A.Introduction

1.SourceofFunds

1.1TheGovernmentoftheUnitedofRepublicofTanzaniathroughtheTanzaniaAirportsAuthorityhassetasidefundsfortheoperationsoftheairports.ItisintendedthatpartoftheproceedsofthefundswillbeusedtocovereligiblepaymentunderthecontractforSupplyofgoodsspecifiedintheBidDataSheet.

2.EligibleBidders



2.1ThisInvitationtoTender,isopentoallfirmscapableofsupplyingthegoodscomplyingtospecificationinthesebiddingdocument.Firmsofamembercountrymaybeexcludedifasamatteroflaworregulation,Tanzaniaprohibitscommercialrelationswiththatcountry.

2.2Biddersshouldnotbeassociated,orhavebeenassociatedinthepast,directlyorindirectly,withafirmoranyofitsaffiliates

whichhavebeenengagedbythePurchasertoprovideconsultingservicesforthepreparationofthedesign,specifications,andotherdocumentstobeusedfortheprocurementofthegoodstobepurchasedunderthisInvitationforBids.

2.3Government-ownedenterprisesintheUnitedRepublicofTanzaniamayparticipateonlyiftheyarelegallyandfinanciallyautonomous,if

theyoperateundercommerciallaw,andiftheyarenotadependentagencyofthePurchaser.

2.4BiddersshallnotbeunderadeclarationofineligibilityforcorruptandfraudulentpracticesissuedbytheGovernmentoftheUnitedRepublicof

TanzaniainaccordancewithITBClause36.1.

3.1Allgoodsandrelatedservicestobesuppliedunderthecontractshallhavetheiroriginineligiblesourcecountries,andallexpendituresmadeunderthecontractwillbelimitedtosuchgoodsandservices.

3.2Forpurposesofthisclause,"

origin"

meanstheplacewherethegoodsaremined,grown,orproduced,ortheplacefromwhichtherelatedservicesaresupplied.Goodsareproducedwhen,throughmanufacturing,processing,orsubstantialandmajorassemblyofcomponents,acommercially-recognizedproductresultsthatissubstantiallydifferentinbasiccharacteristicsorinpurposeorutilityfromitscomponents.

3.3TheoriginofgoodsandservicesisdistinctfromthenationalityoftheBidder.

4.1TheBiddershallbearallcostsassociatedwiththepreparationandsubmissionofitsbid,andthePurchasernamedintheBidDataSheet,hereinafterreferredtoas"

thePurchaser,"

willinnocaseberesponsibleorliableforthosecosts,regardlessoftheconductoroutcomeofthebiddingprocess.
