双方本着友好合作精神，按照公平、公正、公开的原则，充分体现权力对等、义务相等，在自愿签订聘用外国文教专家合同基础上，自愿签订本合同附件，并保证认真履行合同中约定的各项条款。

Inthespiritoffriendshipandcooperation,bothpartiessignthiscontractontheprinciplesofequality、justice、open,forthesakeofpresentingequityofrightanddutyonthebaseofvoluntarysigningofEmploymentContractBetweenForeignTeachersandXi’anUniversityofFinanceandEconomicsandguaranteeofthetermsimplementation

一、受聘方具体工作任务:

1、受聘方将承担每周16课时工作量。

超过16课时，相关院系将付给额外课时费。

2、受聘方课程包括英语口语、写作、听力、文学、文化概况等。

3、每学期为学生做2---3次讲座。

4、学期结束，要求受聘方写出教学工作总结。

I、Specificworkloadoftheemployee：

1、PartyBshallundertake16classhourseveryweek.IfPartyArequiresPartyBtoteachextraclasses,theyshallfirstobtainPartyB’sagreement.Paymentforsuchextraclassesshallbepaidbytherelativeteachingdepartments.

2、PartyBshallteachsuchcoursesasoralEnglish、writing、listening、literatureandculturaloverviews.

3、2—4lecturesforstudentseveryacademicyear.

4、Writingoutteachingsummarywhenthesemesterisover.

二、聘期从200年9月1日至200年7月31日。

Ⅱ、Employmentperiodfrom200yearmonth1dateto200year7month31date.

三、工资待遇

Ⅲ、Salary

1、直接报酬：

货币工资

1、Directpay:

currencypay

每月人民币3500元。

工资以人民币支付，自到职之日起至合同期满之日止，按月发放；不足月的，按日计发，日工资为月工资的1/30（二月份同）。

每月1日为付薪日（遇节假日顺延）。

合同期未满而提前离院，只发在院工作期内的工资，并追究违约责任。

一个月之内请假超过10天以上者，不予发放。

工资的70%以内可按月兑换外汇，受聘方应按照《中华人民共和国个人所得税法》依法交纳个人所得税。

RMB3500YuanpaidinRMBeachmonthstartedfromthefirstworkdaytillthelastdaywithinthecontract.IftheworkdaysintheContractarelessthanamonth,salarywillbepaidaccordingtothenumbersoftheactualworkdays,andthepayforeachdayis1/30ofthemonthsalary（appliestoFebruary）.Every1stofthemonthisthepayday（forholidaydelayedtothenextworkingday）.IftheemployeeleavesbeforethecompletionoftheContract,salarywillbepaidonlyfortheactualworkdaysandtheemployeewillbeascertainedwheretheresponsibilityis.70%ofsalarycanbechangedintoforeignexchangebymonth.Theemployeemustpaypersonalincometaxaccordingto<>.

2、间接报酬：

聘方将保障受聘方在华生活的基本条件：

2、Indirectpay:

Theemployerwillguaranteetheemployee’sbasiclivingconditionforlivinginChina:

（1）住宿条件：

聘方提供附设家具、卧具、电话、电视机、电脑、打印机、电冰箱、洗衣机、微波炉、厨房、卫生间、有取暖（暖气）和降温（空调）设备的二室一厅住房。

（1）Livingcondition:

Theemployerwillprovideoneheatingandair-conditionedlodgingwithalivingroomandtwobedroomwithfurniture,bed,phone,TV,computer,printer,frig,washingmachine,electricoven,kitchen,toilet,intheresidentialbuilding.

（2）公费医疗：

聘方负担受聘方在受聘期间医疗费用的80%。

受聘方须在聘方指定的医院就医，在非指定医院就医费用自理。

受聘方的挂号、就医交通、镶牙、整容、保健按摩、配眼镜、住院用餐和服用非医疗性的滋补药品以及医生出诊等费用自理。

在合同期内受聘方因公在中国境内出差，在当地政府指定的医院就诊的医疗费用，由聘方支付；因私外出就诊的医疗费用自理。

在合同期内，聘方在台湾、香港、澳门地区和中国境外就诊的医疗费自理。

（2）MedicalInsurance:

Theemployerwillbear80%medicalfeefortheemployeeduringtheemploymentperiod.Theemployeemustbehospitalizedintheappointedhospitalbytheemployer.Anychargesfromnon-appointedhospitalmustbeself-supportedincludingfeesofregistration,traffic,tooth-inserting,face-lifting,health-care,massage,spectacles,dinninginthehospital,tonicmedicinesofnon-treatmentanddoctor’soutvisitingcharges.

