Tomakedrinkinganddrivingacriminaloffenseisanapproachdirectedonlyatintoxicateddrivers.Insomestates,thelawempowerspolicetorequestbreathtestsofdriverscitedforanytrafficoffenseandelevatedBACcanbethebasisforarrest.TheNationalHighwayTrafficSafetyAdministrationestimates,however,thatevenwithincreasedattests,thereareabout700violationsforeveryarrest.Atthislevelthereislittleevidencethatlawsserveasdeterrentstodrinkingwhileintoxicated.InBritain,motorvehiclefatalitiesfell25percentimmediatelyfollowingimplementationoftheRoadSafetyActin1967.AstheBritishincreasinglyrecognizedthattheycoulddrinkandnotbestopped,theeffectivenessdeclined,althoughintheensuingthreeyearsthefatalityrateseldomreachedthatobservedinthesevenyearspriortotheAct.

WhetherpenaltiesfordrivingwithahighBACorexcessivetaxationonconsumptionofalcoholicbeverageswilldetertheexcessivedrinkerresponsibletotmostfatalitiesisunclear.Infact,theanswerdependsontheextenttowhichthosewithhighBACinvolvedincrashesarecapableofcontrollingtheirintakeinresponsetoeconomicorpenalthreat.Therapeuticprogramswhichrangefromindividualandgroupcounselingandpsychotherapytochemotherapyconstituteanotherapproach,buttheyhavenotdiminishedtheproportionofaccidentsinwhichalcoholwasafactor.Inthefewcontrolledtrialsthathavebeenreported,thereislittleevidencethatrehabilitationprogramsforthoserepeatedlyarrestedfordrunkenbehaviorhavereducedeithertherecidivismorcrashrates.Thusfar,thereisnofirmevidencethatAlcoholSafetyActionProjectsupportedprograms,inwhichrehabilitationmeasuresarerequestedbytilecourt,havedecreasedrecidivismorcrashinvolvementforclientsexposedtothem,althoughknowledgeandattitudeshaveimproved.Onethingisclear,however,unlesswedealwithautomobileandhighwaysafetyandreduceaccidentsinwhichalcoholicintoxicationplaysarole,manywillcontinuetodie.
