ChapterIgeneralrule

Article1inordertocarryoutfamilyplanning,controlpopulation,improvepopulationquality,populationgrowthwitheconomicandsocialdevelopmentplans,accordingtothesichuanprovincialfamilyplanningordinanceandtheabaTibetanandqiangautonomousprefectureautonomousregulations,combinedwiththeactualstate,thesemeasures.

Article2bothhusbandandwifeshallhavetheobligationtopractisefamilyplanning.Autonomousorgansofautonomousstatesshallguaranteethelawfulrightsandinterestsofcitizenstocarryoutfamilyplanninginaccordancewithlaw.

Article3thepromotionoffamilyplanningshallbebasedontheprincipleoftheeducationofthemind,withthenecessaryadministrativeandeconomicmeasures,andthepromotionoflatemarriage,latechildbirth,lowbirthandeugenics.

Article4thepeople'sgovernmentsatvariouslevelsshallstrengthentheleadershipintheworkoffamilyplanningandcarryoutthemeasures;Eachunitshallcarryouttheresponsibilitysystemforpopulationtargetmanagement;Thedepartmentsconcernedshallhavetheirrespectivedutiesaccordingtothedivisionoflabor.

Article5thestateandcountyfamilyplanningcommissionisthedepartmentofthepeople'sgovernmentofthesamelevelinchargeoffamilyplanning.Thepeople'sgovernmentofthetownship（town）shallberesponsibleforthefamilyplanningworkinthetownship（town）.

Thedirectorofthevillagerscommitteeandthedirectoroftheresidentscommitteeshallberesponsibleforthefamilyplanningworkinthedistrict.

Chapteriimarriageoflatemarriage,latechildbirthandtemperance

Article6advocatingandencouraginglatemarriageandlatechildbirth.

Hanmalemorethan25yearsofage,female,23yearsoldofabove,minoritymenmarriedmorethan23yearsofage,female21yearsoldbutforlatemarriage,thewomanonthebasisofmarryatamatureagedelaybirthtomorethanoneyearlaterpregnancy.

Article7.Thefamilymustproceedasplanned.

Encourageandencourageacoupletohaveonlyonechild.

Itisforbiddentohavechildren.

Article8minoritycouplesmayhaveaplantohaveasecondchild.

TheparentsofthehanChinesefarmersandherdsmen,approvedtotakecareoftheirsecondchild.

Article9thehanChinesecoupleofthenon-agriculturalpopulationmayhaveasecondchildinaccordancewithoneofthefollowingcircumstances:

（1）thefirstchildshallhaveanon-geneticdiseaseandcannotgrowintoanormallabor;

（2）afteryearsofmarriage,aftermarriage,achildisadoptedafterthemarriage;

（3）Taiwancompatriots,compatriotsinHongKongandMacao,andoverseasChinesereturnedtothestatetosettledown;

（4）onlyoneofthebrothersorsistershasabearingcapacity;

（5）oneormoreoftheparentsisanonlychild;

（6）bothhusbandandwifeareonlychildren;

（7）inthecaseofthefirstclassorabove,thedisabledorthedisabledinthesecondclassshallbeequivalenttothedisabledinthesecondclass.

Article10.Ifoneofthefollowingconditionsismet,achildmaybebornagain:

（1）thehusbandandwifewhoremarriedbecauseofthedeathofahusbandandwife,whohavenomorethantwochildrenbeforeremarriage,andtheotherwithoutchildren;

（2）thehusbandandwifewhoremarriedfordivorce,theotherparenthasonlyonechildandtheotherhasnochildren;

（3）amarriedminorityofethnicpeasantsandherdsmen,whohavetwochildrenbeforeremarriage,oronewithoutchildren,oroneoftheotherchildren;

（4）aminorityofethnicfarmersandherdsmenandherdsmen,oneofthetwochildrenhasanon-geneticdiseaseandcannotgrowintoanormalworkforce.

Article11inaba,zoige,holocene,soilpondfourcountiesandtheotherisat3000metersabovesealevelofthetownship（town）ofthehannationalitypopulationoffarmingandanimalhusbandry,thepermanentresidenceineightyears,toarrangethesecondchildinaplannedway.

Article12acoupleofethnicminorityfarmersandherdsmenwhoareinoneofthefollowingcircumstancesmay,afterapproval,takecareofthethirdchild:

（1）livinginaba,ruoge,hongyuanandloitangcounty;

（2）tosuspendretailinvestorsinremote,high-coldareasdeterminedbythepeople'sgovernmentofthestate;

（3）onlyoneofthebrothersorsistershasabearingcapacity;

（4）bothpartiesareonlychildren;

（5）onepartyisthesecond-classonedisabledsoldierorthedisabledinthesecondclassorabove.

