Somepeoplebelievethatthereshouldbefixedpunishmentsforeachtypeofcrime.Others,however,arguethatthecircumstancesofanindividualcrime,andthemotivationforcommittingit,shouldalwaysbetakenintoaccountwhendecidingonthepunishment.Discussboththeseviewsandgiveyourownopinion.
CrimesarealwaysamutualconcernofmanycountriesintheWorld.ThesignificanceofdesignedpunishmentcategorizedtorelevantcrimesalsoisacenterofdiscussionamongtheGovernorsinproposinglegalactions.ItisarguedthattheGovernmentshouldissueauniformpunishmentforeachofvariouscrimes;whiletheothersrefutethattheauthorityshouldconsidertheaspectofindividualmotivesbeforedecidingpunishments.Bothpointsofviewwillbeanalyzedbeforeareasonedconclusionisdrawn.
Firstly,theadvantageofutilizingastandardizedpunishmentforacertaincrimewouldlesscomplicatetheregulatoryconceptwhichhelpsincreasingunderstandingofcitizensaboutcrimesandtheirpaybacks.Forexample,inJapan,peopleareremindedbypublicadvertisementsaboutregularcrimessuchasthieves,trashthrowersandtheirpotentialmonetaryandpublicservicepunishments.Bythat,thecitizensmaybemoreawareofillegalactions;thus,thatcouldleadtodecreaseincrimes.Therefore,itisessentialtoapplyafixedpunishmentforeachtypeofcrimes.
Ontheotherhand,othersarguethateachofcrimecaseshouldbeclarifiedtheinitiativemotiveofthecriminalinordertodeterminethedegreeofcrime.Itisobvious,forexample,thatapersonwhocommitsculpablehomicide,wouldhaveanattentivemotive,incomparisontotheoneunintentionallydoso.Thus,theconsciousnessofinitiativemotivationdiffersthedegreeofcrimecommittedinordertodeterminefairandadequatepunishments.Thus,consideringacriminal’smotivationcertainlycontributestotheauthority‘spunishmentdecisions.
Afteranalyzingbothopposingpointsofview,itisagreedthattheGovernmentshouldbespecificoninvestigatingcausesofactionbeforedeciding
