InterimMeasuresofShenzhenCityforManagementoftheHousingProvidentFund
PartIGenerals
Article1AccordingtoRegulationsonManagementoftheHousingProvidentFundissuedbytheStateCouncilandwithreferencetotherealsituationsinShenzhenCity,thesemeasuresareformulatedtolegalizethemanagementofthehousingprovidentfundofShenzhenCity,protectthelegitimateinterestsoftheholdersofthehousingprovidentfund,allowthehousingprovidentfundtoplayitsroleinhousingsecurity,supporttheemployeestobuyhousesontheirown..
Article2TheseMeasuresareapplicabletothecontribution,withdrawal,use,managementandsupervisionofhousingprovidentfundwithintheterritoryofShenzhenCity.
Article3Thehousingprovidentfundshallbecontributedbygovernmentalorganizationsandinstitutions,enterprises,non-profitprivateestablishments,non-governmentalorganizations(hereinafterreferredtoasunits)andtheirin-serviceemployeeswithorwithouthouseholdregistrationinShenzhenCity.
ThehousingprovidentfundintheseMeasuresreferstothelong-termpooltosupporttheemployeestopurchasehousesforinhabitationbythemselvesanditispurposedforhouseavailability,mutualaidandobligatory.
Thehousesforinhabitationbyemployeesthemselvesintheseregulationsincludeaffordablehouses,reasonablehousesandaveragecommercialhouses.
Article4Thehousingprovidentfundcontributedbyanemployeeitselfaswellasthatcontributedbyunitstowhichtheemployeeservesisownedbytheemployeeitself.
Article5Theprinciplethatthehousingcommitteemakesdecisions,themanagingcenterofhousingprovidentfundoperates,thebankdepositsinspecialaccountandthefinancesupervisesshallbeexcisedinthemanagementofhousingprovidentfund.
Article6Thegovernmentaldepartmentsforhousingsecurity,finance,people’sbank,planningandlandresources,publicsecurity,humanresourcesandsocialinsurance,civilaffairs,marketsupervisions,taxcollection,statistics,state-ownedassets,tradeunionandpeople’sgovernmentofeachdistrictshallperformthefunctionsoftheirowntosupporttheexpansionofthecontributiontothehousingpoolandaninformationsharingmechanismshallbeestablishedtofacilitatetheexaminationofthecontributiontoandwithdrawal,loanfromthehousingpool.
PartIIOrgansandResponsibilities
Article7TheManagementCommitteeofHousingProvidentFund,onethirdofwhosemembersshallberesponsiblepersonsfromthegovernment,financialdepartment,peoplebanketcandrelativeexperts,onethirdshallberepresentativesfromthetradeunionandtheemployeesandonethirdshallbefromtheunits,formsdecisionmakertomanagethehousingprovidentfundofShenzhenCity.
Thecommitteemembershallbeappointedbythegovernmentafterrecommendationaccordingtotherequiredprocedures.
Article8Astrict,standardizedmeetingsystemshallbeappliedtotheManagementCommitteeofHousingProvidentFund,rules,procedures,purviewsandresponsibilitiesfordecisionmakingshallbedefinedandsystemsforkeepingrecordsofthedecisionsforreviewshallbeestablished.
OfficeresponsiblefororganizationsofmeetingsandsupervisionsofdecisionimplementationsundertheleadershipoftheManagementCommitteeofHousingProvidentFundshallbeestablishedintheMunicipalHousingDepartment.
Article9TheManagementCommitteeofHousingProvidentFundshallperformthefollowingfunctionsandresponsibilitiesinthemanagementofhousingprovidentfund:
(1)Toworkoutandadjustthespecificmeasuresforthemanagementofhousingprovidentfundandsupervisetheimplementationthereofinaccordingtotherelevantlaws,regulationsandpolicies;
(2)Tosetthespecificrateforcontributiontothehousingprovidentfund;
(3)Toexamineandapprovetheplanforcollectingandusingthehousingprovidentfundandthereportabouttheplanimplementations;
(4)Toexamineandapprovetheannualbudgetsandfinalaccountsforthefinancialrevenueandexpenditureofthehousingfund;
(5)Toexamineandapprovetheplanfordistributionoftheprofitfromvalue-addingoperations;
(6)ToexamineandapprovetheapplicationsubmittedbytheManagementCenterofHousingProvidentFundforwritingoffthebadanddoubtfuldebtsontheaccountofhousingfund;
(7)ToexamineanddiscusstheannualbulletinofhousingfundtheManagementCenterofHousingProvidentFundintendstomakepublic;
(8)Otherissuesneededtoexamineandapprove.
Article10TheManagementCenterofHousingProvidentFundisanon-profitandindependentestablishmentdirectlyundertheleadershipofthePeople’sgovernmentofShenzhenCityandisnowmandatedbytheMunicipalHousingDepartment;
AsapioneeringstatutorybodyofShenzhenCity,theManagementCenterofHousingProvidentFundshalloperateaccordingtotheProvisionsontheOperationoftheManagementCenterofHousingProvidentFund,whichisrequiredforastatutorybody.
