聘请外籍教师合同

（范本）

一、-------------------聘请------------籍---------------------（外文姓名）-----------（译名）女士（先生）为英语教师。

双方本着友好合作精神，自愿签订本合同并保证认真履行合同中约定的各项义务。

二、合同期自年月日起至年月日止

三、受聘方的月薪为人民币元。

四、聘方的义务：

1．向受聘方介绍中国有关法律、法规和聘方有关工作制度以及外国专家的管理规定。

2．对受聘方的工作进行指导，检查和评估。

3．向受聘方提供必要的工作和生活条件。

4．配备合作共事人员。

5．支付受聘方的报酬。

五，受聘方的义务：

1．遵守中国的法律，法规，不干预中国的内部事务。

2．遵守聘方的工作制度和有关外国专家的管理规定，接受聘方的工作安排，业务指导，检查和评估，未经聘方同意，不得兼任与聘方无关的其他劳务。

3．按期完成工作任务，保证工作质量。

4．尊重中国的宗教政策。

不从事与教师身份不符的活动。

5．尊重中国人民的道德规范和风俗习惯。

六，合同的变更，解除和终止：

1．双方应信守合同，未经双方一致同意，任何一方不得擅自更改、解除和终止合同。

2．经当事人双方协商同意后，可以变更，解除和终止合同。

在未达成一致意见前，仍应当严格履行合同。

3，聘方在下述条件下，有权以书面形式通知受聘方解除合同：

（1）受聘方不履行合同或者履行合同义务不符合约定条件，经聘方指出后，仍不改正的；

（2）根据医生诊断，受聘方在病假连续30天后不能恢复正常工作的;

4．受聘方在下述情况下，有权以书面形式通知聘方解除合同;

（1）聘方未按合同约定提供受聘方必要的工作和生活条件;

（2）聘方未按时支付受聘方报酬。

七、违约金：

当事人一方不履行合同或者合同义务不符合约定条件，即违反合同时，应当向另一方支付500—2000美元（或相当数额人民币）的违约金。

受聘方因不可抗力事件要求解除合同，需出具有关机构证明，经聘方同意后，离华的费用自理;受聘方若无故解除合同，除离华费用自理外，还应当向聘方支付违约金。

聘方因不可抗力事件要求解除合同，经受聘方同意后，离华费用由聘方负担；聘方若无故解除合，除负担受聘方离华费用外，还应当向受聘方支付违约金。

八、本合同附件为合同不可分割的一部分，与合同具有同等效力。

九、本合同自双方签订之日起生效，合同期满即自行失效。

当事人一方要求签订新合同，必须在合同期满90天前向另一方提出，经双方协商同意后签订新合同。

受聘方合同期满后，在华逗留期间的一切费用自理。

十、仲裁

当事人双方发生合同纠纷时，尽可能通过协商或者调解解决。

若协商，调解无效，可向国家外国家局设立的外国文教专家事务仲裁机构申请仲裁。

本合同于年月在（地点）签订，一式两份，每份都中文和英文写成，两种文本同等作准。

－－－－－中学（以下简称甲方）聘请－－－－（以下简称乙方）为外籍教师。

双方本着友好合作的精神签订本合同附件，并保证认真履行附件中的各项义务。

甲、乙双方应共同遵守国家外国专家局制定的《外国文教专家生活待遇条件》中的有关条款。

1．乙方在甲方工作的总学时数为－－课时／周。

主要担任课程有

（1）英语口语教学

（2）开展英语课外活动、讲座

（3）培训本校英语教师口语

乙方参加甲方的英语教研及相关学术活动，对学生进行课外英语辅导等不计在学时效内。

2．甲方应根据不同班级的教学要求制定相应的教学内容，安排课程表。

乙方应将教学计划和教材内容事先交甲方审定，并按指定的时间和地点上课。

在教学过程中，经甲方同意，乙方可适当调整教学计划或内容。

乙方根据教学需要补充的教材、资料等，应经甲方同意，方可使用。

当甲方对乙方进行教学评估时，乙方应予以合作。

3．甲方按月（每月10日）支付乙方工资，时间从2002年3月3日至2002年6月30日止。

4．甲方须支付乙方（外教）在到职期间所发生的国内段机票款，连同50元机场建设费和20元保险费。

5．对任职半年的外教，甲方应提供旅游津贴1100元。

6．甲方应负责支付乙方到职后办理各种手续，包括住宿证、居留证和专家证及有关费用。

7．乙方受聘期间，甲方为其免费提供的住房及其设施（如：

电视（上网费用自理）、冰箱，洗衣机，热水器、电话（电话费自理）等）仅供乙方专用。

乙方（外教）将每月按时支付电话费和上网费。

8，乙方来客探访需投宿者，乙方应提前三天告知甲方，并由甲方妥善安排住宿，费用自理。

9．乙方受聘期间，免费享受甲方（校内）的医务室治疗。

如需到校外医院治疗，甲方半年应为乙方提供医疗费用人民币500元，超出部分自理。

10．休假遵循国家外专局有关规定。

本合同附件于2002年3月，在江苏省常州市田家炳实验中学三楼会议室（地点）签定，中文和英文文本一式两份，甲，乙／双方各保留一份。

两种文本具有同等法律效力。

2.PartyAshallconductdirection,supervisionandevolutionofPartyB'swork.