Duringtheemploymentperiod,whentheemployeegobusinesstrippubliclyinChina,theemployee’smedicalchargeinthelocalgovernmentappointedhospitalswillbepaidbytheemployer;butmedicalchargesfromprivateoutgoingareself-supportedincludingmedicalchargesgeneratedinTaiwan,Hongkong,MacaoandoutsideChina.

（3）国际旅费：

受聘方合同期为一年的，工作期满，聘方将支付受聘方往返国内、国际旅费（中国至受聘方国家最近距离经济舱国际机票）。

（3）Internationaltravelingexpenses:

whenIftheemploymentperiodisayear,whentheemploymentexpirestheemployerwillpaytheemployeerounddomesticinternationalexpenses.（thenearesttouristinternationalairticketofeconomicclassfromChinatothecountryoftheemployee）.

（4）受聘方一旦被聘用，聘方负责受聘方从机场（咸阳机场）到学院住所的接送。

（4）Oncetheemployeeisemployed,theemployerisresponsibleformeetingandseeing-offtheemployeefromtheairports（XiangYangairport）tothelivingplaceoftheemployeeintheUniversity.

（5）受聘方与学院合同期为一年的，可享受两次假期旅游补贴费,旅游补贴费两次一共2,200（1，100*2）元人民币。

假期旅游补贴费将于每学期末支付。

（5）Thoseonafullyear’scontractwithXAUFEareentitledtotwovacationallowances.Thevacationallowancewillbeatotalof2,200（1，100*2）YuanRMB.Paymentofthevacationallowancewillbegivenattheendofeachsemester.

四、聘方的义务

IV、Thedutyoftheemployer

1、开学第一周，聘方统一安排专人向受聘方介绍中国有关法律、法规和聘方有关工作制度以及有关外国专家的管理规定。

1、Atthefirstweekofthenewsemester,theemployerwillarrangethespecificpersontointroducerelevantChineselawstotheemployee,aswellasregulationandworkingrulesfortheforeignexperts.

2、负责受聘方来华后体检及办理专家证、居留许可等手续。

2、Theemployerisresponsibleforthephysicalexam,andproceduresofforeignexpertandresidencecertificatesoftheemployee.

3、配备合作共事人员（教师或学生课代表）。

3、Theemployerisresponsibleforequippingteachingassistants.

4、每月1日（遇节假日顺延）支付受聘方当月工资。

4、Theemployerisresponsibleforpayingtheemployeethemonthsalaryon1steachmonth（forholidaysdelayedtothenextworkingday）

5、在聘期最后一个月，受聘方需向聘方提供所属教学部门提供的完成聘期工作任务的书面证明材料，聘方在接到材料两日后，支付当月工资及国际旅费。

5、Onthelastmonthoftheemploymentperiod,theemployeewillprovidewrittenstuffbythecorrespondingdepartmentfortheemployer,whichwillapprovethattheemployeehasalreadyfinishedworkduringtheemploymentperiod.Aftertwodayswhentheemployerreceivesthestuff,theemployerwillpaytheemployeethemonthsalaryandinternationalexpenses.

6、学期末，聘方配合有关部门对受聘方工作进行检查和评估。

对敬业爱岗，有突出成绩的外教，聘方可报请有关部门推荐受聘方参加本院“先进工作者”的评选活动。

6、Attheendofeachsemester,theemployerwillcooperatewiththeconcerneddepartmentstocheckandevaluatetheworkoftheemployee.Theemployerwillapplytotheconcerneddepartmentsandrecommendthosewhoworkexcellentlytoparticipateintheassessedactivityof“ModelWorker”whichisconductedbyouruniversity.

五、受聘方的义务

V、Thedutyoftheemployee

1、遵守中国的法律、法规及聘方有关规定和制度。

不干预中国的内部事务，尊重中国的宗教政策，尊重中国人民的道德规范和风俗习惯，不传播宗教。

不谈政治，不从事与专家身份不符的活动。

1、TheemployeemustobeytheChineselaw,acts,rulesandregulationsoftheemployer.TheemployeeshouldnotinterferewiththeinterioraffairsofChina.TheemployeemustrespectChinesereligiouspolicy,moralcriteriaandcustoms,nottospreadreligion,nottotalkaboutsensitiveChinesepolitics,nottoparticipateintheactivitieswhicharenotaccordwiththeforeignexperts’identity.

