AccordingtothelawsandregulationsofLaborLawofP.R.C.,thecontractismadetobeabidedbythebothpartiesbasedonequalityandfreewill.
1.EmploymentPeriod
Thecontractdurationis2years.ThecontractshalltakeeffectfromApr.2,2001toApr.1,2003.
2.JobContent
PartyAappointsPartyBasManagerinPrinterBusinessDepartment.
3.LaborProtectionandWorkingConditions
PartyAisrequiredtoprovidePartyBwiththeconditionsoflaborsafetyandsanitation,andnecessarylaborprotectiveequipmenttoPartBaccordingtorelevantregulationsofthestateandgovernment.
4.WorkingTime
Accordingtotherelevantregulationsofthestateandgovernment,PartyBworks40hoursaweekand8hoursadayaveragely.PartyAshallpromisePartyBatleastadayoffperweek.PartyAcanprolongtheworkingtimebynegotiatingwithPartyBincaseofbusinessneed,buttheextendedtimeisnotpermittedtobemorethanthelongestextendedworkingtimeregulatedbythestate.
5.LaborremunerationandWelfareTreatment
(1)PartyAshouldpaythesalaryinformofcurrencyRMB3,000ontimeandpositionallowanceRMB1,000permonthwithoutdeductionanddefault.
(2)Inadditiontothesalary,PartyBcangetbonusofcertainamount.Thestandardofdeliveringbonusis:
dependingontheoperationstatusofthedepartmentandindividualperformance,andofferedatthebeginningofthecomingyear.
(3)IfPartyAextendstheworktime,PartyAshouldcompensatePartyB150%salaryfortheovertime.IfPartyAarrangesPartyBtoworkduringrestdays,PartyAshouldcompensatePartyB200%salary.IfPartyAarrangesPartyBtoworkduringlegalholidays,PartyAshouldcompensatePartyB300%salary.
(4)PartyAshouldpaypartofthesocialinsurancepremiumforPartyBaccordingtotheconcerningregulationsandthelawsofthestate,andPartyBiswillingtoentrustPartyAtodeducttheotherpartofthesocialinsurancepremium.
(5)IfPartyBisinjuredforworkorafflictedwithoccupationaldiseasewithintheemploymentperiod,PartyAshouldhandlethemattersaccordingtotherelatedstatelaws.
6.WorkingDiscipline
(1)PartyAhastherighttoformulatetheregulationsoftheunitaccordingtorelatedregulationsofthestateandthecitytoguaranteetherightsandobligationsofPartyB.PartyAhasarighttosupervisetheworkperformanceofPartyB.
(2)PartyBshouldobeythepresentrelatedlaws,regulationsandpolicies,andcompletetheoccupationaltaskactively.
7.Alteration,extension,cancellationandterminationoftheContract
(1)Thecontractcanbealteredifitisnecessaryaccordingtotheactualsituation;bothpartiesshouldnegotiatefriendlyandsigntheagreementoflaborcontractalteration.Iftheagreementcannotreachafternegotiation,PartyAhastherighttoterminatethecontractandnoticePartyBbywrittenform30daysinadvance.
(2)Whentheagreedconditionsofcontractcancellationoccur,thiscontractiscancelledimmediately.30daysbeforethecancellation,bothpartiesshouldinformeachotherinwrittenformtoextendorcancelthecontract.Ifbothpartiesarewillingtoextendthecontractafternegotiation,theextensioncontractshouldbesignedbeforethecancellationterm.
(3)Basedonnegotiationbetweenbothpartiesuponconsensus,thiscontractcanbeterminated.
(4)PartyAhastherighttoterminatethecontractifPartyBisinoneofthefollowingsituations(Intermsofthelastthreeitems,PartyAshallinformPartyBinwrittenform30daysinadvanceandpayPartyBrelevanteconomiccompensationaccordingtorelevantregulationsofthestateandcity.):
1)PartyBbreachesdutiesandcausesseriousdamagesorviolatingthelabordisciplines.
2)PartyBisinvolvedinacriminallawsuit.
3)PartyBissickorinjuredbecauseofemploymentandcannotfulfillherresponsibilitiescontinuouslyafterhersickness.
4)PartyBisincompetentforthejob,evenafterthetrainingortheadjustment.
5)Theobjectivesituationsthatthecontractisbasedontakechangesandcausethecontractfailingtobeimplemented,andthecontractcannotbereachedafterbothparties’negotiation.
(5)PartyAhasnorighttostopthecontractincasethatoneofthefollowingsituationshappens:
(excludingitem1and2intheabovepoint)
1)PartyBhasoccupationaldiseaseorhurtfromtheworkandlosetheabilityofworking.
2)PartyBissickorhurtsnotfromthework,butwithinthetreatmentperiod.
3)PartyBisinpregnancy,confinementorlactationperiod.
4)Othersituationsaccordingtothelawsandregulations.
(6)PartyBhastherighttoterminatethecontractincasethatoneofthefollowingsituationshappens:
1)PartyAforcesPartyBtoundertakeactivitiesbyviolence,threatorrestrictionofPartyB’shumanfreedom.
2)PartyAcannotpayPartyB’ssalaryorprovideherwiththeworkconditionsaccordingtothecontract.
3)PartyAdoesnotpaythesocialinsuranceforPartyBaccordingtotheHandbookofEmployees.
(7)Inadditiontotheitemsabove,PartyBshouldnegotiatewithPartyAinwrittenform30daysinadvance.IfPartyAagreestounconditionallyterminatethecontractorhasnoreplywithin30days,PartyAshouldterminatethecontractwithPartyBassoonaspossible.
(8)Whenthedurationofthecontractends,orsituationfortheterminationofthecontracthappens,thelaborcontractiscancelledimmediately.
8.Responsibilitiesofbreachingthecontract
Bothpartiesshouldobeythelaborcontract,eitherpartywhobreachesthecontractandcausesdamagetootherPartyshouldgivecompensation.
9.Others
(1)ThecontractisprintedduplicationsforPartyAandBeach,whichareefficientsincethesigningdayandhavethesamelegaleffect.
(2)Disputesshallbesettledthroughnegotiationorapplyformediation,arbitrationandbringalawsuit.
(3)Unmentionedmattersinthislaborcontractshallbesettledthroughnegotiation.
(4)Ifthecontentofthecontractisnotinaccordancewiththestateormunicipalregulations,itshouldbeimplementedaccordingtorelevantstateandmunicipalregulations.
