PartyAandPartyBherebyreachaconsensusafternegotiationtoenterintothiscontractorsafetyagreement（hereinafterreferredtoasthe"Agreement"）toensuresmoothprogressoftheprojects（e.g.engineeringconstruction/siteservices/internaltransportation,etc.,andforspecificprojectsandscopeofworks,thepurchaseagreement（hereinafterreferredtoasthe"PurchaseAgreement"）betweenthepartiesshallprevail）undertakenbythecontractorandtosafeguardthelifeandpropertiesofthepartiesandsatisfytherequirementsforenvironmentalprotection.IfPartyBisentitledtosubcontracttheworkscommissionedbyPartyAaccordingtotheprovisionsofPurchaseAgreement,thenthecontentshereofapplyequallytoitssubcontractorsandtheiremployees.Inthiscase,PartyBisobligedtoensureitssubcontractorsandtheiremployeescomplywiththisagreementandshallbeartheliabilitiestoPartyAforanybreachoftheagreementcommittedbyPartyB’ssubcontractorsandtheiremployees.
为保证乙方所承包项目（如工程施工/现场服务/内部运输等，具体承包项目及承包内容以甲、乙双方签署的采购协议（以下简称“采购协议”）为准）的顺利进行，确保甲、乙双方生命、财产安全以及满足环境保护的要求，经双方协商一致同意签订本承包商安全协议书（以下简称“协议书”）。
若根据采购协议的规定，乙方有权将甲方所委托工作进行转包，则本协议内容一并适用于其分包商及分包商的员工。
在此情况下，乙方有义务确保其分包商及分包商的员工遵守本协议，并应就其分包商及分包商的员工对本协议的违反向甲方承担违约责任。
1General
总则
1.1ThepersonnelofPartyBwhoareenteringintoPartyA'sfacilitiesforrelevantworksmuststrictlyabidebyallHSErulesandregulationsofPartyA.

乙方人员需要进入甲方进行相关工作时，必须严格遵守甲方的各项环境健康安全规章制度。
1.2PartyBmustprovideitsemployeesanditssubcontractorswithsafetyoperationtoolsandsufficientHSE-relatedfacilitiesandarticlessuchasproperPPEandcleandrinkingwater,etc.Itisstrictlyprohibitedtobringfoodsordrinkingwatertotheconstructionsite.
乙方必须为自己的员工以及分包商提供安全的作业工具、足够的环境健康安全相关设施及用品，如合适的劳动防护用品、清洁的饮用水等。
食品、饮用水严禁带入施工现场。
1.3AllpersonsofPartyBwhoaregoingtoprovideservicesofficiallymustbesubjecttotheHSEtrainingandassessmentorganizedbyPartyA,andonlyafterassessmentresultisacceptablecantheycommencetheirworks.TheHSEsafetyeducation,trainingandassessmentprovidedbyPartyAtothepersonnelofPartyBshallnotrelievePartyBfromitsobligationsandresponsibilitieshereunderorunderthePurchaseAgreement.PartyBshallnotifyPartyAofthecontentsandformofworksinadvance.
乙方所有人员在正式提供服务前，必须接受甲方安排的环境健康安全教育培训和考核，合格后方可开始作业。
甲方对乙方人员的环境健康安全教育培训和考核对乙方基于本协议或采购协议中应承担的义务和责任不构成任何影响。
乙方应就作业内容及形式事先通知甲方。
1.4PartyBshallsolelybearallexpensesincurredasaresultofanyaccidentorcasualtycausedbyPartyB’sviolationofHSErulesandregulationsofthegovernmentandtheHSErequirementsofPartyA,andPartyAisalsoentitledtofurtherclaimtheliabilitiesofPartyB.PartyBshallnotviolatetheHSErules®ulationsandHSErequirementsofPartyA/thegovernmentnomatterwithwhatsoeverexcuse.
乙方违反政府的环境健康安全规章制度和甲方环境健康安全要求而造成的任何事故或人员伤害，所发生的全部费用均由乙方自行承担，并且甲方有进一步追究责任的权力。
乙方不得以任何理由违反甲方/政府的环境健康安全规章制度和环境健康安全要求。
1.5PartyBmustprovidecooperationduringthesitesupervisionandinspectionconductedbyPartyAandshallacceptanypenaltyimposedagainstitduetoitsviolationoftheHSErulesofVestas.ThesitesupervisionandinspectionconductedbyPartyAwithrespecttoPartyBshallnotrelievePartyBfromitsobligationsandresponsibilitiesunderthisagreementorthePurchaseAgreement.
