5、emadeclearbyaddingexplicitwordingtothiseffectinthecontractofsale1.Thistermshouldnotbeusedwhenthebuyercannotcarryouttheexportformalitiesdirectlyorindirectly.Insuchcircumstances,theFCAtermshouldbeused,providedtheselleragreesthathewillloadathiscostandrisk.THESELLERSOBLIGATIONSTHEBUYERSOBLIGATIONS A1Pro

11、htimeastheyhavebeendeliveredinaccordancewithA4.B5Transferofrisksbuyermustbearallrisksoflossofordamagetothegoodsfromthetime,theyhavebeendeliveredinaccordancewithA4;andfromtheagreeddateortheexpirydateofanyperiodfixedfortakingdeliverywhicharisebecausehefailstogivenoticeinaccordancewithB7,provided,howev

12、er,thatthegoodshasbeendulyappropriatedtothecontract,thatistosay,clearlysetasideorotherwiseidentifiedasthecontractgoods.A6DivisionofcostsThesellermust,subjecttotheprovisionsofB6,payallcostsrelatingtothegoodsuntilsuchtimeastheyhavebeendeliveredinaccordancewithA4.B6DivisionofcostsThebuyermustpayallcost

13、srelatingtothegoodsfromthetimetheyhavebeendeliveredmaccordancewithA4;andanyadditionalcostsincurredbyfailingeithertotakedeliveryofthegoodswhentheyhavebeenplacedathisdisposal,ortogiveappropriatenoticeinaccordancewithB7provided,however,thatthegoodshavebeendulyappropriatedtothecontract,thatistosay,clear

14、lysetasideorotherwiseidentifiedasthecontractgoods;andwhereapplicable8,allduties,taxesandotherchargesaswellasthecostsofcanoutcustomsformalitiespayableuponexport.ThebuyermustreimburseallcostsandchargesincurredbythesellerinrenderingassistanceinaccordancewithA2.A7NoticetothebuyerThesellermustgivethebuye

18、adeknowntothesellerbeforethecontractofsaleisconcluded.Packagingistobemarkedappropriately.B9InspectionofgoodsThebuyermustpaythecostsofanypreshipmentinspection,includinginspectionmandatedbytheauthoritiesofthecountryofexport.A10OtherobligationsThesellermustrenderthebuyeratthelattersrequest,riskandexpen
