PartOne:

Generalprovisions

Article1:

TheseRegulationsareformulatedinaccordancewiththePRCTrademarkLaw（theTrademarkLaw）.

Article2:

TheprovisionsoftheseRegulationsrelatingtotrademarksforgoodsshallbeapplicabletotrademarksforservices.

Article3:

Atrademarkholderrequestingwell-knowntrademarkprotectioninaccordancewithArticle13oftheTrademarkLawshallsubmitevidenceshowingthathis/her/itstrademarkconstitutesawell-knowntrademark.TheTrademarkOffice（TMO）orTrademarkReviewandAdjudicationBoard（TRAB）shalldeterminewhetherhis/her/itstrademarkiswell-knownpursuanttoArticle14oftheTrademarkLawandbasedontherequirementsoftheexaminationandhandlingofthecaseandtheevidencesubmittedbytheconcernedparty.

Article4:

AgeographicalindicationasprovidedforinArticle16oftheTrademarkLawmaybethesubjectofanapplicationforregistrationasacertificationmarkoracollectivemarkpursuanttotheTrademarkLawandtheseRegulations.

Whereageographicalindicationhasbeenregisteredasacertificationmark,anaturalpersonoralegalpersonorotherorganisationwhosegoodssatisfythe

第一章总则

第一条根据《中华人民共和国商标法》（以下简称商标法），制定本条例。

第二条本条例有关商品商标的规定，适用于服务商标。

第三条商标持有人依照商标法第十三条规定请求驰名商标保护的，应当提交其商标构成驰名商标的证据材料。

商标局、商标评审委员会应当依照商标法第十四条的规定，根据审查、处理案件的需要以及当事人提交的证据材料，对其商标驰名情况作出认定。

第四条商标法第十六条规定的地理标志，可以依照商标法和本条例的规定，作为证明商标或者集体商标申请注册。

以地理标志作为证明商标注册的，其商品符合使用该地理标志条件的自然人、法人或者其他组织可以要求使用该证明商标，控制该证明商标的组织应当允许。

以地理标志作为集体商标注册的，其商品符合使用该地理标志条件

conditionsforuseofthegeographicalindicationmayrequesttousesuchcertificationmark,andtheorganisationthatcontrolsthemarkshallpermitsuchuse.Whereageographicalindicationhasbeenregisteredasacollectivemark,anaturalpersonoralegalpersonorotherorganisationwhosegoodssatisfytheconditionsforuseofthegeographicalindicationmayrequesttojointhegroup,associationorotherorganisationthatregisteredsuchgeographicalindicationasacollectivemark,andsuchgroup,associationorotherorganisationshallaccepthim/her/itasamemberpursuanttoitscharter;ifhe/she/itdoesnotrequesttojointhegroup,associationorotherorganisationthatregisteredsuchgeographicalindicationasacollectivemark,he/she/itmaynonethelessmakelegitimateuseofthegeographicalindication,andthesaidgroup,associationorotherorganisationshallhavenorighttoprohibitthesame.

Article5:

Anapplicantentrustingatrademarkagencytoapplyfortrademarkregistrationortohandleothertrademarkmattersshallfileapowerofattorney.Thepowerofattorneyshallclearlystatethemattersentrustedandthelimitsofauthority.Thepowerofattorneyofaforeignerorforeignenterpriseshallalsostatethenationalityoftheprincipal.

第五条当事人委托商标代理机构申请商标注册或者办理其他商标事宜，应当提交代理委托书。

代理委托书应当载明代理内容及权限；外国人或者外国企业的代理委托书还应当载明委托人的国籍。

Thenotarisationandauthenticationproceduresforthepowerofattorneyandtherelevantsupportingdocumentsofaforeignerorforeignenterpriseshallbecarriedoutinaccordancewiththeprincipleofreciprocity.

Whereanapplicationismadetoregisteratrademarkorassignatrademarkandtheapplicantfortrademarkregistrationorthetrademarkassignororassigneeisaforeignnationalorforeignenterprise,he/she/itshalldesignateintheapplicationarecipientinChinatoberesponsibleforreceivingsubsequentlegaldocumentsconcerningtrademarkmattersfromtheTMOandTRAB.SubsequentlegaldocumentsconcerningtrademarkmattersshallbeservedbytheTMOandTRABontherecipientinChina.

外国人或者外国企业的代理委托书及与其有关的证明文件的公证、认证手续，按照对等原则办理。

申请商标注册或者转让商标，商标注册申请人或者商标转让受让人为外国人或者外国企业的，应当在申请书中指定中国境内接收人负责接收商标局、商标评审委员会后继商标业务的法律文件。

商标局、商标评审委员会后继商标业务的法律文件向中国境内接收人送达。

ForthepurposesofArticle18oftheTrademarkLaw,thephrase"foreignersandforeignenterprises"meansforeignersandforeignenterprisesthathavenopermanentresidenceorplaceofbusinessinChina.

商标法第十八条所称外国人或者外国企业，是指在中国没有经常居所或者营业所的外国人或者外国企业。

Article6:

TheChineselanguageshallbeusedforapplicationsfortrademarkregistrationorthehandlingofothertrademarkmatters.

第六条申请商标注册或者办理其他商标事宜，应当使用中文。

Certificates,supportingdocumentsandevidencesubmittedpursuanttotheTrademarkLawortheseRegulationsthatareinaforeignlanguageshallbeaccompaniedbyaChinesetranslation,failingthattheyshallbedeemednottohavebeensubmitted.

Article7:

AmemberoftheworkingpersonneloftheTMOorTRABshallrecusehimself/herself,andmaybechallengedbyapartyoramateriallyinterestedperson,inanyofthefollowingcircumstances:

依照商标法和本条例规定提交的各种证件、证明文件和证据材料是外文的，应当附送中文译文；未附送的，视为未提交该证件、证明文件或者证据材料。

第七条商标局、商标评审委员会工作人员有下列情形之一的，应当回避，当事人或者利害关系人可以要求其回避：

Article8:

WhereatrademarkregistrationapplicationorothersuchrelevantdocumentsarefiledindatamessageformatasspecifiedinArticle22oftheTrademarkLaw,theyshallbesubmittedviatheinternetinaccordancewiththeprovisionsoftheTMOorTRAB.

Article9:

WiththeexceptionofthecircumstancesetforthinArticle18hereof,forthedateonwhichapartysubmitsadocumentormaterialstotheTMOorTRAB,thedateofdeliveryshallprevailifdeliveredbyhand,orthepostmarkdateshallprevailifsentbymail.Ifthepostmarkdateisunclearorthereisnopostmark,thedateonwhichtheTMOorTRABactuallyreceivesthedocumentormaterialsshallprevailunlessthepartyisabletosubmitevidenceoftheactualpostmarkdate.Wheredeliveryiseffectedbyacourierenterpriseotherthanapostalenterprise,thedateofconsignmenttothecourierenterpriseshallprevail.Iftheconsignmentdateisunclear,thedateonwhichtheTMOorTRABactuallyreceivesthedocumentormaterialsshallprevailunlessthepartyisabletosubmitevidenceoftheactualconsignmentdate.Wheresubmissioniseffectedindatamessageformat,thedateofentryofthesameintotheTMO'sorTRAB'selectronicsystemshallprevail.

IfapartymailsadocumenttotheTMOorTRAB,itshalldosobyregisteredmail.

WhenapartysubmitsadocumenttotheTMOorTRAB,itshalldosoinwritingandthatrecordedinthefilekeptbytheTMOorTRABshallgovern;orifsubmittedindatamessageformat,thatrecordedintheTMO'sorTRAB'sdatabase
