　　Article1ThisLawhasbeenenactedforthepurposesofregulatingnotarizationactivities,ensuringthatthenotarizationinstitutionsandnotariesperformtheirdutiesinaccordancewiththelaw,preventingdisputesandprotectingthelawfulrightsandinterestsofthenaturalpersons,legalpersonsorotherorganizations.

　　Article2Notarizationmeansanactperformedbyanotarialinstitution,upontheapplicationofapartyconcerned,suchascertifyingtheauthenticityandlegalityofalegalact,adocumentorafactoflegalsignificanceaccordingtothestatutoryprocedures.

　　Article3Anotarialofficeshallcomplywiththelawandshallsticktotheprincipleofobjectivenessandimpartialitywhenperformingnotarialacts.

　　Article4ChinaNotaryAssociationshallbesetupasanationalnotaryassociationandeachprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentshallestablishalocalnotaryassociation.ChinaNotaryAssociationandlocalnotaryassociationsshallbesocialorganizationswithlegalpersonstatus.ThecharterofChinaNotaryAssociationshallbeformulatedbythegeneralassemblyoftherepresentativesofitsmembersandshallbereportedtothejudicialadministrativedepartmentoftheStateCouncilforarchivalpurposes.

　　Thenotaryassociationsareself-disciplinaryorganizationsofthenotarizationindustry.Theyshallcarryoutactivitiesinaccordancewiththecharterandshallsupervisethepracticeofthenotarialofficesandnotaries.

　　Article5Thejudicialadministrativedepartmentshall,underthelaw,superviseandofferguidancetothenotarialoffices,notariesandnotaryassociations.

　　Article6Anotarialofficeisalawfullyestablishednon-profit-makingcertificationinstitutionthatindependentlyexercisesthenotarialfunctionsandbearcorrespondingcivilliabilities.

　　Article7Anotarialofficemay,incompliancewiththeprincipleofoverallplanningandreasonabledistribution,beestablishedinacounty,undistrictedcity,districtedcity,municipalitydirectlyundertheCentralGovernmentordistrictdirectlyunderacity.Oneormorenotarialoffice（s）maybeestablishedinadistrictedcityormunicipalitydirectlyundertheCentralGovernment.Thenotarialofficesarenotestablishedondifferentlevelsaccordingtoadministrativehierarchy.

　　Article8Ato-be-establishednotarialinstitutionshallmeetthefollowingconditions:

（1）Havingitsownname;

（2）Havingafixedoffice;

　　（3）Having2ormorenotaries;

and

　　（4）Havingthefundnecessarytocarryoutnotarialwork.

　　Article9Whereanotarialofficeistobeestablished,itshallbereportedbythelocaljudicialadministrativedepartmenttothejudicialadministrativedepartmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Afterthejudicialadministrativedepartmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentgrantsapprovalaccordingtotheprescribedprocedures,thelocaljudicialadministrativedepartmentshallissueapracticingcertificateofnotarialoffice.

　　Article10Theperson-in-chargeofanotarialofficeshallbeselectedorelectedfromthenotarieswhohave3ormoreyearsofpracticingexperience,shallbesubjecttotheexaminationandapprovalofthelocaljudicialadministrativedepartment,andshallbereportedtothejudicialadministrativedepartmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentforarchivalpurposes.

　　Article11Uponrequestofanaturalperson,legalpersonoranyotherorganization,thenotarialofficeshallperformingnotarialactsforthefollowingmatters:

（1）Contract;

（2）Inheritance;

　　（3）Authorization,declaration,bestowal,will;

　　（4）Distributionofproperty;

　　（5）Biddingandtendering,auction;

　　（6）Marriagestatus,kindredrelationship,adoptionrelationship;

　　（7）Birth,existence,death,identity,experience,educationbackground,degree,jobtitle,professionaltechnicaltitle,havingornothavingillegalandcriminalrecord;

　　（8）Articlesofassociation;

　　（9）Preservationofevidence;

　　（10）Signature,sealanddateasindicatedinadocument,duplicateorphotocopyofadocumentconformingwiththeoriginaldocument;

　　（11）Othermattersthatanaturalperson,legalpersonoranyotherorganizationvoluntarilyrequestsfornotarization.

