ChapterI.Organization第一章组织

（EstablishmentandPurpose）（设立和目的）

Article1.第1条

1．Forthepurposeofprotectinglifeandpropertyandpreventing,detectingandsuppressingviolationoflawatsea,thereshallbeestablishedasanexternalorganizationunderthejurisdictionoftheMinisterofLIT,theJapanCoastGuardinaccordancewithparagraph2ofArticle3oftheNationalGovernmentOrganizationLaw（LawNo.120of1948）.为了保护海上生命和财产，预防、调查和制止违法行为，根据国民政府组织法第3条第2款（1948年第120号法），成立受国土交通省管辖的外事组织日本海上警卫队。

2.2．按照内阁令颁发的港口法第2条规定划分河口港和内河港的分界线（1948年第174号法）。

（Duties）（职责）

Article2.第2条

1．为维护海上安全和秩序，日本海上保安厅履行职责有海上执法,海难搜寻与救助，防止海洋污染，预防和控制海上犯罪，调查和逮捕海上犯罪分子，管理海上交通，管理海上及水道助航设施，保障航行安全、对涉及以上事项的海上事件进行调查。

2．2.222以上ThosefunctionsheretoforeunderthejurisdictionoftheSecretariatoftheMinisterofTransport.以上职能由交通省秘书处管辖。

交通省海事总局的局长DirectorGeneral'sSecretariatoftheGeneralMaritimeBureauofMinistryofTransport,BureauofShipping,ShipBureau,BureauforSeafarers,CommissionsforMarineAccidentsInquiry,LighthouseBureau,HydrographicBureauorthosefunctionsofotheradministrativeauthoritieswhicharementionedintheprecedingparagraphshallbeplacedunderthejurisdictionoftheJapanCoastGuard.局长局长秘书处，航运局，船舶局，海员局，海事调查委员会，灯塔局，水文局或其他前款规定的行政职能划归到日本海上保安厅的管辖范围。

Article3.第3条

Article4.第4条

1．日本海上保安厅的VesselsandaircraftoftheJapanCoastGuardshallbeofsuchconstruction,equipmentandcapabilitiesasrequiredforthemaintenanceofaidstonavigation,conductofhydrographicsurveyandoceanographicalobservation,maintenanceofpeaceandorderatsea,assistancetomarinersindistressandprotectionoflifeandpropertyincaseofmarinecasualty.船舶和飞机应当具备为导航维护，水文调查和海洋观测，维护海上和平与秩序，援助遇险船员和保护海上事故中的生命和财产的结构、装备和功能。

2.2．AllvesselsoftheJapanCoastGuardshallbenumberedandsomarkedasclearlydiscerniblefromothervesselsandshallhoisttheJapanesenationalensignandtheflagoftheJapanCoastGuard.日本海上保安厅的船只应全部编号，并明确标明与其他船只区别的标识，悬挂日本国旗和日本海上保安厅的旗帜。

3．日本海岸保安厅的飞机应全部编号，并明确标明与其他飞机区别的标识。

（Functions）（职责）

Article5.第5条

InordertoperformthedutiesunderParagraph1ofArticle2,JCGshallcarryoutthefollowingfunctions:

为了履行第2条第1款的义务，日本海上保安厅应确保履行下列职责：

（1）Enforcementoflawsandregulationsatsea;

（1）海上执法;

（2）Rescueoflife,cargoandvesselsincaseofmarineaccidentandnecessaryassistanceincaseofnaturalcalamityandothereventwherereliefisrequired;

（2）救助海难事故中的人命、财产、船舶，并在海洋灾害发生时和其他需要救援的情况时实施救援；

（3）Systemsrelatingtotherescueandprotectionofvesselsindistressandthedisposalofdriftagesandsunkensubstances;（3）建立遇险船舶、漂浮物以及沉船、沉物的救助打捞体系；

（4）Investigationofmarineaccidents（otherthanthoseinvestigationsthatareconductedbytheMarineAccidentsInquiryAgency）;（4）海事调查（由海事事故调查机构调查的除外）;

（5）Removalofobstructiontovessels'navigation;（5）清除碍航物;

（6）SupervisionoverthoseotherthantheJapanCoastGuard,whoareengagedintheservicestorescuelife,cargoandvesselsatseaandremovalofobstructiontovessels'navigation;（6）对日本海上保安厅以外的人命、货物、船舶救助打捞单位、设施的监管；

（7）Supervisionrequiredforsafetyatseaoverthoseengagedinmaritimetransportationbusinessforpassengersorcargoes;（7）对从事海上旅客、货物运输的单位实施安全监管，确保海上运输的安全；

（8）Rulesofsailingandsignalsfornavigation;（8）航行规则和导航信号;

（9）Portregulations;（9）港口规章;

（10）Matterstheassuranceofsafevesseltrafficinareascongestedwithvesseltraffic;（10）确保船舶交通拥挤区域的船舶航行安全；

（11）Mattersconcerningpreventionofmarinepollutionandmaritimedisaster;（11）有关海洋污染和海洋灾害的预防工作;

（12）Patrolofcoastalwaters;（12）沿海水域巡航;

（13）Suppressionofriotsanddisturbancesatsea;（13）制止海上暴动和骚乱;

（14）Searchforandarrestofcriminalsatsea;（14）调查、控制海上犯罪行为；

（15）Mattersconcerninginternationalmutualassistanceininvestigation;（15）国际调查互助的工作;

（16）Mattersconcerningcooperation,mutualassistanceandliaisonservicebetweentheJapanCoastGuardandtheNationalPoliceAgencyandprefecturalpolice（hereafterreferredtoas"policeauthorities"）,customhouses,quarantinestationsandotheradministrativeauthoritiesconcerned;（16）日本海上保安厅和警察厅、地方警察（以下简称“警察机关”）海关、检疫站和其他有关行政机关的合作、互助和联络事务；

（17）MattersconcerninginternationalreliefactivitiesundertheLawConcerningDispatchofJapanDisasterReliefTeams（LawNo.93of1987）;（17）根据日本灾难救助队派遣法（1987年第93号法）从事国际救援活动；

（18）Hydrographicsurveyandoceanographicalobservations;（18）水文调查和海洋学观测;

（19）Preparationandsupplyofhydrographicpublicationsandaeronauticalchartsandpublications;（19）制备和供应水文出版物、海图及出版物;

（20）Informationofmattersnecessaryforthesafetyofnavigation;（20）发布对航行安全有必要的信息；

（21）Construction,maintenanceandoperationoflighthousesandotheraidstonavigationandfurnishingofsuppliesforthem;（21）建造、维护及操作灯塔和其他导航设施以及相关的物品供应;

（22）Meteorologicalobservationwiththeuseofinstallationsattachedtolighthousesandothernavigationaids,andreportsthereof;（22）凭借在航标灯塔和其他助导航设施上的设备进行气象观察和报告；

（23）SupervisionoverthoseotherthantheJapanCoastGuard,whoareengagedinconstruction,maintenance,oroperationoflighthousesandotheraidstonavigation;（23）除海上保安厅以外建造、维护或操作灯塔和助航设施事务的监督;

（24）Internationalcooperationconcerningthefunctions;（24）有关职能的国际合作;

（25）TrainingregardingthefunctionsintheeducationaltraininginstitutesprovidedbytheCabinetOrder;（25）依据内阁令开展教育培训的机构进行职能培训；

（26）Construction,maintenanceandoperationofthevesselsandaircraftusedfortheperformanceofthefunctions;（26）建造、维护和操作用于履行职责的船艇和飞机;

（27）Construction,maintenanceandoperationofcommunicationinstallationsusedfortheperformanceofthefunctions;（27）建造、维护和操作用于履行职责的通讯设备;

（28）DutiesprovidedintheParagraph1ofArticle2otherthanthosementionedineachoftheprecedingitems.（28）履行前面所列条款之外在第2条第1款规定的其他职责。

（Commandant）（司令官）

Article10.第10条

1．TheheadoftheJapanCoastGuardshallbetheCommandant.日本海上保安厅负责人是司令官。

2．2.2、TheCommandantoftheJapanCoastGuardshallpresideovertheAgencyaffairsanddirectandsupervisehissubordinatepersonnelunderthedirectionandsupervisionoftheMinisterofLIT:

ProvidedthatregardingtheserviceunderthejurisdictionofaMinisterotherthanMinisterofLIT,heshallbeunderthedirectionandsupervisionofthecompetentMinister.日本海上保安厅司令官在国土交通省的指挥和监督下主持机构事务并指挥和监督下属人员：

在其他司法管辖区而不是国土交通省开展的工作，受主管大臣的指挥和监督。

（RegionsandRegionalHeadquarters）（区域与区域总部）

Article12.第12条

1．ThewholecountryandcoastalwatersofJapanshallbedividedintocoastguardregionsandeachofthoseregionsshallhaveoneRegionalCoastGuardHeadquartersallottedwithpartoffunctionsoftheJapanCoastGuard.整个国家和日本沿海水域分为海上保安厅分区，每个分区有一海上保安厅总部并分配海上保安厅的部分职能。

2.2．由内阁令规定TheareaandnameofeachMaritimeSafetyRegionandthenameandlocationofeachRegionalCoastGuardHeadquartersshallbeprovidedbytheCabinetOrder.每个区域海上保安厅总部地点的名称以及海上安全区的区域和名称。

3.3．地区RegionalCoastGuardHeadquartersmayhaveDeputyCommandersprescribedbytheCabinetorder.海上保安厅总部可以由内阁令设定副司令官。

4.4．地区海上保安厅总部可以由国土交通省条例设定部门，人数由内阁令设定。

5.5．除Otherthanthoseprescribedbytheprecedingtwoparagraphs,internalorganizationofeachRegionalCoastGuardHeadquartersshallbeprescribedbytheMinistryofLITOrdinance.前两款规定之外，由国土交通省条例规定每个区域海岸警卫队总部的内部组织机构。

6.6．为Whenhedeemsitnecessarytoensuresmoothperformanceofadministrationofaidstonavigationorotherservices,theMinisterofLITmayallotoneregionalheadquarterswithpartoffunctionsofanotherregionalheadquartersforamatterrelatedtoanareaadjacenttothejurisdictionalboundariesofthetworegionalheadquartersinvolved.确保对助导航标志管理或其他服务平稳运行，国土交通省认为有必要，可以分配一个区域总部和另一个区域总部的一部分职能来处理在两个总部管辖区域交界的事务。

（CoastGuardOfficesandOtherOffices）（海上保安厅办事处和其他办公地点）

Article13.第13条

为了分摊区域海上保安厅的部分职能，国土安全省可以在必要的地方设立区域海上保安厅办办事处。

由国土安全省条例设定该办事处名称、地点、辖区范围、职责范围和内设机构。

（CoastGuardOfficers,TheirRanksandDuties）（海上保安厅人员级别和职务）

Article14.第14条

1．TheJapanCoastGuardshallhaveCoastGuardOfficersandassistantCoastGuardOfficers.日本海上保安厅设有海上保安厅人员和海上保安厅辅助人员。

2.2．由内阁令设定TheranksoftheCoastGuardofficersandassistantCoastGuardofficersshallbeprovidedbytheCabinetOrder.日本海上保安厅人员和辅助人员的级别。

3.3．CoastGuardofficersshall,byorderofsuperiors,performthedutiesprescribedintheParagraph1ofArticle2.海岸警卫队人员，按照上级的命令，执行在第2条第1款所规定的职责。

4.4．AssistantCoastGuardofficersshallassistCoastGuardOfficersinperformingtheirduties.日本海上保安厅辅助人员应协助海上保安厅人员履行职责。

（StatusofCoastGuardOfficersinLawEnforcementDuties）（日本海上保安厅从事执法工作人员的地位）

Article15.第15条

海上保安厅人员按照本法执行法律或命令时，在职权范围内，应被视为执行特定法律的特别行政办公室办事员，遵守该办公室颁布的与该法律执行相关的所有法规。

（CoastGuardOfficers'RequestforAssistancefromNearbyPersons,etc.）（海上保安厅人员向附近人士等请求协助）

Article16.第16条

执行第5条第2款涉及的职责，或者为了逮捕罪犯或在任何紧急情况下，任何有必要的情况下，海上保安厅人员可以要求附近人士和船舶的协助。

（CoastGuardOfficers'RighttoOrderPresentationofShip'sPapers,toVisitandInspectaVesselorQuestionPersons）（海上保安厅人员有权要求出示船舶证书，调查和检查船只或怀疑对象）

Article17.第17条

1．ACoastGuardofficermay,whennecessaryfortheperformanceofhisduties,directtheshipmasterorotherpersoncommandingavesselinsteadoftheshipmastertoproducetheship'sofficialpaperswhicharetobekeptaboardunderlawandorder;stop,visitandinspectthevesselforthepurposeofascertainingheridentity,portofregistry,nameoftheshipmaster,lastportorplaceofdeparture,portorplaceofdestination,natureofhercargo,orwhethersheisloadedornot,andallotherparticularsaboutvessels,cargoandnavigationwhicharedeemedimportant;orquestionthecrewandpassengersonmattersnecessaryfortheperformanceofhisduties.海上保安厅人员在履行职责时，可以在必要的时候，要求船长或代替船长指挥船只的其他人出示
