1.I/We,theundersigned,knowthattheBank’sGeneralAgreementforAccountOpening（the“Agreement”）isontheBank’swebsite,andherebyrepresentthatI/WehavereadtheAgreementforaperiodofatleast5daysandfullyunderstoodandagreetobeboundbyalltermsandconditionsoftheAgreement.

立约人已知悉贵行将开户总约定书置于贵行网页，并声明开户总约定书业经立约人于合理期间（五日以上）审阅，已完全了解开户总约定书内容，且同意与贵行各项业务往来时，将遵守开户总约定书公告之各项约定。

2.I/Weandmy/ourresponsibleofficer,agreethattheBankmayinquiremy/ourinformationfromJointCreditInformationCenter（JCIC）.

立约人同意授权贵行得向财团法人金融联合征信中心查询立约人及负责人之账户数据。

3.My/Ourresponsibleofficer,herebyconfirmandacknowledgethatthetermsofNotificationofPersonalInformationProtectionsetforthintheAgreementhavebeenunderstoodandaccepted.

立约人之负责人已知悉贵行网页公告之开户总约定书个人数据运用告知事项。

本申请书以中英文书写而成,若中、英文义有任何歧异或不一致之处,应以中文版本为主。

ConsideringconfidentialityofthecollectionoftheCustomer’spersonalinformation,accordingtoArticle8,paragraph1ofthePersonalInformationProtectionActofTAIWAN（hereinafterreferredtoasthe“PIPA”）（ifindirectlycollectaccordingtoArticle9,paragraph1ofthePIPA）,theBankshallclearlyinformtheCustomerfollowingissues：

由于个人资料之搜集，涉及立约人的隐私权益，贵行向立约人搜集个人资料时，依据个人数据保护法（以下称个资法）第八条第一项（如为间接搜集之个人资料则为第九条第一项）规定，应明确告知立约人下列事项：

Name,I.D.cardnumber,gender,dateofbirth,contactinformation,accountinformation,transactioninformationandotherinformationdetailedintherelevantapplications,agreements,contract,orfromthebusiness,accountsorservicesprovidedtotheCustomerorfromthirdparties.（e.g.,theJointCreditInformationCenter）

姓名、身分证统一编号、性别、出生年月日、通讯方式及其它详如相关业务申请书或契约书之内容，并以贵行与立约人往来之相关业务、账户或服务及自立约人或第三人处（例如：

财团法人金融联合征信中心）所实际搜集之个人资料为准。

（d）Periodofusingthepersonalinformation个人数据利用之期间：

（i）Withintimeperiodofspecificpurpose.特定目的存续期间。

（ii）Retentionperiodinaccordancewiththerelevantlaws/regulations（suchasBusinessEntityAccountingActetc.）orinlinewithbusinessneedsorindividualcontracts.（thelongerperiodtobeapplied）.

依相关法令所定（例如商业会计法等）或因执行业务所必须之保存期间或依个别契约就数据之保存所定之保存年限。

（以期限最长者为准）

（e）Areaofusingthepersonalinformation个人资料利用之地区：

Thelocationofthepartiesindicatedinthecolumnof“Partiesofusingthepersonalinformation”.

以「个人数据利用之对象」字段所列之利用对象其国内及国外所在地。

（f）Partiesofusingthepersonalinformation个人数据利用之对象：

（i）TheBank（includingtheserviceproviderengagedwiththeBank）.

贵行（含受贵行委托处理事务之委外机构）。

（ii）Theinstitutionusingtheinformationincompliancewithregulations（suchastheparentcompanyoftheBankorthefinancialholdingstheBankbelongingto）.

依法令规定利用之机构（例如：

贵行所属金融控股公司及其子公司等）。

（iii）Theinstitutionsinrelationtorelevantbusiness（suchascorrespondentbanks,JointCreditInformationCenter,NationalCreditCardCenterofR.O.C.,TheTaiwanClearingHouse,FinancialInformationServiceCo.,Ltd.,creditguaranteeinstitutions,creditcardinternationalorganizations,creditcardacquirers,engagedstores,anyassignee（potentialassignee）ofBank’sloan,participant（potentialparticipant）ofBank’sloan,oranyotherBank’sauthorizedagents）.

其它业务相关之机构（例如：

通汇行、财团法人金融联合征信中心、财团法人联合信用卡处理中心、台湾票据交换所、财金信息股份有限公司、信用保证机构、信用卡国际组织、收单机构暨特约商店、受让参贷（拟受让、参贷）贵行债权债务之人等）。

（iv）Legallyinvestigationauthorityorfinancialsupervisoryauthority.

依法有权机关或金融监理机关。

（v）PartiesagreedbytheCustomer（suchastheBank’sjointlymarkingorCustomerinformationsharingcompanies,theBank’sbusinesscooperativeunits）.

立约人所同意之对象（例如：

贵行共同营销或交互运用客户资料之公司、与贵行合作推广业务之公司等）。

（g）Waysofusingthepersonalinformation个人数据利用之方式：

Bywayofautomaticornon-automaticmeasuresthatiscompliancewithpersonalinformationprotectionrelevantregulations.

符合个人数据保护相关法令以自动化机器或其它非自动化之利用方式。

18.2AccordingtoArticle3ofthePIPA,theCustomermayexercisethefollowingrightswithrespecttotheCustomer’spersonalinformationcollectedbytheBank:

依据个资法第三条规定，立约人就贵行保有立约人之个人资料得行使下列权利：

（a）SaveintheexceptionalcircumstancesasprovidedinArticle10ofthePIPA,theCustomermayinquireandrequestforareviewormakeduplicationsoftheCustomer’spersonalinformation.However,theBankmaychargenecessaryhandlingfeeintermsofArticle14ofthePIPA.

除有个资法第十条所规定之例外情形外，得向贵行查询、请求阅览或请求制给复制本，惟贵行依个资法第十四条规定得酌收必要成本费用。

（b）TheCustomermayrequesttosupplementorcorrecttheCustomer’spersonalinformation.However,accordingtoArticle19oftheEnforcementRulesofthePIPA,theCustomershallgiveanappropriatestatementofthereasonsandfactsforsuchrequest.

得向贵行请求补充或更正，惟依个资法施行细则第十九条规定，立约人应适当释明其原因及事实。

（c）AccordingtoArticle11,paragraph4ofthePIPA,theCustomermayrequesttheBanktodiscontinuecollection,processingoruseoftheCustomer’spersonalinformationwhereaviolationofthisActoccurredduringcollecting,processingorusingtheCustomer’spersonalinformation.

贵行如有违反个资法规定搜集、处理或利用立约人之个人数据，依个资法第十一条第四项规定，立约人得向贵行请求停止搜集。

（d）AccordingtoArticle11,paragraph2ofthePIPA,theCustomermayrequesttheBanktodiscontinueprocessingorusingtheCustomer’spersonalinformationintheeventofadisputeregardingtheaccuracyofpersonalinformation.However,theprecedingsentencemaynotbeapplicablewhenitisnecessaryfortheperformanceofanofficialdutyorfulfillmentofalegalobligationandhasbeenrecorded,orwhenitisagreedbytheCustomerinwriting.

依个资法第十一条第二项规定，个人数据正确性有争议者，得向贵行请求停止处理或利用立约人之个人数据。

惟依该项但书规定，贵行因执行业务所必须并注明其争议或经立约人书面同意者，不在此限。
