PublicLiabilityInsuraneeClauses

GeneralProvisions

ProvisionIThisInsuraneeContract（hereinafterreferredtoas“Contract”o）isistsofInsuraneeClauses,InsuraneeApplication,InsuraneePolicyorotherCertificatesofInsuraneeaswellassuchotherinsuraneeapplicationdocuments,statements,comments,affixedendorsementsorotherwrittendocumentsasrelatedhereto.Anyandallsuch

arrangementsasinvolvedhereundershallbemadeinwriting.

ProvisionIIAnyandallgovernmentalagencies,enterpriseandpublicinstitutions,socialgroups,individualeconomicorganizationsandotherlegallyestablishedorganizationswithintheterritoryofthePeopie'sRepublicofChina（exclusiveofHKSAR,MacaoSAR

andTaiwan,thesameappliesbelow）aredeemedtobequalifiedenoughtobetheInsuredhereunder.

Insuraneecoverage

ProvisionIIIDuringtheinsuraneeperiodandwithinsuchscopeofareasasspecifiedherein,incaseofanyincidentasaresultoftheInsured'snegligeneeduringthecourseofitsrunninganybusinessactivitiesoritsownbusiness,whichincidenthascausedthird-partypersonalinjuriesand/orpropertydamagesandthesufferer（s）raises/raiseclaimsthefirsttimeeverduringtheinsuraneeperiod,theInsurershallundertaketopaytheindemnificationshereunderagainstanysuchindemnificationliabilityastobebornebytheInsuredinaccordaneewiththelawsofthePeople'sRepublicofChina（excluthe

lawsofHKSAR,MacaoSARandTaiwan,thesameappliesbelow）.

ProvisionIVIntheeventofanyinsuredaccident,asaresultofwhicheitherarbitrationorlitigationhasbeenraisedagainsttheInsured,theInsurershallalsotakesuchliabilityastomakeindemnificationshereunderagainstanysucharbitrationorlitigationexpensesasimposedontheInsuredaswellasthoseothernecessaryandreasonablefees（hereinafterreferredtoas“egalFees”）,whichshallbepaidbytheInsureraspertheprior

writtenconsent.

Exclusions

ProvisionVInthecaseofanyofthefollowing

notundertaketopayanyindemnification:

（I）Suchanimals,bicycles,cars,locomotives,vesselsofanykind,aircrafts,lifts,

elevators,escalators,cranes,hoistsorotherliftingmachinerywhichbelongtoor

areinthepossessionoftheInsuredorusedinitsname,butnotspecifiedinthe

ScheduleofthisInsuraneePolicy.

（II）Suchproducts,goodsandcommoditiesassold,marketedand/orgrantedfor

freebyeithertheInsuredoranyofitsempioyeesandrepresentatives;

（III）Defectivesanitaryinstallationsorpoisoningofanykindoranyuncleanor

harmfulfoodordrink;

（IV）AnyclaimsarisingfromtheengagementoftheInsuredoranyofitsempioyees

insuchperformancesasadoctor,attorney-at-laworaccountantetc.,whicharecategorizedasofthespecialprofessionsbynature.

（V）TheengagementoftheInsuredinanyconstruction,installationand/or

decorationprojects.

ProvisionVITheInsurershallnotundertaketopayanyindemnificationforany

claimsagainstsuchlossesanddamagesasaresultof:

（I）Anysuchwillfulorgravemisconducts,criminalactivitiesorgrossnegligeneeascommittedbytheInsuredoranyofitsempioyeesand/orrepresentatives;

（II）Wars,hostileactions,militaryactions,armedconflicts,terrorismactivities,

strikes,riotsand/orcivildisturbances;

（III）Administrativeand/orjudicialacts;

（IV）Naturaldisasters;

（V）Fire,explosion,fumes;

（VI）Nuclearreaction,nuclearradiation,nuclearexplosionand/orotherradioactivecontaminations;

（VII）Air/land/waterpollutionsandothernon-radioactivecontaminations;

（VIII）AnyengagementoftheInsured,anyofitsempioyeesoranyotherpersonin

theInsured'snameinsuchrelevantworkasappearingtobeoutsidetheacknowledgedbusinessand/orobligatoryscopes.

（IX）Anyaccesstoand/oruseoftheasbestos,asbestosproductsand/or

substancescontainingasbestos.

ProvisionVIITheInsurershallnotundertaketopayanyindemnificationforany

claimsagainstsuchlossesanddamagesasaresultof:

（I）ThepersonalinjuriesoftheInsuredoranyofitsempioyees

representatives;

（II）Damage/lossofthepropertywhichbelongtoorareinthechargeoforunderthecontroloftheInsuredoranyofitsempioyeesand/orrepresentatives;

and/or

operationorperformaneeof

（III）Damage/lossofanyarticlesorlandorpremisesorotherbuildingswhichhavebeenusingoroccupyingbytheInsuredoranyofitsempioyeesrepresentativesupontherequirementsofbusiness

obligations;

（IV）ThepersonalinjuriesandpropertydamagesofanypersonwhoprovideservicetotheInsured.

