CHAPTER1:
GENERALPROVISIONS
Article1(Purpose)
ThepurposeofthisActistoservetocreatethecleanclimateofthecivilserviceandsocietybypreventingandregulatingtheactsofcorruptionefficiently.
Article2(Definitions)
ThetermsusedinthisActaredefinedasfollows:
1.Theterm"publicinstitutions"meansinstitutionsandorganizationsfallingunderanyofthefollowingitems:
(a)TheadministrativeagenciesofvariouslevelsundertheGovernmentOrganizationActandtheexecutiveorgansandlocalcouncilsoflocalgovernmentsundertheLocalAutonomyAct;
(b)TheSuperintendentsoftheOfficesofEducation,thedistrictofficesofeducation,andtheboardsofeducationundertheLocalEducationAutonomyAct;
(c)TheNationalAssemblyundertheNationalAssemblyAct,thecourtsofvariouslevelsundertheCourtOrganizationAct,theConstitutionalCourtundertheConstitutionalCourtAct,theelectioncommissionsofvariouslevelsundertheNationalElectionCommissionAct,andtheBoardofAuditandInspectionundertheBoardofAuditandInspectionAct;and
(d)OrganizationsrelatedtothepublicserviceunderArticle3
(1)10ofthePublicServiceEthicsAct;
2.Theterm"publicofficials"meansthepersonsfallingunderanyofthefollowingitems:
(a)ThepublicofficialsundertheStatePublicOfficialsActandtheLocalPublicOfficialsAct,andotherpersonswhoarerecognizedbyotherActsaspublicofficialsintermsofqualifications,appointments,educationandtraining,services,remunerations,statusguarantee,etc;and
(b)Theheadsoforganizationsrelatedtothecivilserviceprovidedforinsubparagraph1(d)aboveandtheemployeesofsuchorganizations;and
3.Theterm"actofcorruption"meanstheactfallingunderanyofthefollowingitems:
(a)Theactofanypublicofficial'sabusinghispositionorauthorityorviolatingActsandsubordinatestatutesinconnectionwithhisdutiestoseekgainsforhimselforanythirdparty;and
[*51](b)TheactofcausingdamagestothepropertyofanypublicinstitutioninviolationofActsandsubordinatestatutes,intheprocessofexecutingthebudgetoftherelevantpublicinstitution,acquiring,managing,ordisposingofthepropertyoftherelevantpublicinstitution,orenteringintoandexecutingacontracttowhichtherelevantpublicinstitutionisaparty.
Article3(ResponsibilitiesofPublicInstitutions)
(1)Everypublicinstitutionshallassumetheresponsibilitytostriveforthepreventionofcorruptiontocreatethesoundethicsofsociety.
(2)Intheeventthatanypublicinstitutiondeemsitnecessarytoeliminatelegal,institutional,oradministrativeinconsistenciesortoimproveothermattersforthepreventionofcorruption,itshallpromptlyimproveorrectifytheforegoing.
(3)Basedonsuchreasonablemeansaseducationandpublicity,everypublicinstitutionshallmakestrenuouseffortstoraisetheconsciousnessofitsemployeesandcitizenstostampoutcorruption.
(4)Everypublicinstitutionshallaggressivelyworktopromoteinternationalexchangesandcooperationforthepreventionofcorruption.
Article4(ResponsibilitiesofPoliticalParties)
(1)PoliticalpartiesthatareregisteredinaccordancewiththePoliticalPartiesActandmembersaffiliatedwithsuchpoliticalpartiesshallendeavortocreateacleanandtransparentcultureofpolitics.
(2)Politicalpartiesandmembersaffiliatedwithsuchpoliticalpartiesshallhaveapropercultureofelectiontakerootandshalloperatethemselvesandraiseandspendpoliticalfundsinatransparentmanner.
Article5(DutiesofPrivateEnterprises)
Privateenterprisesshallestablishasoundorderoftradeaswellasbusinessethicsandtakestepsnecessarytopreventeverycorruption.
Article6(DutiesofCitizens)
Everycitizenshallfullycooperatewithpublicinstitutionsinpolicystepstakenbythemtopreventcorruption.
Article7(ObligationofPublicOfficialstobeClean-Handed)
EverypublicofficialshallabidebyActsandsubordinatestatutes,performhisdutiesfairlyandhospitably,andrefrainfromcommittinganyactofcorruptinghimselforlosinghisdignity.
[*52]Article8(CodeofConductforPublicOfficials)
(1)ThecodeofconductthatthepublicofficialshavetoobserveinaccordancewithArticle7shallbeprescribedbythePresidentialDecree,theNationalAssemblyRegulations,theSupremeCourtRegulations,theConstitutionalCourtRegulations,ortheNationalElectionCommissionRegulations.
