Well-knowntrademarksisalong-termuse,inthemarketenjoyahighreputation,knownfortherelevantpublicandbycertainproceduresthatthetrademark.Sincethe"

ParisConvention"

wasfirstintroducedtheconceptofwell-knowntrademarks,thewell-knowntrademarksforspecialprotectionlegislationhasbecometheworldtrend.

ParisConventionstipulates:

allofthememberswereidentifiedasthewell-knowntrademarks,orregisteredFirst,thefirsttobanothers,andtheotheristoprohibittheuseofotherswithidenticalorsimilarlogo.Tripsfurtherprovides:

1,theParisConventionforthespecialprotectionandextensionoftheservicesofwell-knowntrademarks,2,thescopeofprotectiondoesnotextendtoprohibitsimilargoodsorserviceswiththewell-knowntrademarksforuseonthesameorsimilarlogo,3,onhowtoThatawell-knowntrademarksinprincipleasimplerequirement.

Nationallegislationonthepractice,thewell-knowntrademarksthatstandardsvary,oftenbasedonspecifictrademarkpromotionofpublicawarenessofrelatedareas,logomerchandisesalesandthescopeofnationalinterests,andotherfactorsidentified.Fromaninternationaltreatytoprotectthewell-knowntrademarksmind,thatwell-knowntrademarksandprotectionofwell-knowntrademarksarecloselylinked.

Second,thewell-knowntrademarksprotectedmode

Ontheprotectionofthemaintrademarksofrelativeandabsoluteprotectionismtwomodels.

Theformerreferstobanotherswithwell-knowntrademarksidenticalorsimilartrademarkwiththetrademarkownerthesameorsimilarindustriesintheregistrationoruseofsimilargoodsinnon-useofthesameorsimilartrademarksispermitted,"

Whilethelatterreferstobanothersinanyindustry,includingthewell-knowntrademarkgoodswithdifferentorsimilartothoseintheindustrytoregisterwiththewell-knowntrademarksandtheuseofthesameorsimilartrademarks,TRIPSagreementthatistakenbytheexpansionoftheabsoluteprotectionism.

Insimpleeconomicform,asspecifiedbythetrademarkgoodsatasingle,specifictrademarkgoodsandthelinkbetweenmoreclosely.With,avaluablewell-knowntrademarkshavebeenmoreandmoreuseofdifferenttypesofcommodities,whichareamongthetypesofgoodsonthepropertymaybetotallydifferent,inatrademarkassociatedwiththecommoditygroupsandtherelativeweakeningoftrademarksCommodityproducersandtherelativeisolation.Notwell-knowntrademarkssuchascross-categoryprotectionandallowotherstoregister,evenifthegoodsobviousdifferences,thepublicwillstillbeinthenewgoodsandreputablewell-knowntrademarkstoestablishalinkbetweenpeoplethatthegoodsmaybewell-knowntrademark,thenewcommodities,Orthewell-knowntrademarksofgoodsandpeoplebetweentheexistenceofalegal,organizationalorbusinessassociation,thusleadingtothemisuseofconsumerspurchase.Therapiddevelopmentofthecommoditytoday,therelativeprotectionismhasnotimprovedtheprotectionofthepublicandwell-knowntrademarkowner'

sinterests.

Inviewofthis,inordertoeffectivelypreventthereputationofwell-knowntrademarks,andtheidentificationofsignificantfeaturesandadvertisingvaluebytheimproperuseofthedamage,manycountriesontheimplementationofawell-knowntrademarksisprotectionism,whichprohibitstheuseofanyproductsonthesameorwiththewell-knowntrademarksSimilartothetrademark.

TRIPSAgreementArticle16,paragraph3states:

ParisConvention1967text,inprinciple,applicabletothewell-knowntrademarksandlogosofthecommoditiesorservicesarenotsimilargoodsorservices,ifnotsimilargoodsorservicesontheuseofthetrademarkwillbeSuggestthatthegoodsorserviceswiththewell-knowntrademarksonalinkexists,sothattheinterestsofallwell-knowntrademarksmaybeimpaired.