（VI）

Fines,penaltiesorpunitivedamages;

（VIII）ThedeductiblesstipulatedintheInsuraneePolicytobebornebytheInsured.

ProvisionVIIITheInsurershallnotundertaketopayanyindemnificationincaseofanyandallsuchotherlosses,damages,costsandexpensesasuncoveredbytheinsuraneeliability.

PeriodofInsuranee

ProvisionIXTheinsuraneeperiodofthiscontractisoneyearfrom0:

dateofinsuraneeliabilityto24:

00oftheexpirydateofinsuraneeliabilityasspecifiedintheInsuraneePolicy.

LimitsofIndemnityandDeductibles

ProvisionXTheLimitsofIndemnityhereunderineludeLimitofIndemnityforAnyOne

AccidentandAccumulatedLimitofIndemnityoftheInsuraneePolicy.Inaddition,theLimitsofIndemnitycanbecalculatedaccordingtootherspecificmethodasagreed.EachLimitofIndemnityshallbedecideduponagreementbetweentheApplicantandtheInsurerand

specifiedintheInsuraneePolicy.

ProvisionXIDeductibleforAnyOneAccidentshallbedecideduponagreementbetweentheInsuredandtheInsurerandspecifiedintheInsuraneePolicy.

ObligationsoftheInsurer

ProvisionXIITheInsurershallissueinsuraneepolicyorothercertificatesofinsuraneetotheInsuredinatimelymannerupontheexecutionofthiscontract.

ProvisionXIIITheInsurershallmakeverificationsinatimelymanneruponreceiptofthe

Insured'sclaims.FurtherverificationsmaybetakenbytheInsurerasreasonably

waysofmaking

performedbythe

TheInsurershall

compensationobligationtobefulfilledwithineithertendaysfollowingtheconclusionofaninsuraneecompensationagreementwiththeinsuredorsuchanalternativecompensationperiodassetforthintheContract.

ProvisionXIVTheInsurershallhavetheApplicantandtheInsurednotifiedcollectively

andinatimelymannerasofanymissingand/orincompleteclaimevidencesandmaterials,whichshouldhavebeensubmittedbytheInsuredhereunder.

ProvisionXVTheInsurershallpayinadvaneetheamountthatcanbedeterminedbythe

existingevidencesormaterialsifthecompensationamountcannotbedeterminedwithin60daysuponthedateofreceivingthenoticeofclaimandrelatedevidencesandmaterials.ThedifferencesshallbemadeupforaftertheInsurerfinallydeterminesthecompensationamount.

ObligationsoftheApplicantandtheInsured

ProvisionXVIfaithfuldata

Uponestablishmenthereof,theApplicantshallbeobligedtoprovidingthe

whencompietingtheInsuraneeApplicationandclarifyingsuchrelevantinquiriesasraisedbytheInsurer.

IftheApplicantconcealsfactsdeliberatelyorfailstoperformthedutyofdisclosureduetogrossnegligeneethatwouldbeenoughtoaffecttheInsurerfrommakingthedecisionofwhetherornottoagreetoaccepttheinsuraneeortoraisethepremiumrate,theInsurerhastherighttoterminatethecontract.

IftheApplicantdeliberatelyrefusestoperformthedutyofdisclosure,theInsurershallnotundertaketopayindemnityorinsuraneemoneyforinsuredaccidentthatoccursbeforethecontractisterminatedandshallnotreturntheinsuranee

premium.

IftheApplicantfailstoperformthedutyofdisclosureduetogrossnegligenee,therebyseriouslyaffectingtheoccurreneeofinsuredaccident,theInsurershallnotundertaketopayindemnityorinsuraneemoneyfortheinsuredaccidentthat

occursbeforethecontractisterminatedbutshallreturntheinsuraneepremium.

TheInsurershallnotcancelthisContractifit'sbeenaware,uponestablishmenthereof,of

anysuchconditionsasnothavingbeenfaithfullydisclosedbytheApplicant;intheeventofanyinsuredaccident,theInsurershallundertaketopayeitherindemnityorinsuraneemoney.

ProvisionXVIITheApplicantshallpaytheinsuraneepremiumaccordingtothecontract.

TheApplicantshallpayinalumpsumbeforethecontracttakeseffectifthecontractprovidesforlump-sumpremiumorthereisnostipulationaboutthemethodandtimeofpayment,andshallpaythefirstinstallmentintimeifthecontractprovidesforregularpremium.TheInsurershallnotbeliableforanyinsuraneeliabilityuntilthepremium

ismadeasrequiredbythisparagraph.

InfailureoftheApplicanttoeitherpaythepremiumintimeorinfull,orpaythesecondinstallmentofpremiumsoranyinstallmentthereafter,theInsurershall,startingfromthedateofsuchdefault,beentitledtoterminatethisContractandfurthertochargebackbothsuchaccumulatedpremiumplusinterestasofsuchperiodforwhichtheInsurerhasundertakenthein
