ChapterIgeneralprovisions

Article1inordertostrengthenthemanagementoftheurbanroadfacilities,givefullplaytoitsfunction,promotetheeconomicandsocialdevelopment,accordingtotherelevantlawsandregulations,combinedwiththeactual,theseregulationsareformulated.

Article2theseregulationsshallapplytourbanroadfacilitieswithintheadministrativeregionofthismunicipality.ExceptforpublicSpacesinurbanroadfacilities.

Urbanroadfacilitiesintheseregulationsmeansthecityroadplanningredlinewithinthescopeoftheroadway,sidewalks,isolationbelt,square,Bridges,tunnels,highways,pedestrianoverpass,undergroundpassageandaffiliatedmunicipalfacilities,etc.

Article3themunicipalpublicadministrationbureauofnanjingmunicipalityistheadministrativedepartmentofthecity'surbanroadfacilitiesandisresponsiblefortheadministration,

maintenanceandsupervisionofurbanroadfacilitiesinthismunicipality.

Theadministrativedepartmentsofurbanroadfacilitiesinthedistrictsandcountiesshallberesponsibleforthemanagementandmaintenanceofurbanroadfacilitiesaccordingtotheprescribedscopeanddivisionoflabor.

Thedepartmentsofconstruction,planning,publicsecurity,industrialandcommercialadministration,gardens,landandmunicipalcapacityshall,withinthescopeoftheirrespectivefunctionsandresponsibilities,worktogetherwiththecompetentauthoritiestomanagetheurbanroadfacilities.

Article4theconstruction,renovationandmaintenanceofurbanroadfacilitiesshallbeinaccordancewiththeoverallplanofthecity,reasonablelayoutandsupportingimplementation.Newconstruction,reconstructionandexpansionofurbanroadfacilitiesshouldstrictlyimplementconstructionproceduresandqualitystandards,adheretotheprinciplesofundergroundandpost-earth,andplanandcoordinatetheconstruction.

Withinthreemonthsafterthecompletionoftheurbanroadfacilitiesproject,theconstructionunitshalldeclareacceptanceandtransfertotheadministrativedepartmentofurbanroadfacilitiesinaccordancewiththeprovisions.

Thespecialroadsconnectedwithurbanroads,whichmeetthestandardsofurbanroads,canbetransferredtotheadministrativedepartmentofurbanroadfacilitiesformanagementandmaintenance.

Article5anyunitandindividualshallhavetheobligationtoprotecttheurbanroadfacilitiesandshallhavetherighttoreportandprosecuteanyviolationsoftheseregulations.

Unitsandindividualswhohavemadeoutstandingachievementsintheprotectionofurbanroadfacilitiesshallbecommendedorrewardedbytheadministrativedepartmentofurbanroadfacilities.

Chapteriioccupationmanagement

Article6nounitorindividualshallarbitrarilyoccupytheurbanroadfacilities.Isreallynecessary,thetemporaryoccupationshallapplytothecompetentadministrativedepartmentforurbanroadfacilities,andwiththeapprovalofthepublicsecuritytrafficmanagementdepartmentforexaminationandapproval,gothroughtheformalitiesforexaminationandapprovalofappropriateurbanroadfacilities,payZhanDaoFei,theurbanroadoccupancylicence.

Areaofurbanroadfacilitiesthecompetentadministrativedepartmentforreviewbythemunicipalurbanroadfacilitiesdesignatedbytheadministrativedepartmentoftheimportantsectionsandregulationstemporaryoccupationareaoftheurbanroadfacilities,shallbesubmittedtothemunicipaladministrativedepartmentofcityroadfacilitiesforapproval.

Article7thefollowingareasarestrictlyprohibited:

（1）thebridgedeckandthelocationthatisdangeroustotraffic;

（2）busstation;

（3）gatevalves,inspectionWells,rainwaterWells,welluseandoperationrangesofundergroundpipelines.

Article8thefollowingconstructionprojectsduetotheneedofconstructionoftemporaryoccupationofurbanroadfacilities,constructionunitsandindividualsshallholda

constructionprojectplanningpermit,applyfortodealwithformalitiesoftemporaryoccupyurbanroadfacilities:

（1）construction,reconstructionorexpansionofmunicipalprojects;

（2）buildingnew,rebuildingandexpandinghousesalongthestreet;

（3）miningprojectsbeyondthescopeofexcavationapproval.

Article9.Strictlycontroltheoccupationofurbanroadfacilitiestosetupvariousmarkets.Ifnecessary,itshallbesubmittedtothemunicipalpeople'sgovernmentforapprovalaftertheexaminationandapprovaloftheadministrativedepartmentofurbanroadfacilitiesandthepublicsecuritytrafficmanagementdepartment.

