Article2NoStateorgans,socialorganizations,enterprises,institutions,privatenon-enterpriseunits,orindividualindustrialandcommercialbusinesses（hereinafterreferredtoasemployingunits）mayrecruitandhireminorsundertheageof16（theterm"

hiringminorsundertheageof16"

ishereinafterreferreduniformlytoas"

useofchildlabour"

）.

Allunitsandindividualsareprohibitedfromprovidingjobplacementservicetominorsundertheageof16.

Minorsundertheageof16areprohibitedfromstartingbusinessandengaginginindividualbusinessoperationactivities.

Article3Theparentsorguardiansofminorsundertheageof16shallprotecttheirphysicalandmentalhealth,safeguardtheirrightstocompulsoryeducationandshallnotpermitthemtobeillegallyhiredbyemployingunits.

Wheretheparentsorguardiansofminorsundertheageof16permitthemtobeillegallyhiredbyemployingunits,thepeople'

sgovernmentofthetownship（town）,theurbansubdistrictoffice,thevillagers'

committeeortheresidents'

committeewheretheyarelocatedshallcriticizeandeducatetheparentsorguardians.

Article4Employingunits,whenrecruitingemployees,shallverifytheidentificationcardoftherecruited;

nominorsundertheageof16shallberecruited.Theemployingunitsshallproperlypreservethedocumentsforrecruitmentregistrationandverification.

Article5Labourandsocialsecurityadministrativedepartmentsofthepeople'

sgovernmentsatorabovethecountylevelshallberesponsibleforthesupervisionoverandinspectionoftheenforcementoftheseProvisions.

Administrativedepartmentsforpublicsecurity,industrialandcommercialadministration,educationandpublichealth,etc.ofthepeople'

sgovernmentsatorabovethecountylevelshallsuperviseandinspecttheenforcementoftheseProvisionswithintheirjurisdictionandsupportthesupervisionandinspectionconductedbythelabourandsocialsecurityadministrativedepartments.

Tradeunions,YouthLeagues,Women'

sFederationsandothersocialorganizationsshallprotectthelawfulrightsandinterestsofminorsinaccordancewithlaw.

Anyunitorindividualshall,wherediscoveringchildlabour,havetherighttoreportthecasetothelabourandsocialsecurityadministrativedepartmentofthepeople'

sgovernmentatorabovethecountylevel.

Article6Inthecaseofuseofchildlabourbyanemployingunit,thelabourandsocialsecurityadministrativedepartmentshallpunishitbythestandardoffining5,000yuanforeachofchildrenemployedpermonth;

Inthecaseofuseofchildlabourinworkplaceswheretoxicsubstancesareused,aheavierpunishmentshallbeimposedinconsistencewiththefinerangestipulatedintheRegulationsonLabourProtectioninWorkplacesWhereToxicSubstancesAreUsed,orbythestandardoffining5,000yuanforeachofchildrenemployedpermonth.Thelabourandsocialsecurityadministrativedepartmentshallordertheemployingunittosendthechildrenbacktotheiroriginalplacesofresidenceandhandthemtotheirparentsorotherguardianswithinaprescribedperiod,andallthecostsoftransportationandaccommodationssoentailedshallbebornebytheemployingunit.

Wheretheemployingunit,whenorderedtomakecorrectionsbythelabourandsocialsecurityadministrativedepartmentinaccordancewiththeprecedingparagraph,failstosendthechildlabourersbacktotheirparentsorotherguardianswithintheprescribedperiod,thelabourandsocialsecurityadministrativedepartmentshallpunishitbythestandardoffining10,000yuanforeachofchildrenemployedpermonthfromthedateoforderingcorrectionstobemadewithintheprescribedperiod,andthedepartmentforindustrialandcommercialadministrationshallrevoketheirbusinesslicensesor,thecivilaffairsdepartmentshallcancelthenon-enterpriseunitregistration;

iftheemployingunitisaStateorganorpublicinstitution,therelevantunitsshallimposeadministrativeordisciplinarysanctionsofdemotionordischargingfromthepostonthepersonsinchargedirectlyresponsibleandotherpersonsdirectlyresponsible.

Article7Whereaunitoranindividualprovidesjobplacementservicetominorsundertheageof16,thelabourandsocialsecurityadministrativedepartmentshallpunishitbythestandardoffining5,000yuanforeachoftheminorsplaced;

whereajobplacementserviceagencyprovidesjobplacementservicetominorsundertheageof16,thelabourandsocialsecurityadministrativedepartmentshallalsorevokeitsjobplacementlicense.