Article11TheManagementCenterofHousingProvidentFundshallimplementthedecisionsmadebytheManagementCommitteeofHousingProvidentFundandperformthefollowingfunctionsaccordingtothelaws:
(1)Tomakeandimplementtheplanforcollectingandusinghousingprovidentfund;
(2)Torecordthecontribution,withdrawalanduseofhousingprovidentfund;
(3)Toassessthehousingprovidentfund;
(4)Toexamineandapprovethewithdrawalanduseofhousingprovidentfund;
(5)Topreventthehousingprovidentfundfromdepreciationbyinvestingitandreturnit;
(6)Todraftthereportontheimplementationoftheplanforcollectingandusinghousingprovidentfund;
(7)Topreparethebudgetandfinalaccountforbalanceofhousingfundineachyear;
(8)Tosuperviseandinspectthecontributionsoftheunitstothehousingfund;
(9)Tolaydownaplanfordistributionoftheadditionalvalueonthehousingfund;
(10)Todecidetheupperlimitforloanfromthehousingfund;
(11)Tocollectthehousingprovidentfundandwithdrawfromitinaccordancewiththeregulationorauthorizeabanktodoso;
(12)Toinvestigateorpunishtheillegalitiesinthecontributiontoorwithdrawalfromoruseofthehousingfund;
(13)ToperformothercommissionsbythePeople’sGovernmentofShenzhenCityandtheManagementCommitteeoftheHousingProvidentFund
Thebudgetandfinalaccountforbalanceofhousingfundineachyear,whichisprescribedinparagraph(7)above,andtheplanfordistributionoftheadditionalvalueonthehousingfund,whichisprescribedinparagraph(9)above,shallbeauditedbythemunicipalfinancialdepartmentbeforetheyaresubmittedtotheManagementCommitteeofHousingProvidentFundforexaminationbytheManagementCenterofHousingProvidentFund.Theupperlimitforloanfromthehousingfund,whichisprescribedinparagraph(10)above,shallbedecidedbytheManagementCenterofHousingProvidentFundonthebasisofthehousingprice,affordabilityoftheemployee,thebalanceofhousingprovidentfundinShenzhenCitybeforeitissubmittedtotheManagementCommitteeofHousingProvidentFundforapproval,publicityandimplementation.
Article12TheManagementCenterofHousingProvidentFundmaysetupsubdivisionsforoperationasfewaspossibleinconformitywiththeoperationalneedandthesituationofShenzhenCity;
Article13AComputerizedSystemforManagementoftheHousingProvidentFundshallbeestablishedintheManagementCenterofHousingProvidentFundandsuchITmeansasonlineserviceplatformshallbeappliedtoimprovetheefficiencyinhandlingthebusinessofhousingprovidentfund.
FortheoperationoftheManagementCenterofHousingProvidentFundClear,specificandeffectivesystemtomaketheoperationregularized,scientific,computerizedshallbeestablishedsothattheoperationalriskmanagementcanbereinforcedandthefundsecuritiescanbeensured.
TheManagementCenterofHousingProvidentFundshallimprove
TheManagementCenterofHousingProvidentFundshallkeepaneyeonthequalityofthehousingprovidentfundservice,innovatenewservicemodeandestablishregularsystemandstandardmechanismforhandlinghousingprovidentfundservice
Article14TheManagementCommitteeoftheHousingProvidentFundmayanswerthecallofrealneedbycommittingabanktocollectandwithdrawthehousingprovidentfund;tothisend,acontractshallbemadeandenteredintobetweentheCommitteeandtheauthorizedbanktomakecleartheaccountabilityandresponsibilitiesofthebankincollectiontoandwithdrawalfromthehousingprovidentfund.
Thetrusteebankshallbesupervised,inspectedandexaminedbytheManagementCenterofHousingProvidentFund.TheManagementCenterofHousingProvidentFundshalldisengagethetrusteebankwhichembezzlesthehousingprovidentfundorisfoundunacceptableafterexaminationfromthecontractandafterthedisengagement,thetrusteebankshallturnoverthehousingprovidentfundandrelativedatawithintherequiredperiod.
PartIIIContributiontotheHousingFund
Article15Anewly-establishedunitshallberegisteredatthemanagingcenterofhousingprovidentfundforcontributiontothehousingfundwithin30daysafteritsestablishmentandthosewhichwereestablishedbeforetheenactmentoftheseMeasuresshallberegisteredatthemanagingcenterofhousingprovidentfundforcontributiontothehousingfundwithintherequiredperiod.
Within20daysafterregistrationintheManagementCenterofHousingProvidentFund,aunitshallarriveatthetrusteebanktoopentheaccountforhousingprovidentfundfortheemployeesofitselfandeachemployeeisallowedonlyoneaccountforthe