3.PartyAshallprovidePartyBnecessaryworkingandlivingconditions.

4.PartyAshallprovideco-workers.

5.PartyAshallpayPartyB'ssalaryregularlybythemonth.

VI.PartyB'sObligations

1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina'sinternalaffairs.

2.PartyBshallobservePartyA'sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA'sarrangementdirection,supervisionandevolutioninregardtohis/herwork.WithoutPartyA'sconsentPartyBshallnotrenderserviceelsewhereorholdconcurrentlyandpostunrelatedtotheworkagreedonwithPartyA.

3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.

4.PartyBshallrespectChina'sreligiouspolicy,andshallnotconduct,religiousactivitiesincompatiblewithtilestatusofateacher.

5.PartyBshallrespecttheChinesepeople'smoralstandardsandcustoms.

VII.Revision,CancellationandTerminationofContract

1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.

2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.

3.PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions:

（1）PartyBdoesnotfulfilthecontractordoesnotfulfilthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.

（2）Accordingtothedoctor'sdiagnosis.PartyBcannotresumenormalworkafteracontinued30daysickhere.

4.PartyBhastherighttocancelthecontractwithawrittennoticetoPartyAunderthefollowingconditions:

（1）PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.

（2）PartyAhasnotpaidPartyBasscheduled.

VIII.BreachPenalty

Wheneitherofthetwopartiesfailstofulfilthecontractoffailstofulfilthecontractobligationsaccordingtothetermsstipulated,thatis,breakthecontract,itmustpayabreachpenaltyofUS$500to2000（ortheequivelantinRMB）.

IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA'sconsentandpayitsownreturnexpenses;IfPartyBcancelthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandPayabreachpenaltytoPartyA.

IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB’sreturnexpenses;ifPartyAcancelthecontractwithoutvalidreason,itshouldpayPartyB’sreturnexpensesandpayabreachpenaltytoPartyB.

IX.Theappendixofthiscontract,isaninseparablepartofthecontractandhasequaleffect.

X.Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty90dayspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.

PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires.

XI.Arbitration

Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtotheorganizationofarbitrationforforeignexpertsaffairsintheStateBureauofForeignExpertsandaskforafinalarbitration.

APPENDIXTOTHECONTRACT

JiangsuChangzhouTianjiabinExperimentalMiddleSchool（PartyA）wishestoengagetheservicetoMs.AliceThomson（PartyB）asitsforeignteacher.Bothparties,infilespiritoffriendlycooperation,agreetosignthisAppendix,whichisacontinuouspartofthecontract,andpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.

Bothpartiesshallabidebythetermsconcernedinthepapers"ThelivingConditionsofForeignExpertsWorkinginCulturalandEducationalInstitutes".issuedbytheStateBureauofForeignExpertsofChina.

Party.BshallworkforPartyA14teachinghoursperweektotally.ThecoursesthatPartyBshouldconductareasfollows:

1）ToteachSpokenEnglishinSeniorMiddleSchool.

2）Toorganizetheoutsideclassactivitiesandlectures.

PartyBisadvisedtotakepartinteachingorotherrelatedacademicactivities,andcoachhisstudents,ifrequired,afterclass.Thatshallnotbeincludedintheregularteachinghours.

II.PartyAshallworkouttheoutlinesofthedifferentclassesandsetuptheschedulesoftheclasses.PartyBshallmakeoutthesyllabiforeachcourseandpresentthemtoParty.Aforapproval.PartyBshallgivelessonsinthesuggestedclassroomatthegiventime.Whendeemedadvantageous,PartyBmay,withtheconsentofParty.A,adjusthisorhersyllabi,useself-preparedmaterials,videocassettesorothermaterials.WhenPartyAevaluatesPartyB'swork,PartyBisadvisedtooffercooperation.

III.PartyAshallpayParty.Bmonthly（10thofthemonth）,commencingfromMarch3th2002toJune30th2002.

IV.PartyAshallpayPartyBtheexpenseofflightfromBeijingtoNanjingand50yuan,whichistheexpenseofairportconstructionand203man,insurance.

V.PartyAshallpayPartyB1100yuanasatravelallowanceifPartyBteachesforhalfayear.

VI.PartyAshallpayalltheexpensesofgoingthroughalltheformalities,suchasresidencepaper,foreignexpertcertificate.

VII.WhenParty.Bperformstheobligationsstipulatedinthecontract,thelodgingsandotherfacilitiesprovidedbyPartyAareforPartyB'sprivateuseduringhis/herserviceinTJBEMS,suchasaTVset,telephone,e-mails,refrigerator,washingmachine,andwater-heateretc.PartyBshallpayfortheuseofdomesticandinternationaltelephonecalls,fixesande-mailsforhis/herprivatepurpose.PartyBshallpaytheexpensesofdomesticandinternationaltelephonecalls,fixesande-mailsetc.intimeeverymonth.
