Article1TheCivilProcedureLawofthePeople’sRepublicofChinaisformulatedaccordingtotheConstitutionandinthelightoftheexperienceandactualconditionsofadjudicatingcivilcasesinourcountry.
Article2ThepurposesoftheCivilProcedureLawofthePeople’sRepublicofChinaaretoprotectthelitigationrightsexercisedbytheparties,toensurethatthepeople’scourtsfindfacts,todistinguishrightfromwrong,toapplythelawcorrectly,totrycivilcasespromptly,toaffirmtherightsandobligationsincivilaffairs,toimposesanctionsforcivilwrongdoings,toprotectthelawfulrightsandinterestsoftheparties,toeducatecitizenstovoluntarilyabidebythelaw,tomaintainthesocialandeconomicorder,andtoguaranteethesmoothprogressofthesocialistconstruction.
Article3TheprovisionsofthisLawshallapplytoallthecivillitigationacceptedbypeople’scourtsregardingdisputesoverthestatusofpropertyandpersonalrelationsamongcitizens,legalpersons, or otherorganizationsrespectivelyandmutuallybetweencitizens,legalpersons, or otherorganizations.
Article4AllthosewhoinvolveincivillawsuitswithintheterritoryofthePeople’sRepublicofChinamustabidebythisLaw.
Article5Foreignnationals,statelesspersons,foreignenterprises, or organizations,whichinitiate or respondtolawsuitsinpeople’scourts,shallhavethesamelitigationrightsandobligationsasthecitizens,legalpersons, or otherorganizationsofthePeople’sRepublicofChina.
Shouldthecourtsofaforeigncountryimposerestrictionsonthecivillitigationrightsofthecitizens,legalpersons, or otherorganizationsofthePeople’sRepublicofChina,thepeople’scourtsofthePeople’sRepublicofChinashallfollowtheprincipleofreciprocityregardingthecivillitigationrightsofthecitizens,enterprises, or organizationsofthatforeigncountry.
Article6Theadjudicationauthorityovercivilcasesshallbeexercisedbythepeople’scourtsonly.
Thepeople’scourtsshalladjudicatecivilcasesindependentlyaccordingtolaw,andshallnotbesubjecttoanyinterferencefromanadministrativeorgan,publicorganization, or individual.
Article7Thepeople’scourtsmusttakethefactsasthebasisandtakethelawasthecriterionwhenadjudicatingcivilcases.
Article8Allpartiestoacivillitigationshallhaveequallitigationrights.Thepeople’scourtsshall,whenadjudicatingcivilcases,guaranteeandfacilitateallpartiestoexercisetheirlitigationrights,andapplythelawequallytoallparties.
Article9Whenadjudicatingcivilcases,thepeople’scourtsmaymediatethedisputesaccordingtotheprinciplesofvoluntarinessandlawfulness;ifamediationagreementcannotbereached,thecourtsshallrenderjudgmentswithoutdelay.
Article10Whenadjudicatingcivilcases,thepeople’scourtsshallapplythesystemsofcollegialpanel,recusal,publictrial,and“twotrialsandthesecondoneisfinal”.
Article11Chinesecitizensofallethnicitiesshallhavetherighttousetheirnativespokenandwrittenlanguagesincivilproceedings.
Intheareaswhereanethnicminorityisconcentrated or anumberofdifferentethnicnationalitieslivetogether,thepeople’scourtsshallconducthearingsandpublishlegaldocumentsinthespokenandwrittenlanguagescommonlyusedbythesepeople.
Thepeople’scourtsshallprovidetranslationsforanylitigationparticipantswhoarenotfamiliarwiththespoken or writtenlanguagescommonlyusedbythelocalpeople.
Article12Whenadjudicatingcivilcasesbythepeople’scourt,thepartiesshallhavetherighttoengageinargument.
Article13Thepartiestoacivillitigationshallbeentitled,withinthescopestipulatedbylaw,todisposetheirrightsofcivilaffairsandlitigation.
Article14Thepeople’sprocuratoratesshallhavetherighttoexerciselegalsupervisionoverthecivilproceedings.
Article15Ifthecivilrightsandinterestsofthestate,acollective, or anindividualhavebeeninfringed,astateorgan,publicorganization,enterprise, or institutionmaysupporttheinjuredunit or individualtoinitiatelegalactioninapeople’scourt.
Article16ThePeople’sConciliationCommitteesaretheorganizationsformasstomediatecivildisputesderivedfromprivatecitizensundertheguidanceofbasicpeople’sgovernmentsandthebasicpeople’scourts.
ThePeople’sConciliationCommitteesshallconductallmediationsaccordingtolegalprovisionsandtheprincipleofvoluntariness.Allconcernedpartiesshallenforcemediationagreement.Whereanyconcernedpartiesrefusemediation,failtoreachamediationagreement, or retractamediationagreement,theymayinitiatelegalproceedingsinapeople’scourt.
IfaPeople’sConciliationCommitteeviolatesthelawwhenmediatingcivildisputes,thepeople’scourtshallcorrectit.
Article17Thepeople’scongressesofthenationalautonomousareasmayformulatesomeaccommodating or supplementaryprovisionsaccordingtotheprinciplesoftheConstitutionandthisLawandbasedonthespecificcircumstancesoftheirlocalities.SuchprovisionsmadebyanautonomousregionshallbesubmittedtotheStandingCommitteeoftheNationalPeople’sCongressforapproval.Theprovisionsmadebyanautonomousprefecture or autonomouscountyshallbesubmittedtothestandingcommitteeofthepeople’scongressoftherelevantautonomousregion or provinceforapprovalandtotheStandingCommitteeoftheNationalPeople’sCongressfortherecord.
Chapter2Jurisdiction
Section1JurisdictionbyLevelsofCourts
Article18Abasicpeople’scourtshallhavejurisdictionasthecourtoffirstinstanceovercivilcases,unlessotherwisestipulatedinthisLaw.
Article19Anintermediatepeople’scourtshallhavejurisdictionascourtsoffirstinstanceoverthefollowingcivilcases:
（1）Majorcasesinvolvingforeignelements;
（2）Casesthathavemajorimpactsintheareaofitsjurisdiction;and
（3）Casesunderthejurisdictionoftheintermediatepeople’scourtsasdeterminedbytheSupremePeople’sCourt.
Article20Ahigherpeople’scourtsshallhavejurisdictionasthecourtoffirstinstanceovercivilcasesthathavemajorimpactsontheareasofitsjurisdiction.
Article21TheSupremePeople’sCourtshallhavejurisdictionasthecourtoffirstinstanceoverthefollowingcivilcases:
（1）Casesthathavemajorimpactsonthewholecountry;and
（2）CasesthattheSupremePeople’sCourtdeemsshouldbeadjudicatedbyitself.
Section2TerritorialJurisdiction
Article22Acivillawsuitbroughtagainstacitizenshallbeunderthejurisdictionofthepeople’scourtlocatedintheplacewherethedefendanthashisdomicile;ifthedefendant’sdomicileisdifferentfromhishabitualresidence,thelawsuitshallbeunderthejurisdictionofthepeople’scourtlocatedintheplaceofhishabitualresidence.
Acivillawsuitbroughtagainstalegalperson or anorganizationshallbeunderthejurisdictionofthepeople’scourtlocatedintheplacewherethedefendanthasitsdomicile.
Wherethedomiciles or habitualresidencesofseveraldefendantsinthesamelawsuitareintheareasunderthejurisdictionoftwo or morepeople’scourts,allofthosepeople’scourtsshallhavejurisdictionoverthelawsuit.
