二、租期:
TermofTenancy:
2.1甲方委托中介就提供订立房屋租赁合同的中介方服务。
租赁期为24个月,自年月日起至年月日止。
PartyAentrustpartBherebytolease,andcontrastthisleaseAgreement。
Theabovepropertyisherebyleasedforatermof__,commencingon_andexpiringon。
在租期开始,出租房屋及其家俱电器应已装修或安装布置完毕,处于可供租赁的良好状态。
如因装饰布置的原因,甲方每推迟1目交房,则应推迟2日为租赁期满,以此累计。
Theabovepropertyanditsequipmentandfurnitureshallbefullyrenovatedorinstalledandin
tenantableconditionbeforethecommencementofthelease.
2.2租期届满,甲方有权收回出租房屋及全部家俱、电器(包括附件所列所有家具、设备),
乙方亦应如期交还;
乙方如要求续租,则享有优先续租权,但必须在本租约期满前二个月向甲方提出书面申请。
Onexpiryofthislease,PartyAhastherighttotakebacktheleasedproperty(includingallthefurniture,fittingsandequipmentlistedinAppendix)infull,andPartyBmustdelivertheleasedpropertyonthedateofexpiry.IfPartyBwishestoextendthelease,PartyBshallhavetheprioritytorenewtheleasewithtwomonthsadvancewrittennoticetoPartyA.
三、租金:
Rent:
3.1租金每月为人民币元,包括家具、电器(见附件二)和物业管理费在内,该_____元为交给甲方的净收入,税收和开票归乙方承担和办理。
TherentisRMB5800.00permonth,includingfurniture,electricalappliances(SeeappendixII)andthemanagementfee.
3.2租金支付方式:
三个月一付,先付后住。
乙方应在到期日的10天前把租金付到甲方帐户上。
Paymentmethod:
PartyBmustpaytherenteverythreemonth.AndpartyBmustpaytherent10daysbeforetheexpirydate.
3.3租金款以人民币支付,
TherentshallbepaidinRMB.
在本租约有效期内,租金不予调整。
TherentcannotbeadjustedduringthetermofthisTenancyAgreement.
四、押金:
Deposit:
自本租约签订之日起,乙方应向甲方缴付相当于一个月租金额的租赁押金计人民币_______元。
租约期满,乙方如不再续租,甲方应在租赁期结束后1个月内(在乙方将全部水,电,煤气费和空调费等杂费及电话费付清后)将押金退还(不计利息)。
AftersigningofthisTenancyAgreement,PartyBshallpaytoPartyAonemonthrentasdeposit,whichisequivalenttointotal.Oncompletionofthetenancyperiod,ifPartyBwillnotcontinuetorenttheleasedproperty,PartyAmustreturnthedepositinfulltoPartyB(withoutinterest)withintendaysaftertheterminationoftheLeaseAgreementundertheconditionthatPartyBhaspaidalltheoutstandingutilitiesfeesuchaswater,electricity,gas,air-conditioningfeeandtelephonebill.Ifsuchoutstandingutilitiesfeecouldnotbesettledbecauseoflimitationoftheaccountduedate,PartyAhastherighttokeeppartofthedepositandpaybackthisparttoPartyBaftertheoutstandingutilitiesfeesettled.Howeverthekeptpartofdepositshouldbelimitedtoasmuchastwiceofthepreviousaccountperiod.
4.1如因甲方原因而终止租约的(不可抗力除外),则双倍退还押金后终止租约。
在租赁期内,如因乙方原因而终止租约(不可抗力除外),押金不予退还。
IfPartyBterminatestheTenancyAgreementduringtheleasetermforreasonsotherthanForceMajeure,thepaiddepositwillnotberefunded.