乙方必须接受甲方的现场监督检查，并接受由于违反维斯塔斯环境健康安全规定而导致的处罚。
甲方对乙方的现场监督检查对乙方基于本协议或采购协议中应承担的义务和责任不构成任何影响。
2Scopeofapplication
适用范围
Thisagreementappliestoanykindofworkfortheprojectundertakenbyinxxxxxxxxxxxxxxxxx.Asforspecificprojectsand3
scopeofworks,thePurchaseAgreementbetweenPartyAandPartyBshallprevail.
本协议适用于在xxxxxxxxxxxxx内承包所进行的任何形式的工作。
具体承包项目及承包内容应以甲、乙双方签署的采购协议为准。
3QualificationsofPartyB
乙方资质
PartyBshallpresentnecessarymaterialstoproveitscompliancewiththeHSErequirementsofthegovernment,includingbutnotlimitedto:
乙方应出示必要的资料以证明其符合政府的环境健康安全相关要求，应包括但不限于：
1）Permitsforconstruction/sales/operation/transportofhazardousgoods;
施工/销售/经营/危险品运输许可证；
2）HSEreferences;
环境健康安全安全业绩；
3）WorkpermitsandqualificationcertificatesofthoseundertakingspecialjobsandHSEpersonnelonsiteasrequiredbyChinesegovernment;
中国政府规定的特殊工种人员和现场环境健康安全人员上岗及资格证书；
4）Relevantqualificationcertificatesofthevehiclesusedforcarryinghazardousgoods;
危险物品运输车辆相关资质证明；
5）MSDSofhazardouschemicals,etc.
危险化学品MSDS等。
AllcorporatequalificationsshallmeetthecriteriaconfirmedbyPartyA.
所有企业资质应符合甲方所确认的条件。
4Mobilization&demobilization
进出场
4.1PartyBmustattendtheHSEtrainingandexamorganizedbyPartyApriortomobilizationandonlytheexamresultisacceptablecanitenterintothefacilitiesofPartyAforworks;specifichandlingformalitiesmaybeimplementedasperrequirementsofindividualfactory.
乙方进场工作前必须接受甲方的环境健康安全培训和考试，考试合格后才能进入甲方工作，具体办理流程可根据各工厂要求执行。
4.2TheoperatingpersonnelofPartyBmustwearworkcards,safetytrainingcertificatesandlaborprotectionarticleswhenevertheystayontheconstructionsite.ThepersonnelofPartyBshallnot,nomatterwithwhatsoeverexcuse,enterintotheareathatisnotrelatedtotheirworksorareaswhichtheyareunauthorizedtoenter.Iftemporaryaccesstoothernon-constructionareasbecomesnecessary,itmustbewiththepresenceoftheprojectleaderofPartyAinthewholeprocess.
乙方作业人员必须佩戴胸卡，安全培训合格证以及劳动防护用品进出施工现场。
乙4
方人员不得以任何理由进入与自己工作无关的区域或未经批准的区域。
在必须临时进入其他非施工区域时，须由甲方项目负责人全程陪同。
4.3Thevehicles,constructionmachines/toolsandmaterialstobebroughtinto/takenoutofthesitebyPartyBmustbeconfirmedandagreedbythedoorkeeperofPartyAbeforetheycanbebroughtinto/takenout;otherwise,noneoftheseshallbebroughtinto/takenoutofsite.
乙方进（出）场时需要带进（出）现场的车辆、施工器具、材料须经甲方门岗保安确认并同意后方可带进（出）场，否则不准带进（出）。
5ObligationsofPartyA
甲方的义务
5.1PartyAshallprovidePartyBwithitsHSE-relatedrulesandregulations,whilePartyBshallobtaintheHSElawsandregulationsenactedbythegovernmentandothervariousrelevantrulesbyitself.
甲方向乙方提供甲方的环境健康安全有关规章制度，政府相关的环境健康安全法律法规和各种规章制度由乙方自备。
5.2Ifnecessary,PartyAwillreviewtheHSEmanagementprogramsormeasuresestablishedbyPartyBinrelationtocontractedprojects/supplyofgoods,andthosefailingtomeettherequirementsofPartyAmustbemodifiedbeforePartyBispermittedtoaccessthesite.PartyA'sreviewontheHSEmanagementprogramsormeasuresofPartyBwillnotrelievePartyBfromanyofitsobligationsandresponsibilitiesunderthisagreementorthePurchaseAgreement.