(2)Thecodeofconductforthepublicofficialsreferredtoinparagraph
(1)aboveshallprescribemattersfallingundereachofthefollowingsubparagraphs:
1.Mattersconcerningtheprohibitionandlimitationoftheactofanypublicofficial'sreceivingentertainment,money,goods,etc.fromanypersonrelatedtohisduties;
2.Mattersconcerningtheprohibitionandlimitationoftheactofanypublicofficial'sinterveninginpersonnelaffairsorconcessionsorusinghisgoodofficesorsolicitinganotherpersonforhisgoodoffices,takingadvantageofhisposition;
3.Matterstobeobservedbythepublicofficialstocreateasoundclimateofthecivilservice,includingfairpersonneladministration;and
4.Othermattersnecessarytopreventcorruptionandmaintaintheclean-handednessanddignityofthepublicofficialswhentheyperformtheirduties.
(3)Ifanypublicofficialviolatesthecodeofconductforthepublicofficialsreferredtoinparagraph
(1)above,adisciplinarymeasuremaybetakenagainsthim.
(4)Kindsof,proceduresfor,effect,etc.ofthedisciplinarymeasurereferredtoinparagraph(3)aboveshallbegovernedbyActsandsubordinatestatutesthatprescribemattersconcerningthedisciplinarymeasuresofadministrativeagenciestowhichtherelevantpublicofficialsbelong.
Article9(GuaranteeofLivelihoodforPublicOfficials)
TheStateandlocalgovernmentsshalllabortoguaranteethelivelihoodofthepublicofficialsinorderforthemtodevotethemselvestothecivilserviceandshalltakenecessarystepstoimprovetheirremunerationsandtreatments.
CHAPTER2:
ANTI-CORRUPTIONCOMMISSION
Article10(Establishment)
AnAnti-CorruptionCommission(hereinafterreferredtoasthe"Commission")shallbesetupunderthePresidenttorevampActsand[*53]subordinatestatutes,institutions,etc.andtoformulateandimplementpolicies--allnecessarytopreventcorruption.
Article11(Functions)
TheCommissionshallperformtheworkfallingundereachofthefollowingsubparagraphs:
1.Theworkofformulatingandrecommendingpoliciesandinstitutionalimprovementmeasurestopreventcorruptioninthepublicinstitutions;
2.Theworkofsurveyingtheactualstateandevaluatingtheprogressofthepolicystepstakentopreventcorruptioninthepublicinstitutions;
3.Theworkofworkingoutandimplementingtheeducationandpublicityscheduleforthepreventionofcorruption;
4.Theworkofsupportingactivitiescarriedoutbynonprofitcivicorganizationstopreventcorruption;
5.Theworkofpromotinginternationalcooperationforthepreventionofcorruption;
6.Theworkofreceivingwhistle-blowings,etc.withrespecttoanactofcorruption;
7.Theworkofprotectingandrecompensingwhistle-blowers;and
8.TheworkofaddressingmattersthatthePresidentputsontheagendaoftheCommissiontopreventcorruption.
Article12(CompositionofCommission)
(1)TheCommissionshallconsistof9members,including1chairmanand2standingmembers.
(2)ThechairmanandmembersshallbethepersonsofprofoundlearningandexperienceinthecorruptionquestionandshallbeappointedorcommissionedaccordingtothequalificationstandardssetbythePresidentialDecree.
(3)ThechairmanandstandingmembersshallbeappointedbythePresidentandthenon-standingmembersshallbeappointedorcommissionedbythePresident.Inthiscase,3membersshallbeappointedorcommissionedontherecommendationoftheNationalAssemblyand3members,ontherecommendationoftheChiefJusticeoftheSupremeCourt,respectively.
(4)Thechairmanandstandingmembersshalleachcomefromofficialsofpoliticalservice.
(5)Ifanymemberbecomesvacant,anewmembershallbeappointedorcommissionedwithoutanydelay.
[*54]Article13(Chairman)
(1)ThechairmanshallrepresenttheCommission.
(2)Whenthechairmanisunabletodischargehisdutiesassuchforunavoidablereasons,astandingmemberdesignatedbythechairmanshallactonbehalfofthechairmanindischarginghisduties.
Article14(DisqualificationofMembers)
(1)Apersonfallingunderanyofthefollowingsubparagraphsshallnotbequalifiedasamember:
1.ApersonwhoisnotacitizenoftheRepublicofKorea;
2.ApersonwhofallsundereachsubparagraphofArticle33oftheStatePublicOfficialsAct;
3.Apersonwhoisaffiliatedwithapoliticalpartyasamember;and
4.ApersonwhoregistershimselfasacandidatetoruninanelectionheldinaccordancewiththeActontheElectionofPublicOfficialsandthePreventionofElectionMalpractices.
(2)Anymembershall,whenhefallsunderanysubparagraphofparagraph
(1)above,rightlyresignhisseat.
Article15(IndependenceofWorkandGuaranteeofPositions)
(1)TheCommissionshallindependentlyperformtheworkbelongingtoitsauthority.
(2)Thetermsofofficeforthechairmanandmembersshalleachbe3yearsandtheymaybereappointedorrecommissionedonlyonce.
(3)Nomembershallbedismissedordecommissionedagainsthiswillexceptforthecasefallingunderanyofthefollowingsubparagraphs:
1.WherehefallsunderanysubparagraphofArticle14
(1);and
2.Wherehehasmuchdifficultyinperforminghisdutiesonthegroun