Article8Anyemployingunitthatfailstopreserve,orforgesthedocumentsforrecruitmentregistrationaccordingtotheprovisionsofArticle4oftheseProvisionsshallbefined10,000yuanbythelabourandsocialsecurityadministrativedepartment.

Article9AnyunitthathasnobusinesslicenseorwhosebusinesslicenseisrevokedaccordingtolaworanyunitthathasnotbeenregisteredorsubmitteditselffortherecordaccordingtolawemploysachildorprovidesjobplacementservicestoachildshallbefinedtwiceofthestandardsstipulatedinArticle6,7or8oftheseProvisions,andthatillegalunitshallbebannedbytherelevantcompetentadministrativedepartment.

Article10Whereachildemployedissickorinjured,theemployingunitshallbringhimtothemedicalinstitutionfortreatmentandbearallthemedicalandlivingcostsduringtheperiodoftreatment.

Whereachildemployedisdisabledordead,thedepartmentforindustrialandcommercialadministrationshallrevokethebusinesslicenseoftheemployingunitor,thecivilaffairsdepartmentshallcancelthenon-enterpriseunitregistration;

iftheemployingunitisaStateorganoraninstitution,therelevantunitshallimposeadministrativeordisciplinarysanctionsofdemotionordischargingfromthepostonthepersonsinchargedirectlyresponsibleandotherpersonsdirectlyresponsible;

theemployingunitshallalsopaylumpsumcompensationtothelinealrelativesofthedisabledordeadchildlabourer,andtheamountofcompensationshallbefixedinaccordancewiththeprovisionsonwork-relatedinjuryinsuranceoftheState.

Article11Whoeverabductsachildforuseasalabourer,forcesachildtowork,employsachildtobeengagedinworkhighabovethegroundordowninthepit,workinvolvingradioactive,highlypoisonous,inflammableorexplosivesubstancesorworkofthe4thdegreelabourintensityasstipulatedbytheState,oremploysachildundertheageof14,orcausesdeathorsevereinjurytoachildemployed,shallbeinvestigatedforcriminalliabilityinaccordancewiththeprovisionsofthecriminallawonthecrimeofabductingandtraffickinginchildren,thecrimeofforcedlabourorothercrimes.

Article12Thestaffmembersofthegovernmentadministrativedepartmentswhocommitoneofthefollowingactsshallbegivenadministrativesanctionsofrecordingaseriousdemeritordemotionaccordingtolaw,shallbedischargedfromthepostordismissedaccordingtolawifthecircumstancesareserious,andshallbeinvestigatedforcriminalliabilityinaccordancewiththeprovisionsofthecriminallawonthecrimeofabuseofpower,thecrimeofneglectofdutyorothercrimesifacrimeisconstituted:

（1）thestaffmembersofthelabourandsocialsecurityadministrativedepartmentsandotherrelevantdepartmentsfailtostop,rectifyandinvestigateandpunishthosewhoemploychildren,whentheydiscoverthatchildrenareemployedinthecourseofsupervisionandinspectionoftheprohibitionofchildlabour;

（2）thepeople'

spolicemenofthepublicsecurityorgansissueidentificationcardsorrecordfalsedateofbirthintheidentificationcardsinviolationofrelevantprovisions;

（3）thestaffmembersofthedepartmentsforindustrialandcommercialadministrationissueabusinesslicenseforengaginginindividualbusinesswhendiscoveringthattheapplicantisaminorundertheageof16.

Article13Artisticorsportsunitsmay,uponagreementbytheirparentsorguardians,recruitminorsundertheageof16asprofessionalartistsorsportsmen.Theemployingunitsshallprotectthephysicalandmentalhealthoftheminorsrecruitedundertheageof16andguaranteetheirrightstocompulsoryeducation.Themeasuresforrecruitmentofprofessionalartistsandsportsmenundertheageof16bytheartisticorsportsunitsshallbeformulatedbythelabourandsocialsecurityadministrativedepartmentoftheStateCounciljointlywiththecultureadministrativedepartmentandthephysicalcultureandsportsadministrativedepartmentoftheStateCouncil.

Theworkconductedbyminorsundertheageof16ineducationalpracticalandvocationaltrainingprogramorganizedbyschools,othereducationalinstitutionsorvocationaltraininginstitutionsaccordingtotherelevantprovisionsoftheState,whichdoesnotaffecttheirsafetyandphysicalandmentalhealth,shallnotfallintothecategoryofchildlabour.

Article14TheseProvisionsshallbeeffectiveasofDecember1,2002.TheProvisionsonProhibitionofChildLabourpromulgatedbytheStateCouncilonApril15,1991shallberepealedsimultaneously.
