonOctober31,2001,isherebypromulgated,andshallenterintoforceonJanuary1,2002.

ChapterIGeneralProvisions
Article1
ThepresentRegulationhasbeenenactedinaccordancewiththerelevantprovisionsintheForeignTradeLawofthePeople’’sRepublicofChinawithaviewtomaintainingforeigntradeorderandfaircompetition.
Article2
Incasethatimportedproductsaresubsidizedandcausematerialdamageorconstituteathreatofmaterialdamagetoanalreadyestablisheddomesticindustry,orcauseamaterialimpedimenttotheestablishmentofadomesticindustry,aninvestigationshallbeconductedandcountervailingmeasuresshallbetakeninaccordancewiththepresentRegulation.
ChapterIISubsidyandDamage
Article3
Theterm"subsidy"shallrefertothefinancialcontributionoranyformofincomeorpricesupportwhichisconferredbythegovernmentoranypublicbodyoftheexportingcountry(region)andwhichbringsabenefittothereceiver.
Thegovernmentoranypublicbodyoftheexportingcountry(region)ishereinafteruniformlyreferredtoasthegovernmentoftheexportingcountry(region).
Theterm"financialcontribution"asmentionedinParagraph1ofthisArticleshallincludethefollowing:
(1)directprovisionbythegovernmentoftheexportingcountry(region)offundsintheformsofallocationsofmoney,loans,capitalcontribution,etc.,orpotentialdirecttransferbysuchgovernmentoffundsordebtsintheformsofloanguarantees,etc.;
(2)waiveroforfailuretocollectbythegovernmentoftheexportingcountry(region)theincomereceivable;
(3)provisionbythegovernmentoftheexportingcountry(region)ofgoodsorservicesotherthangeneralinfrastructure,orpurchasebythegovernmentoftheexportingcountry(region)ofgoods;
(4)paymentsmadebythegovernmentoftheexportingcountry(region)toafundingmechanism,orcarryoutoftheabovesaidfunctionsbyentrustingordirectingaprivatebody.
Article4
ThesubsidyagainstwhichtheinvestigationisconductedandthecountervailingmeasurestakeninaccordancewiththepresentRegulationmusthavethecharacteristicofspecialorientation.
Subsidiesunderanyofthefollowingcircumstancesshallbedeemedtohavethecharacteristicofspecialorientation:
(1)subsidiesobtainedbysomeenterprisesorindustrieswhichareclearlydeterminedbythegovernmentoftheexportingcountry(region);
(2)subsidiesobtainedbysomeenterprisesorindustrieswhichareclearlyprovidedinthelawsorregulationsoftheexportingcountry(region);
(3)subsidiesobtainedbytheenterprisesorindustrieswithinsomespecifiedareas;
(4)subsidiesobtainedontheconditionofexportachievements,includingallitemsofsubsidiesenumeratedintheillustrativelistofexportsubsidiesattachedinthepresentRegulation;
(5)subsidiesobtainedontheconditionthattheproductsofacountry(region)areusedtosubstitutethoseimportedtothiscountry(region).
Whenthecharacteristicofspecialorientationofthesubsidyisdetermined,suchfactorsasthenumberofenterprisessubsidized,theamount,proportion,durationandmeans,etc.ofthesubsidygrantedtotheenterprisesshallalsobeconsidered.
Article5
TheMinistryofForeignTradeandEconomicCooperation(hereinafterreferredtoastheMOFTEC)shallberesponsiblefortheinvestigationonanddeterminationofsubsidy.
Article6
Theamountofsubsidyforimportedproductsshallbecalculatedinthefollowingmethodswithdifferentcircumstancesbeingdistinguished:
(1)wherethesubsidyisgrantedintheformofgratuitousallocationofmoney,theamountofsubsidyshallbecalculatedonthebasisoftheamountactuallyreceivedbytheenterprises;
(2)wherethesubsidyisgrantedintheformofaloan,theamountofsubsidyshallbecalculatedonthebasisofthedifferencebetweentheinteresttobepaidbytheenterprisereceivingtheloanundertheconditionofnormalcommercialloanandtheinterestofthesaidloan;
(3)wherethesubsidyisgrantedintheformofaloanguarantee,theamountofsubsidyshallbecalculatedonthebasisofthedifferencebetweentheinteresttobepaidbytheenterpriseifnotbeingguaranteedandthattobepaidbytheenterpriseifbeingguaranteed;
(4)wherethesubsidyisgrantedintheformofacontributedcapital,theamountofsubsidyshallbecalculatedonthebasisofthecapitalamountactuallyreceivedbytheenterprise;
(5)wherethesubsidyisgrantedintheformofprovisionofgoodsorservices,theamountofsubsidyshallbecalculatedonthebasisofthedifferencebetweenthenormalmarketpriceofthegoodsorservicesandthepriceactuallypaidbytheenterprise;
(6)wherethesubsidyisgrantedintheformofpurchasinggoods,theamountofsubsidyshallbecalculatedonthebasisofthedifferencebetweenthepriceactuallypaidbythegovernmentandthenormalmarketpriceofthegoods;
(7)wherethesubsidyisgrantedintheformofwaiveroforfailuretocollecttheincomereceivable,theamountofsubsidyshallbecalculatedonthebasisofthedifferencebetweentheamounttobepaidinaccordancewiththelawandthatactuallypaidbytheenterprise.
