GeneralProvisions
Article1ThisLawisformulatedinaccordancewiththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflabourers,regulatelabourrelationship,establishandsafeguardalaboursystemsuitedtothesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.
Article2ThisLawshallapplytoenterprises,individualeconomicorganizations(hereinafterreferredtoasemployingunits)andlabourerswhoformalabourrelationshiptherewithwithintheterritoryofthePeople'
sRepublicofChina.
Stateorgans,institutionsandpublicorganizationsaswellaslabourerswhoformalabourcontractrelationshiptherewithshallbeboundbythisLaw.
Article3Labourersshallhaveequalrighttoemploymentandchoiceofoccupation,therighttoremunerationforlabour,torestandvacations,toprotectionofoccupationalsafetyandhealth,totraininginvocationalskills,tosocialinsuranceandwelfare,tosubmissionoflabourdisputesforsettlementandotherrightsrelatingtolabourstipulatedbylaw.
Labourersshallfulfilltheirlabourtasks,improvetheirvocationalskills,followrulesonoccupationalsafetyandhealth,andobservelabourdisciplineandprofessionalethics.
Article4Theemployingunitsshallestablishandperfectrulesandregulationsinaccordancewiththelawsoastoensurethatlabourersenjoytherighttoworkandfulfilllabourobligations.
Article5TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,laydownlabourstandards,regulatesocialincomes,perfectsocialinsurancesystem,coordinatelabourrelationship,andgraduallyraisethelivingstandardoflabourers.
Article6TheStateshalladvocatetheparticipationoflabourersinsocialvoluntarylabourandtheunfoldingoflabouremulationandrationalproposalscampaign,encourageandprotectlabourersinconductingscientificresearch,technicalrenovation,inventionsandcreations,andcommendandrewardmodelandadvancedworkers.
Article7Labourersshallhavetherighttoparticipatein,andorganize,tradeunionsinaccordancewiththelaw.
Tradeunionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflabourers,andindependentlycarryouttheiractivitiesinaccordancewiththelaw.
Article8Labourersshalltakepartindemocraticmanagementornegotiatewiththeemployingunitsonanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflabourersthroughtheassemblyofstaffandworkersortheircongressorotherformsasprovidedbylaw.
Article9TheadministrativedepartmentoflabourundertheStateCouncilshallbeinchargeofthemanagementoflabourinthewholecountry.
Theadministrativedepartmentsoflabourunderthelocalpeople'
sgovernmentsatorabovethecountylevelshallbeinchargeofthemanagementoflabourintheirrespectiveadministrativeareas.
ChapterII
PromotionofEmployment
Article10TheStateshallcreateconditionsforemploymentandincreaseopportunitiesthereforebymeansofpromotionofeconomicandsocialdevelopment.
TheStateshallencourageenterprises,institutionsandpublicorganizationstoinitiateindustriesorexpandbusinessesfortheincreaseofemployment,withinthescopeprovidedbylaws,andadministrativerulesandregulations.
TheStateshallsupportlabourerstoachieveemploymentbyorganizingthemselvesonavoluntarybasisorbyengaginginindividualbusinesses.
Article11Localpeople'
sgovernmentsatvariouslevelsshalltakemeasures,bydevelopingemploymentagenciesofvariousforms,toprovideemploymentservices.
Article12Labourers,regardlessoftheirethnicgroup,race,sex,orreligiousbelief,shallnotbediscriminatedagainstinemployment.
Article13Womenshallenjoytheequalright,withmen,toemployment.WithexceptionofthespecialtypesofworkorpostunsuitabletowomenasprescribedbytheState,nounitmay,inemployingstaffandworkers,refusetoemploywomenbyreasonofsexorraisetheemploymentstandardsforwomen.
Article14Inrespectoftheemploymentofthedisabled,peopleofminorityethnicgroups,anddemobilizedarmymen,wheretherearespecialstipulationsinlaws,rulesandregulations,suchstipulationsshallapply.
Article15Noemployingunitsareallowedtorecruitminorsundertheageof16.
Institutionsofliteratureandart,physicalculture,andspecialartsandcraftsthatrecruitminorsundertheageof16mustgothroughtheformalitiesofexaminationandapprovalinaccordancewiththerelevantprovisionsoftheStateandguaranteetheirrighttocompulsoryeducation.
