TelecommunicationsRegulationsofthePeople\'sRepublicofChina

TelecommunicationsRegulationsofthePeople'sRepublicofChina

(adoptedatthethirty-firstregularmeetingoftheStateCouncilheldonSeptember20,2000andpromulgatedbyPremierZhuRongjionSeptember25,2000)

 

Chapter1            GeneralPrinciples

Article1.            TheseRegulationsareformulatedinordertoregulatetheorderofthetelecommunicationsmarket,safeguardthelegitimaterightsandinterestsoftelecommunicationssubscribersandtelecommunicationsoperators,ensurethesafetyoftelecommunicationsnetworksandinformation,andtopromotethesounddevelopmentofthetelecommunicationsindustry.

Article2.            Anypartiesthatengageintelecommunicationsactivitiesortelecommunications-relatedactivitiesinthePeople'sRepublicofChinamustobeytheseRegulations.

"Telecommunications"asreferredtohereinshallmeanthetransmission,emissionorreceptionofvoice,text,data,imagesandanyotherformofinformationusingwireorwirelesselectromagneticorphotoelectricsystems.

Article3.            ThesupervisorydepartmentfortheinformationindustryundertheStateCouncilshallsuperviseandregulatethetelecommunicationsindustrynationwideinaccordancewiththeprovisionsoftheseRegulations.

Thetelecommunicationsadministrationauthoritiesofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernmentshall,undertheleadershipofthesupervisorydepartmentfortheinformationindustryundertheStateCouncilandinaccordancewiththeprovisionsoftheseRegulations,superviseandregulatethetelecommunicationsindustrywithintheirrespectiveadministrativejurisdictions.

Article4.            Thesupervisionandregulationofthetelecommunicationsindustryshallbebasedontheprinciplesofseparationofgovernmentadministrationfromenterprisemanagement,eliminationofmonopoly,encouragementofcompetitionandpromotionofdevelopment,aswellastheprinciplesofopenness,fairnessandimpartiality.

Telecommunicationsoperatorsshallconducttheirbusinessesinaccordancewithlaw,complywithbusinessethicsandacceptlegalsupervisionandinspection.

Article5.            Telecommunicationsoperatorsshallprovidetelecommunicationssubscriberswithtelecommunicationsservicesthatarefast,accurate,secure,convenientandreasonably-priced.

Article6.            Thesecurityoftelecommunicationsnetworksandinformationshallbeprotectedbylaw. Noorganizationsorindividualsmayusetelecommunicationsnetworkstoengageinactivitiesthatjeopardizenationalsecurity,thepublicinterestofsocietyorthelegitimaterightsandinterestsofothers.

Chapter2            TheTelecommunicationsMarket

Section1            TelecommunicationsPermits

Article7.            TheStateshallimplementalicensingsystemfortheoperationoftelecommunicationsbusinesses,pursuanttowhichtelecommunicationsbusinessesshallbedividedintocategories.

OperatorsoftelecommunicationsbusinessesmustobtainoperatingpermitsfortelecommunicationsbusinessesissuedbythesupervisorydepartmentfortheinformationindustryundertheStateCouncilorthetelecommunicationsadministrationauthoritiesofprovinces,autonomousregionsandmunicipalitiesunderthecentralgovernmentinaccordancewiththeprovisionsoftheseRegulations.

Noorganizationsorindividualsmayundertaketelecommunicationsbusinessoperationactivitieswithoutanoperatingpermit.

Articles8.            Telecommunicationsbusinessesshallbedividedintothecategoriesofbasictelecommunicationsbusinessesandvalue-addedtelecommunicationsbusinesses.

Basictelecommunicationsbusinessesshallmeanbusinessesthatprovidepublicnetworkinfrastructure,servicesforpublicdatatransmissionandbasicvoicetelephonyservices. Value-addedtelecommunicationsbusinessesshallmeanbusinessesthatprovidetelecommunicationsandinformationservicesusingpublicnetworkinfrastructure.

Thespecificcategorizationoftelecommunicationsbusinessesissetforthinthe"CatalogofClassesofTelecommunicationsBusinesses"attachedtotheseRegulations. Dependingonactualcircumstances,thesupervisorydepartmentfortheinformationindustryundertheStateCouncilmaymakeincrementaladjustmentstothecategorizationoftelecommunicationsbusinessessetforthinthecatalogandreissuethecatalog.

Article9.            AnoperatorofabasictelecommunicationsbusinessmustbeexaminedandapprovedbythesupervisorydepartmentfortheinformationindustryundertheStateCouncilandobtainan"OperatingPermitforBasicTelecommunicationsBusiness".

