Article1ThisLawisenactedinaccordancewiththeConstitutionofthePeople’sRepublicofChinawithaviewtoensuringthestatusoftradeunionsinthepolitical,economicandsociallifeoftheState,definingtheirrightsandobligationsandbringingintoplaytheirroleinthesocialistmodernizationdrive.

Article2Tradeunionsaremassorganizationsoftheworkingclassformedbytheworkersandstaffmembersonavoluntarybasis.

TheAll-ChinaFederationofTradeUnionsandallthetradeunionorganizationsunderitrepresenttheinterestsoftheworkersandstaffmembersandsafeguardthelegitimaterightsandinterestsoftheworkersandstaffmembersaccordingtolaw.

Article3Allmanualandmentalworkersinenterprises,institutionsandgovernmentdepartmentswithintheterritoryofChinawhorelyonwagesorsalariesastheirmainsourceofincome,irrespectiveoftheirnationality,race,sex,occupation,religiousbelieforeducationalbackground,havetherighttoorganizeorjointradeunionsaccordingtolaw.Noorganizationsorindividualsshallobstructorrestrictthem.

Article4TradeunionsshallobserveandsafeguardtheConstitution,takeitasthefundamentalcriterionfortheiractivities,takeeconomicdevelopmentasthecentraltask,upholdthesocialistroad,thepeople’sdemocraticdictatorship,leadershipbytheCommunistPartyofChina,andMarxist-Leninism,MaoZedongThoughtandDengXiaopingTheory,persevereinreformandtheopenpolicy,andconducttheirworkindependentlyinaccordancewiththeConstitutionoftradeunions.

TheNationalCongressofTradeUnionsformulatesoramendstheConstitutionofTradeUnionsofthePeople’sRepublicofChina,whichshallnotcontravenetheConstitutionofthePeople’sRepublicofChinaorotherlaws.

TheStateprotectsthelegitimaterightsandinterestsoftradeunionsfromviolation.

Article5Tradeunionsshallorganizeandconducteducationamongworkersandstaffmembersinorderthattheyshall,inaccordancewiththeprovisionsoftheConstitutionofthePeople’sRepublicofChinaandotherlaws,giveplaytotheirroleasmastersofthecountryandparticipateinvariouswaysandformsintheadministrationofStateaffairs,managementofeconomicandculturalundertakingsandhandlingofsocialaffairs;tradeunionsshallassistthepeople’sgovernmentsintheirworkandsafeguardthesocialistStatepowerunderthepeople’sdemocraticdictatorshipledbytheworkingclassandbasedontheallianceofworkersandpeasants.

Article6 Thebasicdutiesandfunctionsoftradeunionsaretosafeguardthelegitimaterightsandinterestsofworkersandstaffmembers.WhileprotectingtheoverallinterestsoftheentireChinesepeople,tradeunionsshallrepresentandsafeguardthelegitimaterightsandinterestsofworkersandstaffmembers.

Tradeunionsshallcoordinatelaborrelationsandsafeguardtherightsandinterestsenjoyedinworkbytheworkersandstaffmembersofenterprisesthroughconsultationatanequalfootingandthecollectivecontractsystem.

Tradeunionsshall,inaccordancewiththeprovisionsoflawsandthroughthecongressesoftheworkersandstaffmembersorotherforms,organizetheworkersandstaffmemberstoparticipateindemocraticdecision-makingandmanagementofanddemocraticsupervisionovertheirownworkunits.

Tradeunionsshallmaintainclosetieswithworkersandstaffmembers,solicitandvoicetheiropinionsanddemands,showconcernfortheireverydaylife,helpthemsolvetheirdifficultiesandservethemwholeheartedly.

Articles7Tradeunionsshallmobilizeandorganizeworkersandstaffmemberstotakeanactivepartineconomicdevelopmentandtostrivetofulfilltheirtasksinproductionandotherwork.Tradeunionsshalleducateworkersandstaffmembersconstantlyintheneedtoimprovetheirideological,ethical,technical,professional,scientificandculturalqualities,inordertobuildacontingentteamofwell-educatedandself-disciplinedworkersandstaffmemberswithloftyidealsandmoralintegrity.

Article8TheAll-ChinaFederationofTradeUnionsshall,ontheprincipleofindependence,equality,mutualrespectandnon-interferenceineachother’sinternalaffairs,strengthenfriendlyandcooperativerelationswithtradeunionorganizationsofothercountries.

