Obviously,educationsystemsarebasedonthebeliefthatallchildrencaneffectivelybetaughttoacquiredifferentskills,includingthoseassociatedwithsport,artormusic.Sofromourwonschoolexperience,wecanfindplentyofevidencetosupporttheviewthatachildcanacquiretheseskillswithcontinuedteachingandguidedpractice.

However,somepeoplebelievethatinnatetalentiswhatdifferentiatesapersonwhohasbeentrainedtoplayasportoraninstrument,fromthosewhobecomegoodplayers.Inotherwords,thereismoretotheskillthanagoodlearnedtechnique,andthisextratalentcannotbetaught,nomatterhowgoodtheteacherorhowfrequentlyachildpractices.

Ipersonallythinkthatsomepeopledohavetalentsthatareprobablyinheritedviatheirgenes.Suchtalentscangiveindividualsafacilityforcertainskillsthatallowthemtoexcel,whilemorehard-workingstudentsnevermanagetoreachacomparablelevel.But,aswithallquestionsofnatureversusnurture,theyarenotmutuallyexclusive.Goodmusiciansorartistsandexceptionalsportsstarshaveprobablysucceededbecauseofbothgoodtrainingandnaturaltalent.Withoutthenaturaltalent,continuoustrainingwouldbeneitherattractivenorproductive,andwithoutthetraining,thechildrenwouldnotlearnhowtoexploitanddeveloptheirtalent.

Ontheonehand,fixedpunishmentswillhaveadeterringeffectonsociety.Individualsknowingthattheywillbesubjecttoacertainpunishmentiftheyareconvictedwithagivencrimewillreconsidercommittingthisactinthefirstplace.

Thisdeterringeffectalsoleadstosocialstabilityandsecurity,throughminimizingthenumberofcrimescommitted.

Ifpeopleknewtheywouldbeabletoconvincethecourtorthejuryofareasonforhavingcommittedthecrimetheyareaccusedof,penaldecisionswouldbelargelyarbitrary.Thiswouldresultintocriminalsgettingawaywiththeircrimesandintoahighlevelofinjusticecausedbythesubjectiveapproachofdifferentcourts.

Ontheotherhand,takingthecircumstancesofacrimeanditsmotivationintoconsiderationisaprerequisiteforestablishingandensuringjusticeandequity.

Apersonkillinginself-defensecannotbecomparedtoaserialkiller,movingfromonevictimtothenext.Inmyopinionanintermediarypositionbetweenbothsolutionsistheperfectwaytoestablishandensurejusticeandequity.

Therehavetobefixedpunishmentsforallcrimes.However,criminallawshavetoprovideforaminimumandamaximumforthepunishmentandthelawsalsohavetoforeseecertaincasesofexemptions.

AnexampleforsettingminimumandmaximumpenaltiesisCompetitionLawwhereapersonbeingheldliableofacrimeunderthislawwillbeconvictedtopayafine,accordingtotheharmcausedbytheviolationandtheprofitgainedbytheviolatorthroughcommittingthecrime.

Asfortheexemptions,insomecountriesthelawexemptsthiefsstealingfoodduringaperiodoffaminetakingintoconsiderationthedistressandhunger.