Ifanoperatorofavalue-addedtelecommunicationsbusinesshasascopeofcoverageconstitutingtwoormoreprovinces,autonomousregionsormunicipalitiesdirectlyunderthecentralgovernment,itshallobtainan"OperatingPermitforInter-RegionalValue-AddedTelecommunicationsBusiness"upontheexaminationandapprovalofthesupervisorydepartmentfortheinformationindustryundertheStateCouncil. Ifanoperatorofavalue-addedtelecommunicationsbusinesshasascopeofcoverageofoneprovince,autonomousregionormunicipalitydirectlyunderthecentralgovernment,itshallobtainan"OperatingPermitforValue-AddedTelecommunicationsBusiness"upontheexaminationandapprovalofthetelecommunicationsadministrationauthorityoftheprovince,autonomousregionormunicipalitydirectlyunderthecentralgovernment.

Trialoperationsofnewtelecommunicationsbusinessesnotlistedinthe"CatalogofClassesofTelecommunicationsBusinesses"andusingnewtechnologyshallbefiledfortherecordwiththetelecommunicationsadministrationauthoritiesofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernment.

Article10.            Anoperatorofabasictelecommunicationsbusinessmustfulfillthefollowingconditions:

(1)         theoperatorshallbeasolepurposecompanythatislegallyestablishedtoengageinbasictelecommunicationsbusinesses,andState-ownedequityinterestorsharesinthecompanyshallnotconstitutelessthan51%;

(2)         ithasafeasibilitystudyandatechnicalplanfornetworkconstruction;

(3)         ithasappropriatefundsandprofessionalsrequiredforitsbusinessactivities;

(4)         ithaspremisesandappropriateresourcesrequiredforitsbusinessactivities;

(5)         ithasthereputationorcapabilityofprovidinglong-termservicetosubscribers;and

(6)         otherconditionsstipulatedbytheState.

Article11.            AnapplicantforoperatingabasictelecommunicationsbusinessshallsubmititsapplicationandtherelevantdocumentssetforthinArticle10hereoftothesupervisorydepartmentfortheinformationindustryundertheStateCouncil. Within180daysfromthereceiptoftheapplication,thesupervisorydepartmentfortheinformationindustryundertheStateCouncilshallcompleteitsexaminationanddecidewhethertoapproveorrejecttheapplication. Iftheapplicationisapproved,an"OperatingPermitforBasicTelecommunicationsBusiness"shallbegranted;iftheapplicationisrejected,awrittennoticestatingthereasonforsuchrejectionshallbegiventotheapplicant.

Article12.            Whenexamininganapplicationforoperatingabasictelecommunicationsbusiness,thesupervisorydepartmentfortheinformationindustryundertheStateCouncilshallconsiderfactorssuchasnationalsecurity,securityofthetelecommunicationsnetwork,continuedusabilityoftelecommunicationsresources,environmentalprotectionandthesituationwithregardtocompetitioninthetelecommunicationsmarket.

An"OperatingPermitforBasicTelecommunicationsBusiness"shallbeissuedbymeansofbiddinginaccordancewiththerelevantprovisionsoftheState.

Article13.            Anoperatorofavalue-addedbasictelecommunicationsbusinessmustfulfillthefollowingconditions:

(1)         theoperatorshallbealegallyestablishedcompany;

(2)         ithasappropriatefundsandprofessionalsrequiredforitsbusinessactivities;

(3)         ithasthereputationorcapabilityofprovidinglong-termservicetosubscribers;and

(4)         otherconditionsstipulatedbytheState.

Article14.            Anapplicantforoperatingavalue-addedtelecommunicationsbusinessshall,inaccordancewithArticle9

(2)hereof,submititsapplicationandtherelevantdocumentssetforthinArticle13hereoftothesupervisorydepartmentfortheinformationindustryundertheStateCouncilorthetelecommunicationsadministrationauthorityoftheprovince,autonomousregionormunicipalitydirectlyunderthecentralgovernment. IftheexaminationandapprovalofrelevantdepartmentsisrequiredasstipulatedbyrelevantprovisionsoftheState,anapplicantforoperatingavalue-addedtelecommunicationsbusinessshallalsosubmitapprovaldocumentstosuchrelevantdepartments. Within60daysfromthereceiptoftheapplication,thesupervisorydepartmentfortheinformationindustryundertheStateCouncilorthetelecommunicationsadministrationauthorityoftheprovince,andautonomousregionormunicipalitydirectlyunderthecentralgovernmentshallcompleteitsexaminationanddecidewhethertoapproveorrejecttheapplication. Iftheapplicationisapproved,an"OperatingPermitforInter-RegionalValue-AddedTelecommunicationsBusiness"oran"OperatingPermitforValue-AddedTelecommunicationsBusiness"shallbegranted;iftheapplicationisrejected,awrittennoticestatingthereasonforsuchrejectionshallbegiventotheapplicant.

Article15.            Ifinthecourseofitsoperationsatelecommunicationsoperatorchanges