ChapterIITradeUnionOrganizations 

Article9Tradeunionorganizationsatvariouslevelsshallbeestablishedaccordingtotheprincipleofdemocraticcentralism.

Tradeunioncommitteesatvariouslevelsshallbedemocraticallyelectedatmembers’assembliesormembers’congresses.Nocloserelativesofthechiefmembersofanenterprisemaybecandidatesformembersofthebasic-leveltradeunioncommitteeoftheenterprise.

Tradeunioncommitteesatvariouslevelsshallbeaccountable,andreporttheirwork,tothemembers’assembliesormembers’congressesattheirrespectivelevelsandbesubjectedtotheirsupervisionaswell.

Tradeunionmembers’assembliesorcongressesshallhavetherighttoremoveorrecalltherepresentativesormembersoftradeunioncommitteestheyelected.

Atradeunionorganizationatahigherlevelshallexerciseleadershipoveratradeunionorganizationatalowerlevel.

Article10     Abasic-leveltradeunioncommitteeshallbesetupinanenterprise,aninstitutionoragovernmentdepartmentwithamembershipoftwenty-fiveormore;wherethemembershipislessthantwenty-five,abasic-leveltradeunioncommitteemaybeseparatelysetup,orabasic-leveltradeunioncommitteemaybesetupjointlybythemembersintwoormoreworkunits,oranorganizermaybeelected,toorganizethemembersinvariousactivities.Wherefemaleworkersandstaffmembersarerelativelylargeinnumber,atradeunioncommitteeforfemaleworkersandstaffmembersmaybesetup,whichshallcarryoutitsworkundertheleadershipofthetradeunionatthecorrespondinglevel;wheretheyarerelativelysmallinnumber,theremaybeamemberinchargeofthefemaleworkersandstaffmembersonatradeunioncommittee.

Intownships,townsorinurbanneighborhoods,whereworkersandstaffmembersofenterprisesarerelativelylargeinnumber,jointbasic-leveltradeunionfederationsmaybesetup.

Localtradeunionfederationsshallbeestablishedinplacesatorabovethecountylevel.

Industrialtradeunionsmaybeformed,whenneeded,atnationalorlocallevelsforasingleindustryorseveralindustriesofasimilarnature.

TheAll-ChinaFederationofTradeUnionsshallbeestablishedastheunifiednationalorganization.

Article11Theestablishmentofbasic-leveltradeunionorganizations,localtradeunionfederations,andnationalorlocalindustrialtradeunionorganizationsshallbesubmittedtothetradeunionorganizationatthenexthigherlevelforapproval.

Tradeunionorganizationsathigherlevelsmaydispatchtheirmemberstoassistandguidetheworkersandstaffmembersofenterprisestosetuptheirtradeunions,nounitsorindividualsmayobstructtheeffort.

Article12Noorganizationsorindividualsmaydissolveormergetradeunionorganizationsatwill.

Abasic-leveltradeunionorganizationshallbedissolvedaccordinglywhentheenterpriseorinstitutionorgovernmentdepartmenttowhichitbelongsisterminatedordissolved,andthemattershallbereportedtothetradeunionorganizationatthenexthigherlevel.

Themembershipofthemembersofthedissolvedtradeunionorganizationspecifiedintheprovisionsoftheprecedingparagraphmayberetained,andthespecificadministrativemeasuresinthisregardshallbeformulatedbytheAll-ChinaFederationofTradeUnions.

Article13Foratradeunioninanenterpriseorinstitutionwithtwohundredandmoreworkersandstaffmembers,theremaybeafull-timechairman.Thenumberofthefull-timefunctionariesofatradeunionshallbedeterminedbythetradeuniontogetherwiththeenterpriseorinstitutionthroughconsultation.

Article14TheAll-ChinaFederationofTradeUnions,alocaltradeunionfederationoranindustrialtradeunionenjoysthestatusofalegalpersoninthecapacityofapublicorganization.

Abasic-leveltradeunionorganization,whichhasacquiredthequalificationsofalegalpersonasprescribedintheGeneralPrinciplesoftheCivilLaw,shall,inaccordancewithlaw,begrantedthestatusofalegalpersonasapublicorganization.

Article15Thetermofofficeofthebasic-leveltradeunioncommitteeisthreeorfiveyears.Thetermofofficeofthecommitteesofthelocaltradeunionfederation