Third,thewell-knowntrademarksdiluted

Theprotectionoftrademarkrights,therearemainlytwo:

onefortheconfusiontheory,atheoryfordesalination.

Themaintraditionaltrademarkprotectionfortrademarksthedifferencebetweenfunctionaldesign,anditstheoreticalbasisforthetheoryofconfusion.Insummary,whichistoensurethatthetrademarkcanbeidentification,confirmationanddifferentgoodsorservicesdifferentfromthesignificantfeatures,toavoidconfusion,deceptionandEWu,thelawgivesfirstuseofapersonorpersonsregisteredwithexclusiverights,whichprohibitsanyWithoutthepermissionoftherightstousemaycauseconfusionamongconsumersinthesameorsimilartrademarks.Clearly,thetraditionalconceptoftrademarkprotection,tostop"

isthecoreoftrademarkprotection.

Withthesocio-economicdevelopmentandcommercializationofthecontinuousimprovementofthedegree,well-knowntrademarksbytheenormousimplicationforthegrowingcommercialvaluehaveattractedtheattentionofpeople.Comparedwithordinarymarks,bearingwell-knowntrademarksbythesignificanceandmeaningbeyondthetrademarkrightstothegeneral,andfurthersymbolofproductqualityandcredit,containsamorevaluablebusinessassets-goodwill.Well-knowntrademarkrightsofpeopletouseitsexcellentreputationofleadingthewayinthepurchasingpower,insteadoftheuseoftrademarkstodistinguishbetweendifferentproductsandproducers.

Whenthemarkbeyondtheroleofthisfeaturetoavoidconfusion,then,thisfactorisobviouslyconfusedandcannotcovereverything,andotherfactorsbecomeasimportantasormoreimportant.Thus,intheoryconfusiononthebasisoffurtherdevelopmentofdesalinationtheory.

referstodiluteorweakengraduallyweakenedconsumerorthepublicwillbetrademarksofthecommercialsourceswithaspecificlinkbetweentheability."

TrademarkfadedandthatthemaintheoryisthatmanymarketoperatorshaveUsingwell-knowntrademarksofthedesireofothers,engageinwell-knowntrademarksshouldbetopreventothersfromusingitsownuniqueidentificationofspecialprotection.

wrotethefirsttrademarkdilutetheory.Hebelievesthatpeopleshouldnotonlybetrademarksofothersprohibittheuseofthemark,hewillcompeteinthecommodity,andshouldprohibittheuseofnon-competitivegoodson.Hepointedout:

therealroleoftrademarks,notdistinguishbetweengoodsoperators,butsatisfiedwiththedegreeofdifferencebetweendifferentcommodities,soastopromotethecontinuousconsumerpurchase.Fromthebasicfunctionoftrademarks,trademarkusedinnon-competitivegoods,theirsatisfactionwithregardtothedistinctionbetweentheroleofdifferentcommoditieswillbeweakenedandwatereddown.Trademarksofthemoresignificantorunique,tothepublictheimpressionthatthemoredeeply,thatis,shouldberestrictedtonon-competeothersintheuseofgoodsorservices.

SiKaiteinaccordancewiththetheoryofwell-knowntrademarkshavefadedbecauseoftheeffectofnon-rightsholderswithwell-knowntrademarksinthepublicmindthegoodimageofwell-knowntrademarkswillbeusedinnon-competitivegoods,soastograduallyweakenorreducethevalueofwell-knowntrademarks,Thatis,bythewell-knowntrademarkshavecredibility.Trademarktagismoresignificantoruniquecharacteristics,whichinthepublicmindtheimpressionthatthemoredeep,moreistheneedforincreasedprotection,topreventthewell-knowntrademarksandtheirspecificgoodswasthelinkbetweentheweakeningordisappearance.

Inpractice,trademarksdilutedshareawiderangeofoperatingmethods,suchas:
