1.1ThePointsBasedSystemGenerally

EntryofstudentsnowdealtwithunderthePointsBasedSystem.ThePointsBasedSystem（PBS）comprisesfivetiersdealingwithentryforworkandstudy.Tier3isnot,however,active.

EntryforstudyisdealtwithunderTier4ofthePBS.AdetailedstudyofallthetiersofthePBSisbeyondthescopeofthiscoursebutyouwilllearnentryforstudywithinthecontextofthePBS.

ThePBSisunderconstantchangeandreview.However,inoverviewthetiersdealwiththefollowing:

∙Tier1ofthePBScoversentrybyhighlyskilledmigrants.

∙Tier2setsouttherequirementsforentryofskilledworkers.

∙Tier3isnotactive.

∙Tier4setsouttherequirementstocometotheUKtostudy.

∙Tier5dealswithmigrantswhowishtoworkintheUKonatemporarybasis.

1.2CommonFeaturesofPBSApplications

Therearecommonfeaturestoallentryforworkandstudyapplications.ThepremiseofthePBSistorequireanapplicanttoscoreacertainnumberofpointsfromoneormoreofthreedifferentareas.Thenumbertobeachievedfromeachcategoryvaries.

Theimmigrationrulesonentryforworkarefoundatrules245AA-ZA（Tier1）,245ZB-ZH（Tier2）and245ZBto245ZH（Tier5）oftheImmigrationRules.Therulesrelatingtoentryforstudyarefoundat245ZT–245ZZE（Tier4）.TheycanbefoundontheUKBAwebsiteat:

Therulesrefertotheappendicesthroughout.ThesespecificallystatetherequirementsofthePBStobemetinthreedifferentareas.Theareasare:

2.1EntryforStudy–Tier4

AstudentwillenterforstudyunderTier4PBS.

Para245ZTHC395onwardsstipulatetherequirementsforthoseover16whowanttostudyhere.IfsuccessfulinthiscategorytheapplicantwillgetleavetoremainasaTier4（General）Student.

Para245ZZdetailsseparaterequirementsforchildstudentsagedover4andunder18whoenterasaTier4（child）student.

InordertocometostudythepotentialstudentwillneedtobesponsoredbyaneducationalinstitutionintheUK.

2.2Sponsorship.

2.2.1RegisterofSponsorsandSponsorshipStatus

InordertorecruitstudentsfromoverseasaneducationalinstitutionwillneedtobeapprovedasaproviderbytheUKBA.

AstudentthereforeneedstohavebeenofferedaplacebyaTier4sponsortoapplyasastudent.

InordertoobtainthisapprovalthesponsormustobtainasponsorshiplicencefromtheUKBA.

OncealicenceisobtainedtheeducationalproviderwillbeaddedtotheregisterofsponsorsontheUKBAwebsite.

TheregisterofsponsorwillindicatewhetherthesponsorisahighlytrustedsponsororastandardsponsorwithanA（Trusted）rating.IfaneducationalestablishmentfallsintothelattercategoryitwillbeworkingwiththeUKBAtoimproveitssystems.

UKBAguidanceforsponsors,published4March2013,provides:

“17.WeexpectallTier4sponsorstobeeducationproviderswhocanmeetthestandardswehavesetforhighlytrustedsponsors.WhenyousuccessfullyapplyforaTier4sponsorlicence,wewillgiveyouanA-rating.Thisisatransitionalratingfor12months.YoumustapplyforHTSstatusnolaterthan12monthsfromthedatethatyouweregrantedyourlicence.

18.Wewillrevokeyourlicenceifyou:

a.cannotmeetthestandardswehavesetforHTSstatusafteryouhavehadyourlicencefor12months;or

b.donotapplyforHTSstatuswhenyouhavehadyourlicencefor12months;or

c.alreadyhaveHTSandyoudonotapplytorenewitbeforeitexpires;or

d.yourapplicationtorenewyourHTSstatusisrefused.

20.OnceyouhaveasponsorlicenceunderTier4youwillbeabletoassignCAStostudentswishingtocometotheUKtostudy.WewilldecidehowmanyCASyoucanassign.”

Sponsorsareexpectedtoachievehighlytrustedstatusinashortperiodoftime.Withoutthisstatustheywillbelimitedtotheamountofstudentstheycansponsorandthetypeofcoursethestudentsmayundertake.