4.2甲方因乙方违反本合同的规定而受的损失,可在保证金中扣抵合理数目,在甲方作
出该种扣抵前,需通知乙方将被扣抵的金额和理由,乙方有权拒绝不合理或不公正的抵扣,不足部分乙方必须在接到甲方付款通知后10天内补足。
PartyAmaydeductareasonableamountfromthesecuritydeposittowardspaymentofanyactual
damagesPartyAmayhaveincurredorsufferedasaresultofPartyB'
sbreachofthisAgreement.Prior
tomakingsuchdeductions,PartyAshallinformPartyBoftheamountwhichitintendstodeductand
thereasonformakingsuchdeductions.PartyBshallbeentitledtoobjecttosuchdeductionsifPartyB
believesthatsuchdeductionsareunreasonableorunjustified.Ifthesecuritydepositisnotsufficientto
coversuchamounts,PartyBmustpaythedeficiencywithinten(10)daysofthereceiptofademand
fromPartyA.
4.3押金以人民币支付,甲方收到押金后,向乙方开具收据。
ThedepositshallbepaidinRMB.PartyAshallissueanofficialreceiptonthereceiptofdeposit.
五、中介服务佣金
5.1甲方委托中介就,提供订立房屋租赁合同的中介方服务。

5.2中介服务费承担支付,共计人民币元,其中甲方承担元乙方承担元。

5.3中介方应对甲乙双方的相关信息及租赁情况负有向他人保密的义务。

六、其它费用:
OtherCharges:
6.1乙方在租赁期内所用的水、电、煤气,管理公司每月按实际耗用量结算,乙方按单缴付。
Duringtheperiodoftenancy,PartyBshallpaymonthlyallchargesforusageofwater,electricityandgasbasedontheactualconsumptionamountbillingfromthemanagementoffice.
6.2乙方所用电话,按电信局标准收费,每月根据实际用量结算,乙方按单缴付。
AlltelephonechargesshallbepaidbyPartyBandbasedontheactualusageaccordingtothe
TelecommunicationBureaustandardtariffsonreceiptofthebills
6.3宽带的一切费用,有线电视和卫星电视使用费,由乙方支付。

七、甲方的责任:
Landlord’sResponsibilities:
7.1甲方应督促管理公司向乙方提供足够的服务,如冷水,热水,电的供应及各种设备的正常工作。
ToensurethattheestatemanagementofficetoprovidesufficientandtimelyservicetoPartyB,suchassupplyofcoldwater,hotwater,electricityandtoensurethepropermaintenanceofallkindsofequipment.
7.2甲方应负责租赁期内房屋及其设备的正常维修,并承担维修房屋及设备的正常磨损而
产生的费用。
PartyAshallresponsibleforallnormalmaintenanceofleasedpropertyandequipmentduringthetermoflease,andPartyAshallbearallmaintenancecharges.
7.4甲方应对甲方的固定设施,包括该物业的或引入该物业的结构、屋顶、管道设施、排
污、管道和缆线(包括电力及电话)等进行维护,使之处于完好、可租赁状态;
如若是乙方的原因使之出现故障,则由乙方负责。
TomaintainandkeepPartyA’sfixtures,includingthestructure,roof,sanitaryandplumbingfacilities,drains,pipesandcables(includingelectricityandtelephone)ingoodleasingcondition.PartyAshouldpromptlyrepairorremedyanydefectsthereinafterbeingnotifiedofsuchdefectbyPartyB,providedallsuchdefectsarenotasaresultofthePartyB’s,oritsassistant’snegligentaction,omissionormisconduct.PartyAshallenterthesaidpremisestodothenecessaryrepairsormaintenanceatreasonabletimeandwithadvancednoticetothePartyB.IfPartyAfailstorepairthesaidpremiseincomplywiththedemandissuedbyPartyBtorectifyitwithinseven(7)daysafterreceiptofsuchdemand,PartyBshallbeentitledtoissueawrittennoticetoPartyAtoterminatethisAgreement,andthesecuritydepositpaidbyPartyBshallbereturnedinfulltoPartyB.
7.5甲方谨在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋于
乙方。
PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.