Article13bothhusbandandwifeshallbereturnedtothenationalminority,andthethirdchildmaybeborninthestate.

Article14inaccordancewitharticle8ofthisregulationtotheprovisionsofarticle13,forfertility,mustapplybythebothsidesofhusbandandwife,atownship（town）people'sgovernmentaudit,approvedbythecountyfamilyplanningcommission,theZhunShengZhengrearcanbirth.Thesecondorthirdchildshouldhavethreeyears.

Article15thepermanentresidenceofahusbandandwifeisinthestate,oneisaminority,theotheristhehan,andtheotherpartyistreatedbyethnicminorities.Onespouseisanon-farmanimal,andtheotherisafarmingandlivestockaccount.Onepartyhasapermanentresidenceinthestate,whiletheotherisregisteredinthestate.Ifonepartyisregisteredinthemilitary,theotherpartyisregisteredinthelocalareaandshallbeexecutedinaccordancewiththefertilityprovisionsoftheplacewherethewoman'sresidenceisregistered.

Chapteriiieugenicsandbirthcontrolmeasures

Article16thecountyorabovehospitals,maternalandchildcareunitsandfamilyplanningpropagandaandtechnicalguidanceunitsshallconducteu-nataleugenicsconsultationclinics.

Promotepre-maritalhealthchecks.Marriageandfertilityshouldbeguidedbyeugenics.

Article17coupleswhosufferfromaseriousgeneticdisordersuchasgeneticpsychosis,geneticdefectsandgeneticmalformationsshallbeprohibited;Ifpregnant,thepregnancyshouldbeterminated.

Article18couplesofchildbearingagehavetherightandobligationtoadoptbirthcontrolmeasures.Birthcontrolshouldadoptthecomprehensivemeasurethatismainlycontraceptive.

Therearetwoormorechildrenofchildbearingagewhoareencouragedtoadoptsterilizationmeasures.

Contraceptivetoolsforchildbearingcouplesforfree.

Article19allmedicalunitsandfamilyplanningpropagandaandtechnicalguidanceunitsthatcarryoutbirthcontrolproceduresmusthavetheoperatingconditions.Birthcontroloperationbythehealthadministrativedepartmentatorabovethecountylevelortheoperationcertificateissuedbythedepartmentoffamilyplanningofthemedicalstaff,toensurethatthesubjectofhealthandsafety.

Thecostofthesterilizationoperation,thestatestaffandtheworkersandstaffofthecollectiveownershipofurbanandruralareasshallbespentintheexpensesoftheunit;Urbanunemployedandruralresidentswillspendmoneyonfamilyplanning.

Article20aftersterilization,theallowedtogivebirthtochangingconditions,byplaceunitproof,approvedbythedepartmentinchargeofthecountyfamilyplanning,anastomosissurgeryatthespecifiedmedicalunits.

Article21committeeoffamilyplanningtechnicalappraisal,atorabovethecountylevelforbirthcontroloperation,complicationsandsequelae,duringtheperiodoftreatment,thenationalworkerandurbanandruralcollectiveownershipenterpriseemployeessalaryissueasbefore;Theruralpopulationexemptedfromtheworkofthecollectivevolunteersuntilthediseaseiscured;Treatmentcostishandledaccordingtotheregulationofbirthcontrol.

Chapterivrewardsandpunishments

Article22thestateworkerandurbanandruralcollectiveownershipenterpriseemployees,bothsidesofhusbandandwifeifitmeetstherequirementsofmarryatamatureage,inadditiontotheprovisionsofthestateofmarriageleave,add10daysofweddingleave;Inthecaseoflatechildbirth,itshallincreasethematernityleaveby20days,exceptforthenationalprovisionofmaternityleave.Duringtheperiodofmaternityleave,theonlychild'scertificateisextended,and30daysofmaternityleaveandmaternityleave,maternityleaveandbirthcontrolaretakenasattendance.

Intheruralpopulation,thelatebreedingmayberemovedfromthecollectivevolunteerlabor.

Article23thefertilecoupleshaveonlyonechildwhohasnotreachedtheageof14,havetakenbirthcontrolmeasures,nolongerbirth,bothsidesbythehusbandandwifeappliesfor,placeunittoverify,township（town）people'sgovernmentoftheaudit,theone-childcertificatesissuedbythecountypopulationandfamilyplanningcommission.

Article24ifachildwhohasachildwithinaplan,suchasapairoftwinsormultiplebirths,shallnotberegardedasanonlychild.

Article25thefollowingawardsandpreferentialtreatmentshallbeenjoyedbyallpersonswhoobtaintheevidenceoftheo