2.2.2ConfirmationofAcceptanceofStudies

Whenanunconditionalofferismadetoapotentialstudenttheeducationalestablishmentassignsaconfirmationofacceptanceofstudies（CAS）tothatstudent.

Thisisavirtualdocumentwithuniquereferencenumbercontaininginformationaboutcourseandstudent’spersonaldetails.

Itisonlyvalidifcontains:

∙Student’sname,nationalityandpassportnumber.

∙Sponsor’slicencenumberanddetailsoftheinstitution.

∙Detailsofcoursetitle,startdateandexpectedenddate.

∙Latestdatestudentcanjoincourse.

∙Numberofhoursstudyperweek.

∙Detailsoffeesandaccommodationcostsandifpaidalready.

∙Anyworkplacements.

∙Listsevidenceprovidedbystudentwhenapplyingforcourse.

ThereshouldbenomorethansixmonthsbetweenissuingCASandapplicationforentryclearance.

Applicationforleavetoremainshouldbemadenomorethan3monthsbeforethestartdateofthecourseofstudyasstatedontheCAS.

IfastudenthasaCAStheycannotberefused.

However,sometimesCASremovedonarrivalifappearschangeincircumstances:

AsnotnowinpossessionofacurrentCASforanystudyintheUKwouldnotbeinapositiontomakeafreshapplication.

Furthermorepara28HC395makesitclearthattheapplicationforentryclearance“mustbemadetothepostinthecountryorterritorywheretheapplicantislivingwhichhasbeendesignatedbytheSecretaryofStatetoacceptapplicationsforentryclearanceforthatpurposeandfromthatcategoryofapplicant.Wherethereisnosuchposttheapplicantmustapplytotheappropriatedesignatedpostoutsidethecountryorterritorywhereheisliving."

ThereforeitismandatorythatanynewapplicationforTier4generalstudententryclearancebemadefromoutsidetheUnitedKingdom.

ConsequentlydespitetheunfortunateexperienceoftheClaimantonarrivalintheUKinJanuary2011therewerenoarguablegroundsthattheDefendanthasactedunlawfully.

Permissionforjudicialreviewthereforerefused.

2.2.3SponsorDuties

Thesponsorhastocomplywithanumberofdutiessetoutinparas516-550oftheMarch2013guidance.Theseinclude:

∙Recordkeepingduties,e.g.keepingcopiesofstudents’passports.

∙Reportingduties–mustinformUKBAifstudent:

∙doesnotenrolfortheircourse（paragraph538）;

∙doesnotmaintaincontact（paragraphs539to542）;

∙withdrawsfrom,ordefer,theirstudies（paragraphs543to546）;

Alsoifsponsor:

∙stopssponsoringthemforotherreasons（paragraph547）;or

∙Ifstudentorsponsor’scircumstanceschangesignificantly（paragraphs548to550）.

∙IfstudentdoesnotenrolwhenhavebeengivenaCASmustreporttoUKBA

nolaterthan10workingdaysaftertheenrolmentperiodhasended.（para534）

Includeinreportanyreasongivenbystudent,forexample:

•Missedtheirflight;

•DecidednottocometotheUK;

•Delayedtheirenrolment;

•Aredoingacoursewithadifferentsponsor;or

•UKBAhaverefusedthempermissiontocometo,orstayin,theUK.

∙Ifastudentdoesnotmaintaincontact:

∙MustinformUKBAifastudentdoesnotattend10expectedconsecutivecontactsandhavewithdrawnsponsorshipasaresult.

∙Examplesofexpectedcontactsincludelectures,tutorials,seminars,tests,exams,courseworksubmissionsetc.

DonothoweverneedtoinformUKBAifpermissiongivenformissingacontact,e.g.duetoillnessorinveryrarecircumstanceswhereinstitutionhaveallowedtocontinuecoursedespitemissingcontacts.

∙IfastudentwithdrawsordefersstudiesmustinformUKBA

oAlsoinformofaddressofinstitutionmayhavemovedto,ifknown.

∙Ifhavestoppedsponsorshipforotherreasons,e.g.changedtodifferentcategoryofPBSthatdoesnotneedsponsororhasfinishedcourseearly.

∙Ifsignificantchangeincircumstancesofstudentoreducationprovider.e.g.studentchangedcourseorproviderstoppedtrading.

3.1Tier4GeneralStudents–Requirements

3.1.1Immigrationrule

•Para245ZVimmigrationrulessetsoutrequirementsforstudents18andover.

•Mustnotfallfoulofgeneralgroundsofrefusal.