八、乙方责任:
Tenant’sResponsibilities:
8.1乙方应按本租约第三、五条约定,按期交纳租金及其他费用,如出现迟延支付的情形,
则甲方有权以乙方已付押金抵付;
若其已付押金不足以抵付,则甲方有权按4.4条的约定要求乙方限期补足(押金及其他应付款项);
若超过限定期限30天,乙方仍未支付的,则甲方有权解除本租约。
PartyBshouldpromptlypaytherent,depositandotherchargesassetoutinClauses3and5oftheAgreement.IntheeventthatPartyBfailstopaytherentandanyofthechargesaccordingtothetimelimitandmethodsasspecifiedinthisAgreement,PartyAhastherighttodeductfromthedepositforsuchlossesanddamagessufferedandexpensesincurred.Whenthedepositisinsufficientforreasonsherein,PartyAhastherightinaccordancetoClause4.4,requestPartyBtomake-upthedeposittofullamountwithinthetimelimit.IfPartyBfailstobringupthedeposittothefullamountforoverthirty(30)daysafterthetimelimit,PartyAhastherighttoterminatethisAgreement.
8.2本租约签订后,若乙方未按本租约的约定支付租金及押金,甲方有权解除本租约,同时有权向乙方索取相当于一个月租金金额的赔偿金,而无需提前通知乙方。
IntheeventthatPartyBfailstopaytherentanddepositaccordingtothestipulationofthisAgreement,
PartyAisentitledtoterminatethisAgreementwithoutpriornotice,andatsametimePartyBshouldpayonemonthrentaltoPartyAascompensation.
8.3租赁期内未经甲方同意,乙方不能转让其所租房屋,私自转让无效。
DuringtheperiodofTenancy,unlesswiththeagreementofPartyA,PartyBcannotsub-letorletinpartorinfulltheleasedproperty.
8.4乙方应爱护房屋及其设备,如因使用不当而导致损坏,乙方应负责赔偿。
PartyBmusttakegoodcareofthepropertyanditscontents,otherwisePartyBshouldpaycompensationtoPartyAforhisimproperuseoftheproperty.
8.5除房内已有的装饰和设施之外,乙方如要增加设备或其他装修须征得甲方同意。
租赁期
满,乙方向甲方交还房产时,必须恢复其原状(正常磨损除外),且承担相应的费用。
Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsordecorationtosuchproperty,PartyBshouldgettheconsentofPartyA.OncompletionoftheLease,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition(exceptfornormalwear&
tear)andallfeesarisingforre-instatementofsuchshallbebornebyPartyB.Inthisrespect,theconsenttohanguppicturesonthewallsisalreadygivenbyPartyA.
8.6由于乙方或与乙方有关系的官员、上司、雇员、客人、来访者、雇佣工人、代理、执照
持有者或被邀请人等(统称与乙方相关的人)的粗心、疏忽或故意而造成房屋的损害或损失的,乙方应当承担赔偿责任,并允许甲方或其代理人在事先通知后进入房屋,对房屋的损失或损害进行弥补及修复,由此所发生的费用由乙方负担。
ToindemnifyPartyAforanylossordamagestotheleasedpropertyfromnegligentactoromissionofPartyBoranyofficer,director,employee,guest,visitor,servant,agentlicenseeorinviteeofPartyB(eachreferredtohereinafterindividuallyasan“associate”),topermitPartyAorhisauthorizedrepresentativeswithadvancenoticetoentertheleasedpropertytorepairanysuchlossordamageattheexpenseofPartyB.
8.7在甲方合理的预先通知后,乙方应允许甲方或其代理人在有理由的情况下进入及巡视房
屋,进行必要的维修或修复工作;
在租赁期最后二个月内,允许甲方或其代理人带领有意租赁或购买房屋的客人视察房屋,但乙方已按第2.3条书面通知甲方将续租的除外。
WithPartyA’sreasonablenoticeinadvance,PartyBshouldpermitPartyAandpersonauthorizedbyPartyAunderreasonablecircumstancestoenterandviewtheleasedproperty,tocarryoutanyworkandrepairswhichisdeemednecessary.DuringthelastonemonthoftheAgreement,PartyAhastherighttoshowtheleasedpropertytoprospectivetenantsorpurchasers,unlessaccordingtoclause2.2,PartyBha