ChapterIII
LabourContractsandCollectiveContracts
Article16Alabourcontractisanagreementthatestablishesthelabourrelationshipbetweenalaborerandanemployingunitanddefinestherightsandobligationsofrespectiveparties.
Alabourcontractshallbeconcludedwherealabourrelationshipistobeestablished.
Article17Conclusionandmodificationofalabourcontractshallfollowtheprinciplesofequality,voluntarinessandagreementthroughconsultation,andshallnotruncountertothestipulationsoflaws,administrativerulesandregulations.
Alabourcontractonceconcludedinaccordancewiththelawshallbelegallybinding.Thepartiesmustfulfilltheobligationsstipulatedinthelabourcontract.
Article18Thefollowinglabourcontractsshallbeinvalid:
(1)Labourcontractsviolatinglaws,administrativerulesandregulations;
and
(2)Labourcontractsconcludedbymeansoffraudorintimidation,etc.
Aninvalidlabourcontractshallhavenolegaleffectfromthetimeofitsconclusion.Whereapartofalabourcontractisconfirmedasinvalidandwherethevalidityoftheremainingpartisnotaffected,theremainingpartshallremainvalid.
Theinvalidityofalabourcontractshallbeconfirmedbyalabourdisputearbitrationcommitteeorapeople'
scourt.
Article19Alabourcontractshallbeconcludedinwrittenformandcontainthefollowingclauses:
(1)Termofalabourcontract;
(2)Workassignment;
(3)Labourprotectionandworkingconditions;
(4)Labourremuneration;
(5)Labourdiscipline;
(6)Conditionsfortheterminationofthelabourcontract;
(7)Liabilitiesfortheviolationofthelabourcontract.
Apartfromtherequiredclausesspecifiedintheprecedingparagraph,alabourcontractmaycontainotherclausesagreeduponbythepartiesthroughconsultation.
Article20Thetermofalabourcontractisclassifiedintofixedterm,non-fixedtermandthecompletionofaspecificassignmentasaterm.
Wherealabourerhasworkedinthesameemployingunitfortenconsecutiveyearsormoreandbothpartiesagreetoextendthetermofthelabourcontract,ifthelabourerrequeststheconclusionofalabourcontractwithanon-fixedterm,alabourcontractwithanon-fixedtermshallbeconcluded.
Article21Aprobationperiodmaybespecifiedinalabourcontract.Theprobationperiodshallnotexceedsixmonths.
Article22Thepartiestoalabourcontractmaystipulateinthelabourcontractmattersconcerningkeepingbusinesssecretsoftheemployingunit.
Article23Alabourcontractshallterminateimmediatelyupontheexpirationofitstermortheoccurrenceoftheconditionsfortheterminationofthelabourcontractasagreeduponbytheparties.
Article24Alabourcontractmaybecancelledbyagreementreachedbetweenthepartiesthroughconsultation.
Article25Ifalabourerisunderanyofthefollowingcircumstances,theemployingunitmaycancelthelabourcontractwithhim:
(1)Havingbeenprovednotuptotherequirementsforrecruitmentduringtheprobationperiod;
(2)Havingseriouslyviolatedlabourdisciplineortherulesandregulationsoftheemployingunit;
(3)Havingcausedgreatlossestotheemployingunitthroughgrossneglectofdutyormalpracticeforpersonalgains;
(4)Havingbeeninvestigatedforcriminalresponsibilityinaccordancewiththelaw.
Article26Inanyofthefollowingcircumstances,theemployingunitmaycancelthelabourcontract,however,awrittennoticeshallbegiventothelabourerconcerned30daysinadvance:
(1)Wherealabourerisunabletotakeuphisoriginalworkoranyworkspeciallyarrangedbytheemployingunitaftercompletionoftheperiodofhismedicaltreatmentforillnessornotwork-relatedinjury;
(2)Wherealabourerisunqualifiedforhisworkandremainsunqualifiedevenafterreceivingatrainingorafterreadjustingtheworkpost;
(3)Wheretheobjectiveconditionstakenasthebasisfortheconclusionofthecontracthavechangedsogreatlythattheoriginallabourcontractcannotbecarriedout,andnoagreementonmodificationofthelabourcontractcanbereachedthroughconsultationbytheparties.
Article27Whereitisreallynecessaryforanemployingunittocutdownthenumberofworkforcewhenitcomestothebrinkofbankruptcyandundergoesastatutoryconsolidationorrunsdeepintodifficultiesinproductionand