Forthesubsidiesotherthanthoseenumeratedintheprecedingparagraph,theamountofsubsidyshallbedeterminedinafairandreasonablemethod.
Article7
Theterm"damage"shallrefertothefactthatsubsidyhascausedmaterialdamageorconstituteathreatofmaterialdamagetoanalreadyestablisheddomesticindustryorhascausedamaterialimpedimenttotheestablishmentofadomesticindustry.
TheStateEconomicandTradeCommission(hereinafterreferredtoastheSETC)shallberesponsiblefortheinvestigationonanddeterminationofdamage;whilethecountervailinginvestigationonthedamagetoadomesticindustryinvolvingagriculturalproductsshallbeconductedbytheSETCincollaborationwiththeMinistryofAgriculture.
Article8
Whendeterminingthedamagecausedtoadomesticindustrybysubsidy,thefollowingitemsshallbeexamined:
(1)theimpactofthesubsidywhichmaybecausedtothetrade;
(2)thequantityofthesubsidizedimports,inclusiveoftheabsolutequantityofthesubsidizedimportsorthemassiveornon-massiveincreaseofthequantityascomparedwiththemanufactureorconsumptionofthedomesticproductsofthesamecategory,orthepossibilityofthemassiveincreaseofthesubsidizedimports;
(3)thepriceofthesubsidizedimports,inclusiveofthepricecutsofthesubsidizedimportsortheimpactssuchasgreatrestraintorreduction,etc.tothepriceofthedomesticproductsofthesamecategory;
(4)theimpactsofthesubsidizedimportsupontherelevanteconomicfactorsandtargetsofthedomesticindustry;
(5)themanufacturingcapacity,exportcapabilityoftheexportingcountry(region)andthecountry(region)oforiginonthesubsidizedimportsaswellastheinventoryoftheproductsunderinvestigation;
(6)otherfactorswhichcausedamagetothedomesticindustry.
Thethreatofmaterialdamageshallbedeterminedonthebasisofthefactsinsteadofonlyoneoftheaccusation,presumptionandminorpossibility.Thedamagecausedbysubsidytoadomesticindustryshallbedeterminedonthebasisofaffirmativeevidence,andnofactorothersubsidywhichcausesdamageshallbeattributedtosubsidy.
Article9
Wherethesubsidizedimportscomefromtwoormorecountries(regions),andmeanwhilemeetthefollowingconditions,acumulativeevaluationmaybeconductedupontheimpactscausedbythesubsidizedimportstoadomesticindustry:
(1)theamountofsubsidytotheimportedgoodsfromeachcountry(region)shallnotbeaminimalsubsidy,andthevolumeofimportedproductsmaynotbenegligible;
(2)itispropertoconductacumulativeevaluationonthebasisofthecompetitionconditionsbetweenthesubsidizedimportsaswellasbetweenthesubsidizedimportsandthedomesticproductsofthesamecategory.
Theterm"minimalsubsidy"shallrefertoasubsidywithitsamounttobelessthan1%ofthevalueoftheproducts;however,aminimalsubsidyofthesubsidizedimportsfromadevelopingcountry(region)shallrefertothesubsidywithitsamounttobelessthan2%ofthevalueoftheproducts.
Article10
Theevaluatedimpactsonthesubsidizedimportsshallbeseparatelydeterminedwithregardtothemanufactureofthedomesticproductsofthesamecategory;wheretheymaynotbeseparatelydeterminedwithregardtothemanufactureofthedomesticproductsofthesamecategory,themanufactureofthenarrowestproductgrouporscopewhichincludestheproductsofthesamecategoryshallbeexamined.
Article11
Theterm"domesticindustry"shallrefertoallthemanufacturerswithinthePeople’’sRepublicofChinaofthedomesticproductsofthesamecategoryorthemanufacturerswithinthePeople’’sRepublicofChinawhosetotaloutputaccountsforthelargepartoftheaggregateoutputofthedomesticproductsofthesamecategory,exceptforanyofthosedomesticmanufacturerswhoisassociatedwithanexportoperatororimportoperator,orhehimselfisanimportoperatorofthesubsidizedproductsorproductsofthesamecategory.
Where,underparticularcircumstances,thedomesticmanufacturersinaregionalmarketsellthewholeornearlythewholeoftheproductsofthesamecategoryinthe