必要时审核乙方制订与承包/供货项目相适应的环境健康安全管理方案或措施,不符合甲方要求时必须修改合格后方准予入场工作。
甲方对乙方的环境健康安全管理方案或措施的审核对乙方基于本协议或采购协议中应承担的义务和责任不构成任何影响。
6ObligationsofPartyB
乙方的义务
6.1TheworkingpersonnelofPartyBmustattendtheHSEeducation,trainingandexamorganizedbyPartyAandtheirHSE-relatedperformanceshallbesubjecttoperiodicandrandominspectionofPartyA.
乙方工作人员必须接受甲方组织的环境健康安全教育、培训和考试，并就乙方的环境健康安全相关表现接受甲方的定期和随机检查。
6.2PartyBshalldesignatededicatedpersonstotakechargeofHSEmanagementrelatingtoPartyAandprovidetheoperatorsofPartyBwithHSEtraining.
乙方指派专人负责与甲方相关的环境健康安全管理，并对乙方作业人员进行环境健康安全培训。
6.3PartyBshallprovidetheconstructionworkersonsitewithsafetyprotectionarticlesthatcomplywiththerequirementsofPartyA/thegovernmentonitsownaccount.ThespeciallaborprotectionarticlesandappliancesusedbyPartyBshallbecompleteandeffectiveandthemachinesandtoolsinuseshallmeet

regulatoryrequirements.TheemployeesoftheContractorshallbeprovidedwithandwearcustomizedworkinguniformsthatcarrythecompanynameorlogooftheContractor,andshallnotwearworkingclothesthatbearthelogoornameofxxxxx（excludingvest）orspeciallaborprotectionarticlesofxxxxx.
乙方自行向其进场施工人员提供符合甲方/政府要求的安全防护用品。
乙方所用的特种劳动防护用品、用具应齐全有效，机械、工具符合法规要求。
承包商员工应订制并穿着印有承包商公司名称或标志的工作服，不得穿戴印有xxxxx标志或名称的工作服（马甲除外），不得使用xxxxxx的特种劳动防护用品。
6.4PartyBmustabidebytheworkpermitsystemforhazardousoperationsofPartyA.Fordangerousoperations（e.g.hotwork,operationinconfinedspaceandoverheadoperation）,PartyBshallobtainworkpermitinadvanceanddispatchdedicatedpersonstoinspectthesiteandguardtheoperatorsonsite.
乙方必须遵守甲方的危险工作许可证制度。
对于较为危险的作业（如动火、进入受限空间、高处作业等），乙方应事先办理工作许可证，并应安排专人检查并进行现场监护。
6.5BeforebringanychemicaltothefactoryofPartyA,PartyBmustsubmitthematerialsafetydatasheet（MSDS）totheHSEdepartmentofPartyAforreviewandarchiving.Itisprohibitedtouseasbestos,PCBs,thefirstclassofchemicalsthatdestroyozonelayer,thechemicalsonblacklistofPartyAandotherchemicalsofwhichtheusehasnotbeenapprovedbyPartyA.
任何化学品进入甲方工厂前，乙方必须将材料安全数据说明书（MSDS）呈交甲方环境健康安全部门进行审核、备案。
不得使用石棉、多氯联苯、第一类破坏臭氧层物质的化学品，列入甲方黑名单中的化学品以及未经甲方批准使用的其他化学品。
6.6PartyBshallnotoccupyfirefightingroads,safetypassagesandexitswhenworkinginthefactoryofPartyA,andshallensurethecivilizedconstruction.
乙方在甲方厂内工作时不得占用消防道路和安全通道、出口，确保现场文明施工。
6.7ThepersonnelofPartyBworkinginthefactoryofPartyAmustdressneatlyandavoiddining,snacking,sleepingandotherundesiredbehaviors;smokingisonlypermittedindesignatedareasandspecifiedperiods,anddonotforgettosnuffoutthecigaretteresiduetopreventfire.Thesitemustbekeptclean,andthegarbageonsiteshallbestoredaspertypes.
乙方在甲方厂内工作时必须着装整齐，不得在现场用餐、吃零食、睡觉等，吸烟应在指定区域、指定时间内进行，吸烟完毕保证掐灭烟头，防止火灾发生。
并保证现场整洁，对现场垃圾实施分类存放制度。
6.8PartyBshallnotmakeconnectionsfortemporarywaterandpowersupplywithoutpermitinthefactoryofPartyA;itshallkeeptheequipmentintactandensurethefluidonsiteiswellprotectedfromrunning,overflowing,droppingandleaking.
乙方在甲方厂内工作时不得擅自搭接临时用水、用电，保持设备完好，确保现场无跑、冒、滴、漏现象。
