Article3.Loaninterests:

(annual)interest4.2‰andbalancetheinterestbymonth.

Article4.TheloantermisTwentyyears,fromAug.20,2004,toAug.20,2024

Article5.Lendershalldeposittheamountofloaninclauseonebyone-timetotheAccountopenedbyBeijingYiyangXingchengRealEstateDevelopmentCo.,Ltd

Article6.Borrowerpaytheprincipalandinterestoftheloadunderthiscontractin240installments,everyonemonthbeingoneinstallment.TheamountofprincipalandinteresttobepaidforoneinstallmentisRMB9,535.21.Thewayofpaymentisinequalaccountofprincipalandinterest.

Article7.BorroweropenssavingaccountinToutiaoSavingAgentEstablishedNameisYUEJiangyan,AccountNumberis0200210901024019426,andpromisestotransfertheprincipalandinterestoftheloadintoitontime.

Article8.WhereBorrowerdoesnotrepayasperthesaidregulations,Lendermaydeduct2.1/tenthousandeverydaypaymentasdamage.

Article9.WhereBorrowerdoesnotrepaytheinterestofloanasperthesaidregulations,Lendermayhaverighttochargedoubleinterests.

Article10.Beforedistributingtheloan,ifBorrowerhasgreatconflictwithhouseselleroverproblemssuchhouse’squalityandproperty,Borrowerisauthorizedtocancelthiscontract,andshalldecidewhethercontinuethecontractwithinhalfoneyear.

Article11Afterthedeliveryoftheloan,ifdisputeoccursbetweenborrowerandPartyC,thecontractisstilleffective.

Article12.IfBorrowerneedstorefundinadvance,itshallnoteLenderonemonthbeforerefunddayandthenoticeisirrevocableupondelivery.

Article13Ifoneormoreitemsasfollowsoccur,Lenderhasrighttoexpirethecontractinadvance,anddeliver“informationofrepaymentinadvance”toBorrowerandSecurities.

(2)Thelostordeathornon-heirofBorrower

(3)TheheirofBorrowerrefusestorepaytheloan

(4)Borrowerdoesnotrepaytheloaninseriesthreeinstallments,orcumulativesixinstallments.

Article14.Eitherpartywantstoalterpartofthearticlesofcontractshouldinformtheotherpartyinwrittenformandfriendlynegotiate.Anotheradvancedagreementisexcluded.

Article15.Borrowerisresponsibleforthecost.Anotheradvancedagreementisexcluded.

Mortgageitems

Article16.BorrowermortgagestherealestateandallthepovertiestheattachedlistofmortgagestoLender,andpromisestobearlegalresponsibilities.

Article17.Thescopeofmortgageincludesprincipalandinterestofloan(includingthearticle9),punishedinterestandthecostofrealclaims.

Article18.Afterthesignofthiscontract,mortgageregistrationcertificationandotherrightcertificationsshouldbehandedovertomortgagee.

Article19.Mortgageeshouldprotectthemortgagescarefully,beresponsibleforthemaintenanceofthemortgages,andbesupervisedbyLender.

Article20.Thevalueischangedbecauseofmortgager’sfaultsorothers,mortgageeisnotresponsible.

Article21.Withouttheconsentofmortgager,themortgageehasnorighttodisposethemortgages.

Article22.IfLenderthinksitisnecessarytoreevaluatethemortgages,mortgageeshouldcooperate.

Article23.Thesetofmortgagesshouldregisterinadministrationforrealestate,sothecooperationisrequired.

Article24.Ifthesituationofarticle13occurs,Lenderhasrighttodisposethemortgagesinadvance.

Article25.BorrowershouldgoforinsuranceaccordingtotherequirementofBorrower.

Article26.Allorpartoftheitemsinloanhasnothingtodowiththeeffectofmortgageitems.

Materialmortgageitems

Article27.BorrowermortgagesallthepovertiestheattachedlistofMaterialmortgagestoLender,andpromisestobearlegalresponsibilities.

Article28.Thescopeofmortgageisprincipalandinterestofloan(includingthearticle9),punishedinterestandthecostofrealclaims.

Article29.BorrowershouldhandovertherightcertificationtoLender,andLendershouldprotectitcarefully.

Article30.Ifthetimeofcashingvaluedbondsisaheadofthetimeofrepayment,methodsofdisposalasfollows:

(1)Cashthebondstorepaytheloan.

(2)Changeintothefixeddepositasmaterialmortgage.

(3)Usetherecognizedequaldepositandbondstochangesavingdepositandbonds.

Article31.Borrowerhasnorighttoreportlossofanymaterials.

Article32.Ifthesituationofarticle13occurs,Lenderhasrighttodisposethematerialmortgages.

Article33AllorpartoftheitemsinloanhasnothingtodowiththeeffectofMaterialmortgageitems

Guaranteeitems

Article34.GuarantoriswillingtoofferguaranteetoBorrower.

Article35.Thescopeofguaranteeisprincipalandinterestofloan(includingthearticle9),punishedinterestandthecostofrealclaims.

Article36.PeriodofguaranteeistwoyearsafterBorrowernotfulfillingdebts.

Article37.Ifguarantorcannotfulfilltheobligationofguarantee,Lenderhasrighttodeductrelevantcashpaymentinaccount.,

Article38.GuarantorshouldpromisetosuperviseBorrowerpayontime.

Article39.BorrowerhasrighttotransferdebtstoguarantorwithouttheagreementofLender.

Article40.Borrowerusesstate-adjustednewinterestrate,guarantee’sagreementisnotneeded.

Article42.Wherethedisputefailstoreachagreementamongthethreeparties,anyofthepartiesmaysubmittothelocalPeople’sCourtorlocalarbitrationorganizationforconciliation.

Article43.TheContractcomesintoeffectsincesignedbythreeparties.

Article44.TheContractendsasBorrowerpayingthepaymentinfull.

Article45.BorrowerhasrighttotransferthebenefitsinthiscontracttootherswithouttheapprovalofLenderandguarantor

Article47.IfBorrowercannotfulfillthepayment,Lenderhasrighttoclaimforcompensationinanymethod.