Theurbanroadfacilitiesshallbeusedfortheestablishment

andoperationofkiosks,advertisements,signsandpavilions,

andtheproceduresforthetemporaryoccupancyofurbanroadfacilitiesshallbedealtwith,andotherproceduresshallbedealtwith.

Article10strictlycontroltheuseofurbanroadfacilitiestosetupvariousparkingSpaces.Ifthecityroadfacilitiesaretobeusedtosetupparkinglots,themeasuresforexaminationandapprovalandmanagementshallbeseparatelyprescribedbythemunicipalpeople'sgovernment.

Article11strictlycontrolthetemporaryoccupationofpavements.Thetemporaryoccupationofpavementsshallnotbemorethanhalfofthewidthofthesidewalk,anditshallbemorethanonemeterwidetoensurethesafetyofpedestrians.

Themaintenanceandmaintenanceofroadworksinurbanroadfacilitiesshallnotexceedtheroadsurfaceandthe1.5mwidesurfaceoftheroadbetweenthedesignatedsafeisland.

Article12thetemporaryoccupyurbanroadfacilities,unitsandindividualsshall,inaccordancewiththeapprovedscopeandtime,shallnotalteroccupancy,expandingthescopeofthefootprint,andextendtheelapsedtime,arenotallowedtoberenttransfer.

Duringtheperiodofoccupationduetotheneedforurbanconstruction,theoccupyingunitsandindividualsshallpromptlydismantleallkindsofbuildingsandfacilitiesthatoccupytheurbanroadfacilities.

Article13nooccupationunitorindividualmaydamagetheurbanroadfacilities.Anyunitorindividualthatdamagestheurbanroadfacilitiesshallbeliableforcompensation.

Thesitemustbekeptinafenceorpartitionandkeptclean.

Donotprefabricatecementproducts,mixingmortarandrinsinggravelintheoccupationarea.

Article14theexpirationoftemporaryoccupyurbanroadfacilities,takeuptheunitsandindividualsshallbeatthesceneoftheoccupancyperiodtoclear,submittedtothecompetentadministrativedepartmentforurbanroadfacilitiesandpublicsecuritytrafficmanagementdepartmenttoacceptance,handincityroadoccupancylicence.

Article15ZhanDaoFeiinaccordancewiththestandardapprovedbyprovincefinance,commoditypricedepartment,administrativedepartmentbythemunicipalurbanroadfacilitiesunifiedcollectionandimplementfiscalrevenuestorage,usedinurbanroadfacilitiesmaintenance,maintenanceandmanagement.

Chapteriiiminingmanagement

Article16theconstructionunitsandindividualsneedtoexcavateurbanroadfacilities,andrelateddrawingsshallholdaconstructionprojectplanningpermit,applytothecompetentadministrativedepartmentforurbanroadfacilities,gothroughtheformalitiesforexaminationandapprovalofurbanroadfacilities,mining,payrepairfees,andafterapprovalbythepublicsecuritytrafficmanagementdepartment,tothecompetentadministrativedepartmentforurbanroadfacilitiesforurbanroadmininglicense,beforeconstruction.

Districturbanroadfacilitiesthecompetentadministrativedepartmentforreviewbythemunicipalurbanroadfacilitiesdesignatedbytheadministrativedepartmentoftheimportantsectionsandprescribedscopeofurbanroadfacilitiesofdigging,andacrosstheprimaryandsecondarytrunkroadexcavation,shallbesubmittedtothemunicipaladministrativedepartmentofcityroadfacilitiesforapproval.

Toexcavateandrepairtherecoveryfeetoimplementthechargingstandardsetbytheadministrativedepartmentofprovincialconstruction.

Article17theroadswithinfiveyearsofthenewconstructionorreconstructionofurbanroads,andtheconstructionofalargescaleconstructionroadwithinthreeyears,aswellastheroadofcementconcretemotorvehiclesshallnotbeexcavated.Iftheexcavationisindeedrequired,itshallbesubmittedtothemunicipalpeople'sgovernmentforapprovalaftertheexaminationandapprovaloftheadministrativedepartmentofurbanroadfacilitiesandthepublicsecuritytrafficmanagementdepartment,andshallbechargedfortherecoveryof1to3times.

Article18electricpower,telecom,gas,water,drainage,streetlamps,etcundergroundpipelineburiedengineeringconstructionunit,shallbesubmittedtothecompetentadministrativedepartmentforconstruction,planning,urbanroadfacilitiesandpublicsecuritytrafficmanagementdepartmenttosubmittheannualimplementationplan.Themaintenanceandmaintenanceunitsofurbanroadfacilit