　　Astoanymatterthatshallbenotarizedunderanylaworadministrativeregulation,therelevantnaturalperson,legalpersonoranyotherorganizationshallfilearequestwiththenotarialofficefornotarization.

　　Article12Upontherequestofanaturalperson,legalpersonoranyotherorganization,thenotarialofficemayhandlethefollowingaffairs:

（1）Theaffairsthatshallberegisteredbyanotarialofficeunderanylaworadministrativeregulation;

（2）Preservationofevidence;

　　（3）Preservationofwill,heritageorotherproperty,articlesanddocumentsrelatingtothenotarizationaffair;

　　（4）Makinglegaldocumentsrelatingtothenotarizationmatterinsteadofothers;

　　（5）Providinglegalconsultationservicesrelatingtonotarization.

　　Article13Nonotarialofficemay:

（1）issueanotarialcertificateforanuntrueorillegalmatter;

（2）destroyorfraudulentlyalteranynotarialdocumentorarchivefile;

　　（3）canvassnotarialbusinessbybespatteringothernotarialofficesornotaries,orbypayingkickbacksorcommissions,orbyanyotherunfaircompetitionmethods;

　　（4）divulgeanystatesecret,commercialsecreteorpersonalprivacyithasaccesstoinitspractice;

　　（5）chargenotarizationfeesbyviolatingtheprescribedstandards;

or

　　（6）commitanyotheractasprohibitedbyanylaworregulation,orprovisionsofthejudicialadministrativedepartmentoftheStateCouncil.

　　Article14Anotarialofficeshallworkoutrulesforthemanagementitsbusiness,financialaffairsandassets,shallsupervisethepracticesofitsnotariesandshallsetuparesponsibilitysystemforwrongpractices.

　　Article15Thenotarialinstitutionshallbuynotarialpracticeresponsibilityinsurance.

　　Article16AnotaryshallbeanotarialpractitionerwhomeetstheconditionsasprescribedbythisLawandisworkinginanotarialoffice.

　　Article17Thenumberofnotariesshallbedeterminedaccordingtotheneedsofnotarialbusiness.Thejudicialadministrativedepartmentofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentshalldetermine,inlightoftheestablishmentofnotarialofficesandtheneedsofnotarialbusiness,theplanonthearrangementofnotariesandshallsubmitittothejudicialadministrativedepartmentoftheStateCouncilforarchivalpurposes.

　　Article18Anotaryshallmeetthefollowingconditions:

（1）HavingthenationalityofthePeople'

sRepublicofChina;

（2）Being25-65yearsold;

　　（3）Beingimpartialandupright,observingthelawanddisciplines,beingofgoodmoralcharacter;

　　（4）Havingpassedthenationaljudicialexamination;

　　（5）Havingactedasaninterninanotarialofficefor2ormoreyears,orhaving3ormoreyearsofexperienceofanotherlegalprofessionandhavingactedasaninterninanotarialofficefor1yearormore,andhavingpassedtheevaluation.

　　Article19Whereapersonwhowasengagedinteachingandresearchoflawandhasaseniorprofessionaltechnicaltitle,whereapersonwhowasacivilservantorlawyer,hasauniversitydiplomaoraboveandhasfull10yearsofexperienceinadjudication,procuratorialwork,legalaffairsorlegalservice,ifhehaslefthispostandhaspassedtheevaluation,hemaytakeupthejobofanotary.

　　Article20Apersonshallnottakeupthejobofanotaryunderanyofthefollowingcircumstances:

（1）Havingnocivilcapacityorlimitedcivilcapacity;

（2）Havingbeensubjecttoanycriminalpunishmentduetoanintentionalcrimeorduty-relatedcrime;

　　（3）Havingbeendismissedfromagovernmentorgan;

　　（4）Hispracticingcertificatehasbeenrevoked.

　　Article21Whereapersonintendstoactasanotary,heshallmeettheconditionsforanotary,shallfileanapplicationandshallberecommendedbyanotarialoffice.Thelocaljudicialadministrativedepartmentshallsubmittheapplicationtojudicialadministrativedepartmentofthepeople'

sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentforexaminationandapproval.Ifthejudicialadministrativedepartmentofthepeople'

sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentapprovestheapplication,itshallrequestthejudicialadministrativedepartmentoftheStateCouncilforappointmentandshallissuetheapplicantapracticingcertificateofnotary
