Therentalwillbe RMBpermonth(PartyBshallpayforthemanagement andgarbagecollectionofthecommunity).Article4:
Paymentofrentalwillbeoneinstallmenteverysixmonths.Fromtheeffectivedate
ofthecontract,PartyBshouldpaythefirstinstallmentof yuan to PartyAinadvance.Eachsuccessiveinstallmentshallbepaid10daysbeforetheendoftheterm.Therentalshouldbepaidintheformofcash.PartyBshallpayPartyAadepositof yuanwiththefirstinstallment.PartyAwillissueawrittenreceiptafterreceivingthepaymentandthedeposit.Afterthecontractexpired,PartyAshallrefund thedepositinfullamountwithoutinteresttoPartyBifthepremiseisingood condition;
ifdamaged,theoriginalpriceshallbedeductedaccordingtotheactualextentofdamageorthevalueofthedamagedgoods,PartyBshallfilltheinsufficient. Article5:
PartyBwillbearthecostofutilities such as gas, water, electricity, heating,telephone communications, cable TV and networkusagechargesandsecurityfeeson timeduringtheleaseterm.Article6:
Duringtheleaseterm,PartyBshall not sublease the house to a third party,otherwise,PartyAshallhavetherighttounilaterallyterminatethe contractandrecoverthehousing,andPartyB'
sbreachofcontractcanbeinvestigated.Article7:
Duringtheleaseterm,PartyAshallberesponsible
for normal maintenance of the housing, orcommissioned by the lessee to act as repair,maintenancecostsarebornebyPartyA.PartyAshallensurethatthehousingcanmeetthenormaluseandresidentialneedsofPartyB.Article8:
Duringtheleaseterm,ifthepremise hadsomedamagenotcausedbyParty B,suchasthenaturaldamageorman-madedamage,orroofleakage,affectingnormallifeofPartyB,PartyAshallberepairthedamagewithinsevendaysfromthedateofreceivingthenoticefromPartyB.IfmorethansevendaysPartyBhastherighttorepairitself,andtherepairexpensesshouldbebornebyPartyA.
Article9:
Duringtheleaseterm,ifPartyAdoesneedtotakebackthehouseforself-occupation,PartyAmustgiveawrittennoticetoPartyBonemonthinadvance.Aftertheterminationofthecontract,PartyAshallpaypenaltytoPartyBwhich accountfor5%ofthetotalrentaloftheremainingleaseterm.Article10:
IfPartyBneedstoreturnthepremiseduringtheleaseterm,awrittennoticeshouldbegiventoPartyAonemonthinadvance.The two parties agree to terminate the
contractthroughconsultation.PartyBshallpaypenaltytoPartyAwhichaccountfor5%ofthetotalrentaloftheremainingleaseterm.Article11:
PartyBchangethestructureanduseofthehousingwithoutapprovalofPartyA,causedamagetotherentedhousingandequipment intentionally or negligently, shall beresponsible for restitution or compensation foreconomiclosses. IfPartyBwantstodecoratewall,installwindowsandsecuritydoors,mustobtain priorapproval from Party A. Article 12:
The interiordecorationandtheinstallationofequipment,itemsattachto PartyBcanbetransferredtoPartyAinadiscountwhenthecontractexpires.Ifthetwopartiescannotreachanagreement,PartyBshallremovethemwithinsevendaysfromthedateofterminationofthecontract.Formorethansevendays,PartyAshallhavethe right to retain free of charge or remove bythemselves,thecostofremovalshallbearbyPartyBinareasonableamount.Article13:
Earlyterminationofthecontractorafterthecontractexpiresaccordingtothecontract,PartyBshallmoveoutofallequipmentand items within fifteendaysfromthedateof
receivingaformalwrittennoticefromPartyA,unlessthetwoparties haveotherconsultation.IfPartyBdoeshavedifficultiesinfindinganotherhouseinshorttermorotherspecialcircumstances,PartyAshallallowPartyBanextensionof30days,however,PartyBshallpaytheentirerentalwhichthecontractsetatonetime.IfthereisstillbelongingsleftbyPartyBaftersevendays of the removal, it will be deemed to beabandonedbyPartyBandPartyAhastherighttodispose it , unless the two parties have otheragreementArticle14:
IfPartyBfailstomoveafterleaseexpirationorterminationofthecontract,PartyBshall compensateforPartyA the economiclosses.Article 15:
Within one month before the contractexpires,PartyBwillnotifyPartyA ifitintendstoextendtheleasehold.Afterreceivingthewrittennotice,PartyAcanraiseanobjectionordiscussmattersovertheextensionwithPartyBwithin30days. IfPartyAdoesnotgiveawrittenreplytoPartyBduringthe30days,itwillbedeemedtogivetacitconsenttorenewthepremise.Thiscontractisautomatically extendedforoneyear,fromthenextdayoftheexpirationof30
days.Article16:
Anydisputearisingfromthecontractorinconnectionwiththecontract shouldbesettledthroughfriendlydiscussionbetweenthetwoparties.Ifnosettlementcanbereachedthroughdiscussion,bothpartiesshallhaverighttosuewiththepeople’scourt,whichhasjurisdictionoverthematter.Article17:
Thiscontractshallgointoeffectthemomentitissignedbybothpartiesandshallabidebytheadministrativelawsandregulations.Article18:
IfPartyBdelayssuchrentalpayment,theinterestwouldbeimposedon overdueaccountatadailyrateof20%ofmonthrental.IfPartyBstilldelaysinthe
excessoftenworkingdays,partyAshallterminatethecontractunilaterallyandhastherighttotakebackthepremise.PartyBshallbeinvestigatedforbreachofthecontract.Article19:
Thiscontractismadeof4copiesandeachpartywillhold2copieswhichshallhavetheequallegalbindings.Article20:
IfPartyAorPartyBhasanyspecificmatters,itmaybeagreeduponby bothpartiesinthisseparateclause.Supplementaryprovisionsoftheagreementhavethesameeffect.Article21:
Thiscontractwillbeeffectiveafterbeingsignedbyboth