2、承担每周_16__课时教学任务，并在合理范围内给学生进行辅导。

2、Eachweektheemployee'sworkloadis_16_classhoursandsomereasonablecoaching.

3、与聘方教学部门关于教材和课程安排进行研究。

3、Theemployeeshouldstudyandarrangethetextbookwiththeteachingdepartmentsoftheemployer.

4、每周参加1-1.5小时教研活动。

4、Eachweektheemployeeshouldjointeachingandresearchingactivitiesfor1-1.5hours.

5、完成聘方交给的其他工作任务。

5、Theemployeeshouldcompleteotherworktaskassignedbytheemployer.

6、未经聘方同意，受聘方不可以兼任与聘方无关的其他劳务。

6、Withouttheemployer'spermission,theemployeeshouldnotassumepart-timejobandotherirrelevantjobs.

7、合同期内必须完成工作任务，保证工作质量。

接受聘方的工作安排、业务指导、检查和评估。

7、Duringtheemploymentperiodtheemployeemustcompleteworkwithguaranteedqualityandacceptthearrangements,instruction,checking,estimationfromtheemployer.

8、不得有不良嗜好。

如：

吸毒、酗酒、打架斗殴等,一旦发现立即解聘。

8、Theemployeeshouldnothavebadhobby，asdrug,drink,fightingandsoon.Ifthereareanysortsofthis,theemployeewillbefired.

六、工作时间和休息休假

VI.Worktimeandholidays

1、受聘方的工作时间与聘方的教师相同。

1、Theemployeewillworkunderthesametimetableasotherteachersoftheemployer.

2、聘方安排受聘方增加课时，将支付超课时费。

2、Iftheemployerdemandstheemployeetoworkovertime,extrapaymentwillbepaid.

3、受聘方享受下列节日休假：

中国的元旦（1天）、劳动节（7天）、国庆节（7天）以及法律、法规规定的其他节假日。

受聘方可按其国籍和信仰相应享受下列节日休假：

圣诞节两天、宰牲节（古尔邦节）三天、开斋节一天、泼水节一天。

3、Theemployeewillenjoythefollowingholidays

NewYearDay（1day）,LaborDay（7days）,NationalDay（7days）andotherlegalholidays.

Accordingtothenationalityandreligions,theemployeewillenjoytwodaysforChristmas,threedaysforIdal-Kurban,onedayforFestivalofFast-Breaking,onedayforWater-SplashingFestival.

4、受聘方可享受带薪休假。

受聘方合同期为一学年的，享受一个假期带薪休假（寒假或暑假）。

4、Theemployeewillenjoysalariedholidays.Iftheemployeeisemployedforaacademicyear（twosemesters）,asummerorwinterholidaywillbeenjoyed（winterorsummerholiday）.

七、病假和事假

VII.Sickandprivateaffairleave

1、受聘方请病假，须凭聘方指定的医生证明。

受聘方在一个合同期（一学年）内，累计病假不满三十天，工资按照100%发放，超过三十天后，聘方有权解除聘用合同。

若未解除合同，工资将按70%发放，直至恢复正常工作为止。

受聘方请事假须经聘方同意，聘方将按日扣发工资，在合同期一学年内，事假累计不得超过十天，连续事假不得超过三天，超过一天，将扣发两天工资。

未经聘方同意而擅离职守的，旷职一天，扣发三天工资，情节严重的，聘方有权解除合同，并追究受聘方的违约责任。

1、Iftheemployeetakessickleave,itmustbeprovenbythedoctorappointedbytheemployer.Iftheemployeehaslessthan30daysalltogetherinaacademicyearduringanemploymentperiod,100%salarywillbepaid.Ifmorethan30days,employerisentitledtorevokethecontract.Beforerevoking,70%ofthesalarywillbepaidtilltheemployeereturntowork.

Iftheemployeewantstoaskforprivateaffairleave,itmustbepermittedbytheemployer.Theemployerwilldeductthedailysalaryaccordingtothelengthoftheleave.Duringaacademicyearofthecontract,totalprivateaffairleavelengthmustnotovertendays.Successiveleaveperiodmustnotoverthreedays.Ifthesuccessiveleaveismorethanoneday,salarywillbedeductedasmuchastwo-daysalary.Theemployerwilldeductemployeethree-daysalaryfromtheemployeeforonedaytruancywithouttheemployer'spermission.Iftheemployeeisseriouslyabsentwithouttheperm
